Abstract

The meaning former kingdom lands which is diffrent between the government and the kingdom became one of the triggers of the conflict in Indonesia. Horizontal conflict involves the community, kingdom and local government. Likewise at this time there were many conflicts related to ex-kingdom land which eventually ended in a court dispute in Surakarta City, namely the domein land of the Surakarta Palace and the domein Mangkunegaran land. The research was carried out using the Socio Legal method qualitatively. It was hoped that the meanings hidden behind the object and the subject under study were found. This approach was carried out to understand the law in the context of the community. In this study look at the reality of the validity of the land of the former Kingdom in Surakarta. The reality of the absence of a Government Regulation as instructed in Dictum IV letter B of UUPA resulted in a prolonged conflict between the Regional Government and the heirs of the kingdom as well as the people who have an interest in the land of the former kingdom. Based on the results of the study, the Kingdom of Surakarta, namely the Keraton and Mangkunegaran are indigenous people, because the King as the customary leader still has the same territorial area and descent and has authority in and out of his customary area. So that the land of the former kingdom applies as customary land for the Kingdom of Surakarta.

Abstract

Penguasaan negara atas bumi, air dan ruang angkasa mengandung arti memberi wewenang negara untuk mengatur dan menyelenggarakan peruntukan, penggunaan, persediaan dan pemeliharaan bumi, air dan ruang angkasa, antara orang dengan bumi, air dan ruang angkasa. Banyaknya permintaan pertambangan di Kabupaten Belitung di pesisir dan laut secara ilegal mendorong negara dengan kebijakannya mereklamasi hasil pertambangan dengan menjaga kondisi lingkungan yang berkelanjutan. Penelitian ini menggunakan data primer dan data sekunder. Data primer dikumpulkan melalui observasi di kawasan reklamasi dengan wawancara mendalam dengan responden pengelola lahan, dinas terkait, informan maupun pihak/tokoh kunci (key-persons) yang berkompeten. Data sekunder diperoleh melalui mengkaji kebijakan, kebiasaan masyarakat setempat sebagai kearifan lokal menjaga kelestarian lingkungan yang berkelanjutan. Hasil penelitian menunjukkan di Kabupaten Belitung banyak areal pesisir dan laut yang digunakan untuk pertambangan yang merusak lingkungan, maka diadakan kebijakan pemerintah. Target kegiatan orientasi yaitu seluruh elemen masyarakat dan para pihak terkait diharapkan dapat bermanfaat bagi semua pihak sehingga tidak ada pihak yang merasa dirugikan. Metode rehabilitasi dengan pola penanaman menggunakan bibit jenis Rhizophora dengan alasan bibit ini mudah didapatkan dan kuat menahan laju dari pasang surut air laut.

Abstract

The regulation of tanah bengkok is not done on the personal authority of kepala desa but is regulated in legitimate legislation, namely Undang-Undang no. 6 Tahun 2014 about Desa. Based on the results of research, tanah bengkok in Sojopuro village was given to Kepala Desa and desa apparatus as long as they served as desa apparatus and there was no legal effect if the village did not obey the rules of tanah bengkok. Therefore, a clear rule regarding the regulation of tanah bengkok is the asset of the village. Keywords: Tanah bengkok, Regulation, UU Desa.

Abstract

Banyak terjadi konflik terkait tanah eks kerajaan Kasultanan Kotaringin. Konflik terjadi karena tidak ada upaya dari Pemerintah Daerah untuk menyelesaikan permasalahan status hukum tanah eks kerajaan yang terjadi di  Kotawaringin Barat. Tujuan penelitian adalah untuk mengetahui realitas berlakunya kebijakan tanah eks Kasultanan Kotaringin dan mengetahui tanah eks kerajaan dapat dikategorikan sebagai tanah adat. Berdasarkan hasil penelitian Kasultanan Kotaringin merupakan masyarakat adat, karena ahli waris dan kerabat Kasultanan mempunyai kewenangan di dalam dan keluar daerah adatnya.  Kata kunci : Konflik, Tanah Eks Kerajaan, Masyarakat adat

Abstract

This research discusses the legal force of binding sale and purchase agreements under the hands made by the parties without witnesses and only waarmarking by a notary. The research method used is the analytical descriptive method, a research method that reveals problems, analyzes a problem, examines, and interprets it into conclusions and suggestions in a systematic way so that it is easy to understand. Normative Juridical approach method, namely legal research that uses secondary data sources such as principles the doctrines in the science of law. The results of the study can be concluded that the underhand Sale and Purchase Agreement (PPJB) is a form of agreement between two parties who agree to bind themselves, which is made jointly. Even though PPJB under the hand can be made freely by the parties who want to make an agreement, it may not violate the provisions of Article 1320 of the KUHPerdata. PPJB made before an authorized official and PPJB made privately have the same legal force. PPJB under the hand made by the parties without witnesses and only waarmarking by a notary, the strength of proof is only between the parties. If the parties do not deny and acknowledge the signature in the agreement, then the PPJB under the hand has perfect power as an authentic deed.
