Abstract

This study aims to explore the strategies for empowering the community's economy through the management of waqf assets at Baitussalihin Mosque in Ulee Kareng, Banda Aceh City. The problem formulation encompasses the challenges and opportunities in empowering the community's economy through waqf, focusing on the role of Baitussalihin Mosque as a center of activities and a symbol of philanthropy in its community. The research method used is qualitative descriptive with a case study approach, including interviews, document studies, and participant observation. The main findings highlight important strategies that can be applied, including increasing community participation through extensive socialization, enhancing the competence of waqf managers, collaboration with third parties, improving administrative systems with clear regulations, and utilizing modern technology in waqf management. It is hoped that the holistic implementation of these strategies can significantly contribute to empowering the community's economy through waqf resources, with the potential to enhance the welfare of the community as a whole.

Abstract

There are two opinions of scholars in the law of buying and selling gold for cash, the first is the majority of scholars who stated that it is forbidden to buy and sell gold for cash with the existence of sharîh arguments stating the prohibition and the second is the opinion of Ibn Taimiyyah who stated that the law of buying and selling gold for cash is permissible, with the disappearance of ʻIllat Hukum from gold.The author uses qualitative research methods with an approach that is descriptive analysis by using primary data obtained from the Fatwa DSN-MUI and secondary data obtained through the collection of literature related to this research.The majority of scholars view that it is not possible to change the law of buying gold in cash from haram to mubah with the disappearance of ʻIllat Hukum from gold because it does not fulfil the requirements of ʻIllat Hukum while Ibn Taimiyyah views the change as possibleKeyword:  'Illat Law; Selling Gold; Ulama

Abstract

Indonesian people's understanding of murabahah products in Islamic banks is still uneven. In January 2020, the Murabahah contract had the largest portion in Indonesian Islamic banking, which was around 58%, while the musyarakah contract was 39.5% and the mudharabah contract was 2.5%. The main problem in this study is how high the level of understanding of Bank Syariah Mandiri and BTN Syariah Serang customers on murabahah buying and selling, and whether the level of customer understanding can affect investment in Bank Syariah Mandiri and BTN Syariah bank Serang Banten. The author collected primary data with field research with a quantitative descriptive approach, with a questionnaire to 100 customers of Bank Syariah Mandiri and Bank BTN Syariah Serang Banten. The results of this study show: First, customers of Bank Syariah Mandiri Serang have an understanding level of 97.4%, while customers of BTN Syariah Bank Serang have an understanding level of 95.2%. Second, the opinion of customers who think that the level of understanding can affect the interest in investing in Islamic banks is 93.8% for Mandiri Syariah Bank customers, and BTN Syariah Bank customers are 95.3%.

Abstract

Introduction: This article explores the implementation and regulatory challenges of Sharia economic law in Indonesia and Malaysia, two key players in Islamic finance. Both countries have integrated Islamic principles into their economic frameworks, but their approaches differ due to legal, historical, and political factors.Purposes of the Research:  The purpose of this article is to analyze and compare the regulatory frameworks governing Sharia economic law in Indonesia and Malaysia. It aims to highlight both the successes and obstacles in implementation, while offering potential recommendations for improvement.Methods of the Research: This study employs a comparative legal research methodology, analyzing primary legal sources such as laws, regulations, and official guidelines from Indonesia and Malaysia. Secondary sources, including academic articles and government publications, provide context for understanding how these frameworks are implemented.Results of the Research: The research finds that Malaysia’s centralized regulatory system, led by the Sharia Advisory Council (SAC), provides clear guidelines for Sharia-compliant financial products. In contrast, Indonesia’s regulatory framework is more fragmented, with overlapping responsibilities between institutions, creating challenges for effective implementation.

Abstract

Introduction: The rapid development of digital technology has introduced new challenges in the practice of inheritance distribution, particularly concerning digital assets such as cryptocurrency and NFTs.Purposes of the Research: This study aims to explore gender justice in the distribution of digital inheritance, focusing on the Islamic fiqh perspective toward cryptocurrency and NFTs assets in Dubai.Methods of the Research: Using a qualitative approach, the research analyzes fiqh texts, existing regulations, and real-life cases related to digital inheritance. Data were collected through document analysis, case studies, and expert interviews involving Islamic scholars and digital asset practitioners in Dubai.Results of the Research: The findings reveal that digital inheritance, characterized by unique properties such as anonymity and the need for secure access, presents significant challenges in ensuring fair distribution, especially for women. The study highlights cultural and technological barriers that limit women’s access to digital inheritance, despite their growing economic contributions. The novelty of this research lies in proposing a contemporary fiqh framework that integrates traditional Islamic principles with modern technological solutions such as blockchain, aiming to ensure transparency and fairness in inheritance distribution. By addressing the gender gap in digital inheritance, this research contributes to the development of equitable and practical fiqh guidelines for Muslim communities in the digital era.

Abstract

Tujuan dalam penelitian ini adalah untuk menganalisa implementasi penyaluran zakat produktif di Lembaga Manajemen Infaq dan kesesuaian implementasi tersebut dengan pendekatan studi kasus. Hasil dari penelitian ini implementasi penyaluran zakat produktif di Lembaga Manajemen Infaq dalam pendistribusian zakat produktif adalah dengan mendistribusikan kepada wilayah terdekat, dan melakukan assessment langsung terhadap penerima zakat produktif, melalukan pemberdayaan zakat produktif dengan cara membuat program yang disesuaikan dengan karakteristik mustahik tersebut, sehingga instrument, cara pendistribusiannya dan langkah pemberdayaan zakatnya sudah sesuai. Lembaga Manajemen Infaq telah melakukan pelatihan dan pendampingan yang maksimal dari sisi perekonomian dan keagamaan.
