Abstract

Terhadap debitur yang wanprestasi, kreditur memiliki hak untuk menuntut kompensasi atas kerugian yang diderita. Kajian perbandingan hukum pengaturan ganti rugi akibat wanprestasi dengan civil code of the Netherlandsmerupakan hal penting mengingat pengaturan yang berlaku bagi wanprestasi dalam perjanjian di Indonesia sampai saat ini masih mendasarkan civil code Belanda yang pertama kali diberlakukan di Hindia Belanda tahun 1848 sedangkan Belanda telah memiliki civil code baru yang diundangkan pada 1 Januari 1992. Kajian dibatasi pada hak pihak yang menderita kerugian untuk menuntut kompensasi akibat wanprestasi pihak lain. Objek perbandingan hukum ini adalah lembaga hukum, hakikatnya merupakan perbandingan hukum legislasi, sifat perbandingannya horizontal, tujuannya adalah applied comparative. Bahan hukum primer dan sekunder didapatkan dengan cara studi dokumen, pengolahan data dilakukan secara kualitatif dan disimpulkan melalui metoda perbandingan hukum. Berdasarkan hasil kajian perbandingan hukum, diberikan beberapa rekomendasi bagi pembaharuan ketentuan wanprestasi, yaitu berkenaan dengan specific performance, kewajiban kreditur menyatakan kompensasi yang dikehendakinya, konversi kewajiban yang tidak dilaksanakan menjadi kewajiban mengganti sejumlah uang, hak kreditur menunda pelaksanaan prestasi, batasan hak membatalkan perjanjian, serta kewajiban debitur untuk memastikan bahwa setelah pemutusan kontrak dia mampu mengembalikan apa yang telah diterima.

Abstract

The purpose of this study is to address legal issues related to the rights of children from mixed marriages with stateless persons in Indonesia and to highlight the importance of recognizing children's rights in complex situations involving citizenship status and legal uncertainty. This study employs a normative legal research method by analyzing and examining the regulations governing the status of the Rohingya ethnic group as stateless persons in Indonesia, as well as the inheritance rights of children born to parents who are Indonesian citizens and Rohingya ethnic group members classified as stateless persons. The findings of this study indicate that children born from marriages between Indonesian citizens and stateless Rohingya retain their inheritance rights from both parents. Although such marriages may not be legally registered, they remain valid under religious law, and inheritance rights are based on blood ties, not marriage registration. These children may also inherit land from their Indonesian citizen parents under certain conditions. The contribution of this research lies in its effort to address the gap in legal studies regarding the status of children from mixed marriages with stateless individuals, an issue that has received little attention in national regulations. This study provides an argumentative and normative foundation for the protection of children's rights in transnational and stateless contexts, and encourages the development of more inclusive and equitable legal policies.

Abstract

This research was motivated by the merger of three Sharia Banks namely Bank Syariah Mandiri (BSM), Bank Negara Indonesia (BNI) Syariah, and Bank Rakyat Indonesia (BRI) Syariah into Bank Syariah Indonesia. The merger had legal consequences for the customers because the merger policy led to integrating customer personal data into one Big Data. This had become customers' concern related to the security and monitoring system. Consequently, legal protections were needed to secure this issue. This study aims to find a form of legal protection for Sharia Bank Customers after the merger of the three Sharia banks. This study implemented normative legal research with the statute approach and the conceptual approach. The results found that the legal protection for Sharia Bank Customers as intended consists of 2 (two) forms. First, External Protection: legal protection made by the authorities in the form of laws and regulations. Second, Internal protection: legal protection made by the Sharia Bank to secure the customers' personal data.
