Abstract

Kekerasan Dalam rumah tangga (selanjutnya disebut KDRT) merupakan fenomena yang umum terjadi dalam kehidupan masyarakat. KDRT banyak terjadi karena berbagai faktor, apakah itu perbedaan sudut pandang, atau masalah ekonomi, dan lain sebagainya. Pada umumnya KDRT ini terjadi pada pasangan wanita. Secara konsepsi budaya, di Indonesia sendiri memiliki cara pandang budaya patriarki. Budaya yang lebih mengunggulkan nasab laki-laki dan laki-laki sebagai penentu kebijakan dalam rumah tangga. Namun demikian, dalam masalah kekerasan, Pemerintah sendiri sudah berupaya untuk mengurangi angka KDRT dengan kebijakan UU no 23 Tahun 2004 mengenai Penghapusan Kekerasan Dalam Rumah Tangga. Namun sepertinya upaya ini belum maksimal karena angka kekerasan cenderung. Latar belakang diberlakukannya UU Nomor 23 Tahun 2004 tersebut adalah sebagai bentuk antisipasi pemerintah dalam menekan angka kekerasan pada perempuan. Persoalan Rumah Tangga merupakan ranah privat, sehingga Kekerasan yang terjadi dalam rumah tangga sering tidak terekpose kepada pihak keluar, akibatnya kurang tertangani karena orang atau pihak terkait tidak mengetahui bahwa telah terjadi kekerasan. Selain karena faktor privat, ada faktor lain yang menyebabkan masalah kekerasan tersebut tidak sampai tertangani yaitu kuatnya budaya patriarki pada masyarakat Indonesia. Abstract

Environmental management in Indonesia faces significant challenges, including land conversion, pollution, and ecosystem degradation. These issues are primarily driven by human activities and a lack of integration between state policies and local wisdom. Indigenous peoples, who possess traditional knowledge and wisdom-based management systems, play a crucial role in environmental conservation. However, there are still gaps in the recognition of their rights regarding natural resource management. This research aims to analyze the role of local wisdom in environmental management within the framework of village authority and state responsibility. The methodology employed is descriptive analytical, utilizing a normative juridical approach that combines literature review and interviews with indigenous communities in Bali, Jambi, West Sumatra, and Papua. The findings indicate that while local wisdom values, such as Tri Hita Karana in Bali and arat sabulungan in Mentawai, significantly contribute to ecosystem maintenance, the integration between government policies and village authority remains limited. This research proposes strengthening the synergy between local wisdom and state policy to develop an inclusive and sustainable environmental management model. The novelty of this study lies in mapping the contributions of local wisdom within the context of village authority and highlighting the urgency for policy revisions to enhance the active role of indigenous peoples in environmental conservation.

Abstract

This study critically examines the failure of diversion programs in fulfilling the best interests of children in conflict with the law. Diversion, which aims to redirect juvenile offenders from the formal justice system toward rehabilitation, has been a key principle in juvenile justice systems. However, its failure to achieve effective outcomes—particularly in safeguarding children’s rights and welfare—remains a pressing concern. This research aims to identify the factors contributing to the failure of diversion, associating these with the broader endeavor to protect and promote the best interests of children. The study reveals several factors leading to the failure of diversion: the lack of consensus between victims and offenders or their families, the non-implementation of agreements, and differing interpretations of key legal provisions under Article 3 of Perma No. 4 of 2014 and Article 7 of the Juvenile Criminal Justice System Law (SPPA). These factors have contributed to inconsistencies in the application of diversion measures. Despite these failures, the study finds that the law still offers avenues for protecting the best interests of children, particularly when diversion is successful. Achieving effective diversion can lead to faster, simpler, and lower-case examinations, promoting rehabilitation and reintegration over punishment. The study contributes to the national and global discourse on juvenile justice by highlighting the challenges of implementing diversion programs and offering insights for reform.
