Abstract

The topic of this study is about Romanticism of James Horner's songs that entitled If We Hold On Together, Somewhere Out There, I Want To Spend My Lifetime Loving You. The purpose of this study is to find out how James Horner expressed romanticism in his literary works. The theories used to analyze the data are expressive theory made by M.H Abrams and poetry theory from Persy Bysshe Shelly. The research design used is quantitative research. Data collection and analysis techniques by conducting intense readings and conducting content analysis. The research findings show that the romanticism in James Horner's song utilizes parallelism, hyperbole, personification, symbol, imagery, and antitheses. The romanticism expressed by James Horner in his song entitled If We Hold On Together, Somewhere Out There and I Want To Spend My Lifetime Loving You is to tell about the beauty of nature, emotions, feelings and intuitions that are poured out of the author through a message songs lyrics inspired by stories of movie imagination.

Abstract

The recovery of assets derived from crimes has become one of the urgent and critical issues at the global level in Indonesia, namely to take back assets illegally obtained by and or who are not legally responsible so that the Government and the DPR based on their authority need to ratify the draft law on asset forfeiture immediately into law. The formulation of the problem in this study is How are the dynamics of legal politics in the formation of the draft law on asset forfeiture based on Law Number 13 of 2022 concerning the Formation of Legislation. The research method used is normative juridical law or library legal research (search library), by analysing literature or secondary data relevant to the topic. This research is descriptive analytical, the data obtained and processed and analysed to provide a comprehensive picture of the legal political dynamics that occur between the Government and the DPR in terms of passing the draft law on asset forfeiture into law, with data collection methods through document studies. The results showed that the legal political dynamics that occurred between the Government and the DPR so that the Asset Forfeiture Bill was not passed due to many things, including first: The Asset Forfeiture Bill is contrary to Law Number 39 of 1999 concerning Human Rights Article 29 Paragraph (1); Second. Political interests of the Government and Parliament; Third. Coordination issues between law enforcement agencies; Fourth. The authority to adjudicate in the judicial system

Abstract

Tujuan: Penelitian ini bertujuan untuk menganalisis tanggung jawab pidana direksi dan korporasi dalam kasus tindak pidana penggelapan pajak di Indonesia. Fokus utama kajian ini adalah bagaimana peran direksi sebagai pengambil keputusan dapat dikenakan pertanggungjawaban pidana atas pelanggaran perpajakan yang dilakukan oleh korporasi, serta bagaimana penerapan doktrin vicarious liability dalam kerangka hukum pidana nasional. Metode Penelitian: Penelitian ini menggunakan pendekatan yuridis normatif dengan menelaah bahan hukum primer berupa peraturan perundang-undangan, bahan hukum sekunder berupa doktrin atau teori hukum, serta bahan hukum tersier seperti putusan pengadilan. Pendekatan ini digunakan untuk membedah struktur pertanggungjawaban pidana dalam konteks kejahatan korporasi, khususnya penggelapan pajak. Hasil dan Pembahasan: Penelitian menemukan bahwa tindakan penggelapan pajak oleh korporasi sering kali melibatkan peran aktif direksi, baik secara langsung maupun melalui kebijakan internal perusahaan. Direksi memiliki tanggung jawab hukum untuk memastikan kepatuhan pajak, dan dalam beberapa kasus, mereka justru menjadi aktor utama pelanggaran tersebut. Doktrin vicarious liability dapat dijadikan dasar untuk mengenakan pertanggungjawaban pidana terhadap korporasi atas tindakan direksinya. Implikasi: Hasil kajian ini diharapkan memberikan kontribusi teoretis dalam pengembangan hukum pidana korporasi serta menjadi referensi praktis bagi aparat penegak hukum dalam meningkatkan efektivitas penanganan kasus penggelapan pajak oleh korporasi.
