Abstract

This study explores the implementation and significance of “living Qur'an” practices in traditional and modern dayahs in the Southwestern region of Aceh, aiming to identify these practices, understand their implementation, and investigate the reasons behind their persistence. The research employs a qualitative approach, utilizing case studies and ethnographic observations. The study showed that “living Qur'an” practices, such as Ratib al-Haddad, Ratib al-Attas, Ratib Syahir, and Ratib Lathif in traditional dayahs, and Al-Ma’surat in modern dayahs, are deeply embedded in the dayah culture. These practices are systematically managed and carried out according to set schedules, with reasons including seeking Allah's pleasure, gaining rewards, and preserving scholarly traditions. Both traditional and modern dayahs in the southwestern region of Aceh effectively integrate “living Qur'an” practices into their daily routines, contributing to the spiritual and moral development of their students. These practices, while varied, reflect a commitment to maintaining a strong Islamic identity and adapting to contemporary educational needs.

Abstract

Yamin or Oath is swearing a speech to convince others of his words by mentioning the name of Allah swt. There are so many among the Islamic community that they take the oath easily, but they do not care about the effect on the oath they have taken. So that some of them break the oath a lot without knowing what kifarat to do when they break the oath. The author intends to examine the interpretation of the kifarat oath and the procedures for carrying out the kifarat oath in surah al-maidah verse 89 which is mentioned in the book Al-jami 'Fi Ahkam Al-Qur'an by Imam Al Qurtubi. This study uses a descriptive methodology of analysis of the results of the literature review. The results of this study found that Imam Al-Qurtubi in his interpretation mentioned an oath that caused a kifarat and an oath that did not cause a kifarat. There are at least four types of oath models with various models of procedures for carrying out the oath.

Abstract

The development of digital technology has given rise to the practice of sexting and digital pornography which presents moral challenges as well as legal problems in the Muslim society. This phenomenon has to do not only with private ethics, but also has an impact on the broader social order. This study aims to examine the concept, classification, and legal implications of sexting and digital pornography as jarimah in the perspective of Jinyah Fiqh. This research is a normative legal research with a qualitative approach. Data was obtained through literature studies of primary sources of Islamic law, classical and contemporary fiqh literature, and relevant scientific journals. The analysis is carried out with a conceptual approach and maqāṣid al-syarī’ah to assess the substance of the act and its impact on the public good. The results of the study showed that sexting and digital pornography did not meet the elements of hudud jarimah because they did not always involve physical intercourse as in adultery with strict evidentiary standards. However, both can be categorized as jarimah ta’zir because they contain elements of moral violations, the opening of the aurat, and the potential destruction of individual honor and public morals. Viewed from the perspective of maqāṣid al-shari’ah, the practice is contrary to the purpose of protecting honor (ḥifẓ al-’irdh), heredity (ḥifẓ al-nasl), and reason (ḥifẓ al-’aql). This research confirms that Fiqh Jinayah has normative flexibility to respond to the phenomenon of digital sexuality through the mechanism of ijtihad and the application of ta’zir, so that it remains relevant in maintaining the benefit and dignity of human beings in the digital era.
