Abstract

Enriching the perspective of the science of hadith can be done with the study of hadith which focuses on the sociological-historical dimension. One of studies that use a sociological-historical perspective is the science of Mukhtalif al-Hadith formulated by al-Shafi'i. The sociological approach to knowledge is used in this article to uncover the sociological dimension of the formation of mukhtalif al-hadith. The results of this approach reveal that the formulation of the science of mukhtalif al-hadith al-Shafi'i is started from the thoughts about the hadith during al-Shafi'i, especially those which are destructive to the position of hadith. In observing the sociology of knowledge, the science of mukhtalif al-Hadith formulation of al-Syafi'i must be open in order to create new method contributions in the meaning of mukhtalif hadiths.

Abstract

Gerdu is one of the neighborhoods located in the middle of the Wonogiri sub-district, Wonogiri Regency. Wonogiri has the title as the city of 'abangan'. However, the Gerdu community is enthusiastic in carrying out almsgiving activities on Friday blessing. This raises the question of how the community's understanding is related to the alms hadith (Hadith Sadaqah) and the community's motivations in carrying out almsgiving activities on Friday blessing. This research is a qualitative research using a phenomenological approach. Data analysis technique went through three stages, namely orientation, reduction and selection. The result of this study is that the understanding and implementation of the Gerdu community in the Wonogiri sub-district is carried out correctly and is in accordance with the Hadith. The Gerdu community in Wonogiri sub-district interprets alms as an activity to share their assets with families and people in need. The Gerdu community of Wonogiri sub-district already knows that the law of alms is a sunnah to be implemented, but for the Gerdu community of Wonogiri sub-district who are already accustomed to giving alms, they feel themselves obliged to give alms. While the implementation of the sadaqah hadith in the form of food alms in almsgiving activities on Friday blessings. As for the motivation of the Gerdu community in Wonogiri sub-district, there are two motivations, namely internal motivation and external motivation. The internal motivation is that there is a feeling of happiness when giving alms, a feeling of being stuck when not giving alms, people's beliefs about alms bringing sustenance, giving charity for da'wah bil hal. External motivation includes the availability of property owned, motivated from others, wanting to achieve husnul khotimah, understanding the true nature of property, and making it easier in all affairs.

Abstract

The people of Nagari Sungai Tanang, Banuhampu District, have long performed waqf by raising fish in a large pond that the community calls Tabek Gadang. When the waqf fish are ready to be harvested, thousands of fishermen catch some of the fish several times, and the money from fishing can be used to finance mosques, prayer rooms, and other things. Some fish are sold to traders, and others are shared or fought over by the community. It is important to conduct this study to analyze Carotai Waqf in the Nagari Sungai Tanang community by exploring the values that the community considered in carrying out this tradition and how was istiḥsān view towards it, considering that this activity originated from land waqf in the form of Tabek Gadang, produced through the istiḥsān approach. A qualitative method with an ethnographic approach was used to answer the focus of this research. The result showed that people carried out Carotai Waqf to pass on the values of togetherness and kinship and to foster the nature of trust to the next generation. Even though in terms of general arguments, no one regulated or allowed it, turning to other arguments based on istiḥsān with ijmā’, this can be used to continue the tradition of Carotai Waqf.AbstrakMasyarakat Nagari Sungai Tanang Kecamatan Banuhampu sudah lama melaksanakan wakaf dengan pemeliharaan ikan di sebuah kolam ikan besar yang oleh masyarakat disebut Tabek Gadang. Setelah ikan-ikan dari wakaf itu siap panen, sebagian dipancingkan beberapa kali pemancingan dengan ribuan para pemancing dan uang hasil pemancingan tersebut dapat dipergunakan untuk pembiayaan masjid, mushalla dan peruntukkan lain. Sebagian dijual kepada para pedagang, dan sebagian lain dicarotaikan atau diperebutkan oleh ribuan masyarakat. Penelitian ini dilakukan untuk mengkaji tentang carotai wakaf pada masyarakat Nagari Sungai Tanang dengan mendalami nilai-nilai yang menjadi pertimbangan masyarakat melakukan budaya tersebut dan bagaimana pandangan istiḥsān mengingat ia berasal dari tanah wakaf berupa Tabek Gadang yang diproduktifkan. Metode kualitatif dengan pendekatan etnografi dipergunakan untuk menjawab fokus penelitian ini. Hasil penelitian menunjukkan bahwa masyarakat melalukan carotai wakaf tersebut untuk mewariskan kepada generasi berikutnya nilai-nilai kebersamaan, kekeluargaan dan memupuk sifat amanah, meskipun dari segi dalil umum tidak ada yang mengatur dan membolehkannya. Akan tetapi, dengan beralihnya kepada dalil lain berdasarkan istiḥsān dengan ijmā’ dapat dijadikan pertimbangan untuk terus berlanjutnya budaya atau tradisi carotai wakaf ini.

Abstract

This paper discusses how PAS follows democratic way to achive its political goal to establish an Islamic state. Is it true that the establishment of PAS was triggered by its motive to struggle for Islamic state which is not addressed by UMNO? What and how is the concept of Islamic state according to PAS? How and to what extent did Muslim and non-Muslim in Malaysia accept PAS idea, in Malaysian election history, particularly in the last 2018 election? By analysing document of PAS Islamic state, party’s statute, and PAS performance from election to election, the researcher argues that up to present PAS was unsuccessfull to reach its political goal yet. PAS only won and occupied Kelantan and several times won in Sabah and Terengganu. The result of 2018 election shows that PAS was beaten by Pakatan Harapan coallition as well as Barisan Nasional coalition. However, PAS’s struggle through democratic way has significantly contributed to reduce a negative image of Islamic movement in South East Asia. Islam is not monolithic and Islam is compatible with democracy. PAS’s struggle is a clear proof.
