Abstract

Government employees with contract agreements or often known as PPPK have been around for quite a long time. PPPK has even provided its own dynamics related to the personnel management system in Indonesia. PPPK can be said to be a transformation and eliminates the terminology of honorary employees. The PPPK nomenclature has actually existed since the birth of Law No. 5 of 2014 concerning the State Civil Apparatus. However, Law No. 20 of 2023 concerning the State Civil Apparatus provides more strengthening of the rights of PPPK. In both laws, PPPK is placed as part of the state civil apparatus (ASN) just like civil servants. However, even though it is included in ASN, the rights obtained by PPPK are not the same as PNS. Even PPPK using a contract system certainly does not provide certainty about its work period. This study uses normative legal research with the approach used being the statutory approach. The results of the study show that the existence of PPPK since 2014/2015 has been known. In 2023, since the birth of Law No. 20 of 2023 concerning State Civil Apparatus, the rights obtained by PPPK are stronger. However, regarding the certainty of the work period, PPPK still has differences with PNS. The work period of PNS will end when they reach retirement age, while PPPK will end their work period when the work agreement period ends. So that PPPK can be extended again or not based on the needs of each agency and an assessment of the achievement of performance targets which causes there to be no certainty regarding the work period for employees with PPPK status.

Abstract

Tujuan dari penelitian ini adalah untuk mengkaji kebijakan insentif yang berkelanjutan dalam perlindungan lahan pertanian pangan di masa mendatang. Untuk menahan laju konversi lahan pertanian menjadi lahan non-pertanian, Pemerintah bersama dengan Dewan Perwakilan Rakyat mengesahkan lahirnya Undang-Undang Nomor 41 Tahun 2009 tentang Perlindungan Lahan Pertanian Pangan Berkelanjutan. Undang-Undang ini diharapkan dapat menahan laju konversi lahan pertanian menjadi non-pertanian. Salah satu hal yang diatur dalam undang-undang tersebut adalah terkait dengan kebijakan pemberian insentif, akan tetapi kebijakan tersebutmasih berbasis lahan, sehingga insentif hanya diberikan kepada pemilik lahan pertanian yang tidak mengalihfungsikan lahan pertanian pangan. Di mana dengan perkembangan teknologi sekarang ini serta untuk menjaga ketahanan pangan, maka pengembangan varietas unggul pertanian tidak harus dikembangkan berbasis lahan. Oleh karena itu, untuk menjaga ketahanan pangan, diperlukan suatu upaya untuk mengembangkan kebijakan yang tidak hanya berbasis lahan. Metode yang digunakan dalam penelitian ini adalah metode penelitian hukum yuridis normatif dengan menggunakan pendekatan perundang-undangan (statute approach). Analisis data dilakukan dengan menggunakan metode kualitatif berdasarkan logika berpikir deduktif. Berdasarkan penelitian yang dilakukan diperoleh bahwa kebijakan pemberian insentif kepada petani masih berbasis luas lahan, di mana salah satu pertimbangan pemberian insentif adalah memiliki luas tanam paling sedikit 25 (dua puluh lima) hektar dan kebijakan pemberian insentif kepada petani dalam rangka perlindungan lahan pertanian dinilai kurang tepat, karena insentif yang diberikan masih berupa program reguler yang dilaksanakan oleh pemerintah.

Abstract

Proposing the position of Constitutional judge from 3 (three) branches of power to guarantee the independence of the Constitutional Cout ar asĀ  a Defender of Constitution On September 29 2022, the DPR RI proposed dismissing MK judge Aswanto in the middle of his term of office on the grounds that he often disappointed the DPR. Aswanto, who was elected by the DPR, was the subject of dismissal which raised questions regarding the independence and impartiality of the Constitutional Court (MK). This article aims to discuss how proposals for the dismissal of Constitutional Judges should be carried out in accordance with the mandate of Law Number 7 of 2020, and to emphasize that the Constitutional Court has no obligation to be responsible for the proposing institution. As a result, there is no place for the removal process of judges while they are still in tenure due to political considerations in implementing judicial policies.
