Abstract

The question of being an object in this paper is about the reconstruction of land law in the view of Islamic law, how Islam also participates in the mapping of the fairness of the money, which is for the welfare of the ummah. In the case of the use of twisted land (land belonging to village government) is the question of whether the land is solely for the sake of the provision of the salaries of village officials or more than that for the purpose of Village development. This research is done using a qualitative approach with the intent to know how the existence of the information Village program in the view of rural residents is the target of the program. The data collection process relies on observation methods and interviews.

Abstract

Abstract

Marriage is a very important aspect of human life around the world, so it is not surprising that religions around the world regulate marriage; even traditions, customs of society, and state institutions are not left behind in regulating marriage. This research uses a conceptual approach. The data source used entirely uses literature research, while secondary data is used as a way to examine the primary data studied. Data collection techniques use descriptive analysis. The data analysis uses content analysis as an effort to provide comparisons to find suggestions and solutions, and conclusions are drawn. The results showed that the factor that forms the norm of the principle of social maturity is gender, especially because it is the basis for distinguishing between an assessment of biological and psychological maturity and, furthermore, religious traditions that can be the beginning of an understanding of the minimum age of marriage. In terms of the use of the principle regarding age limits—at least a principle that is commensurate with the principle that has been previously used, namely the principle of being old enough-this principle as a legal category is actually sufficient to represent the expectations or ethical demands of legal material. However, it is less able to provide certainty by providing open access for the community to participate.

Abstract

Waqf is one of the instruments of Islamic philanthropy that has great potential in improving the welfare of the people. Nadzir holds a central role as the party responsible for the management and development of waqf assets. This article aims to examine the professionalism and ethics of waqf nadzir from the perspective of Islamic law, using the theory and analysis of maqāṣid al-sharī'ah on the practice of productive waqf in Indonesia. This research uses a qualitative-descriptive approach through the method of literature study, referring to classical and contemporary Islamic law sources as well as national waqf regulations. The results of the study show that efforts to improve the professionalism of a waqf nadzir are to prioritize the principles of Islamic law. Commitment to justice and transparency is a moral-legal responsibility in the management of waqf property. Therefore, strengthening the capacity and integrity of a nadzir is essential to make waqf an instrument for sustainable economic development of the ummah.

Abstract

Fiscal policy is a primary instrument used by the state to regulate and promote economic development. In Indonesia, the Motor Vehicle Tax (PKB) and Regional Retribution remain important sources of revenue for provincial governments, including East Java. However, the modern taxation system often gives rise to debates concerning justice, effectiveness, and its impact on lower-middle-class groups. This article explores the concept of the state and fiscal system in Islamic law through an analysis of the thought of Abul A‘la al-Maududi, a contemporary Islamic thinker who made significant contributions to the discourse on Islamic politics and Sharia-based economics. The study focuses on the relevance of al-Maududi's ideas to the implementation of tax and regional retribution policies in East Java, particularly in the context of distributive justice and state responsibility according to the principles of Sharia. Using a qualitative approach and literature review method, this article finds that al-Maududi views the Islamic state as a divine entity tasked with upholding social justice through fair and responsible resource management. In its fiscal system, taxation is considered a complementary mechanism to zakat and must not be oppressive. When applied to local fiscal policies such as motor vehicle taxes and public service retributions in East Java, al-Maududi’s thought emphasizes the importance of the principles of public interest (maṣlaḥah), justice, and transparency in implementation. This study recommends a reassessment of local fiscal policies to better align with the values of maqāṣid al-sharī‘ah and Islamic fiscal ethics.
