Abstract

Secara yuridis permasalahan penagihan tunggakan utang dapat dilakukan melalui upaya hukum yang berada dalam kewenangan lembaga peradilan. lembaga peradilan yang menangani perkara sebagaimana tersebut di atas dapat memberikan teguran kepada masyarakat yang tidak melunasi utangnya melalui cara dan mekanisme sesuai peraturan perundang-undangan bahkan juga melakukan penyitaan barang jaminan berupa benda bergerak (conservatoir beslag) dan benda tidak bergerak. (revindicatoir beslag). Hal ini dianggap sebagai bentuk kerja pengadilan sebagai Debt Collector sebagai penopang kekuasaan negara yang ada dibaliknya. Namun seiring berjalannya waktu, ketidakefektifan dan efisiensi lembaga peradilan dalam upaya hukum terkait dengan proses wanprestasi atau perbuatan melawan hukum yang dilakukan debitur dirasa tidak seimbang dengan kepastian hukum. orang-orang tertentu yang lebih dikenal oleh masyarakat disebut Debt Collector. Dalam kasus Standard Charter Bank yang menyebabkan nasabah kartu kredit merasa diteror oleh debt collector dan akhirnya menggugatnya ke pengadilan. Dengan adanya Putusan Mahkamah Agung Nomor 3192 K/Pdt/2012 tanggal 3 Oktober 2013, akhirnya menjatuhkan sanksi kepada Standard Chartered Bank. Salah satu alasan Mahkamah adalah Pasal 17 B Peraturan Bank Indonesia Nomor 14/2/PBI/2012 tentang Perubahan Atas Peraturan Bank Indonesia Nomor 11/11/PBI/2009 tentang Penyelenggaraan Kegiatan Alat Pembayaran Dengan Menggunakan Kartu, yang mana Tergugat telah melanggar. Abstract

Kepedulian Lembaga Perguruan Tinggi kepada masyarakat dalam rangka meningkatkan kualitas pendidikan merupakan Tri Dharma Perguruan Tinggi. Untuk merealisasikan program tersebut diperlukan suatu rencana.Program pengabdian pada masyarakat yang bermanfaat bagi masyarakat. Tujuan umum dari kegiatan pengabdian kepada masyarakat pada kali ini adalah memberikan pemahaman dan kesadaran akan pentingnya Aspek Legal dalam menjalankan usaha bagi UMKM terutama yang berada di Kelurahan Pondok Cabe Udik, Pamulang, Tangerang Selatan. Oleh kaena itu tema yang diangkat adalah Urgensi Aspek Legal dan Mutu Produk Bagi UMKM di Kelurahan Pondok Cabe Udik, Tangerang Selatan. Adapun bentuk kegiatan dalam pelaksanaan pengabdian kepada masyarakat berupa penyuluhan dan bimbingan kepada masyarakat terutama para pelaku usaha UMKM. Para penyuluh dan narasumber yang dilibatkan adalah para Dosen Program Studi Ilmu Hukum, Fakultas Hukum dari Universitas Pamulang. Target dari Pelaksanaan PKM yang dilakukan tanggal 2 s.d 4 Maret 2023 adalah melengkapi aspek legal serta meningkatkan mutu produknya agar mampu bersaing dan mampu meningkatkan performa usahanya. Karena dalam penyuluhan disampaikan beberapa hal diantaranya mengenai beberapa bentuk badan hukum dan badan usaha, prosedur pendaftaran, resiko hukum jika tidak legal dan perlunya peningkatan mutu produk. Kegiatan Pengabdian Kepada Masyarakat yang dilakukan disampaikan secara langsung kepada warga yang hadir di Aula Kelurahan Pondok Cabe Udik, Jl. Pala Raya No.2, Pondok Cabe Udik, Tangerang Selatan, Banten. Warga selain mendapat pemahaman tentang pentingnya aspek legal dan mutu produk dalam menjalankan usahanya, mereka juga dapat bertanya dan berdiskusi dengan para narasumber . Diharapkan kegiatan PKM ini dapat berjalan secara simultan dalam mendampingi UMKM yang berada di Kelurahan Pondok Cabe Udik.Kata Kunci : Aspek Legal, Mutu Produk, Pelaku UMKM

Abstract

This writing aims to understand law enforcement by the existing criminal justice system and to understand the existing legal system models in the world and Indonesia along with their characteristics. The method used in this writing is normative legal research through literature study with data collection methods in the form of secondary data. The results of the research show that law enforcement has not been implemented optimally, so it is very important that the existing criminal justice system can work well to create and realize a sense of justice in society. In this world, there are two models of the rule of law concept that have been developed, namely the Continental European model called rechstaat and the Anglo Saxon model called the rule of law. The concept of rechtsstaat was born from a struggle against absolutism so that it is revolutionary in nature. The concept of rechtsstaat relies on the Continental Law system called civil law. Meanwhile, the concept of the rule of law develops evolutionarily, which is based on a legal system called common law.

Abstract

The General Election held on February 14, 2024 has elected the President and Vice President, Members of the DPR, Members of the DPRD and Members of the DPD. In 2024, Regional Head Elections were also held simultaneously throughout Indonesia, in which there were 271 regional governments filled by Acting Regional Heads both in Provinces, Regencies or Cities. The Acting Regional Heads who were appointed directly by the Central Government through the Ministry of Home Affairs are under the responsibility of the President. Many people doubt the independence of the Acting Regional Heads appointed by the Ministry of Home Affairs, especially when associated with the political interests of the current rulers, although legally it is considered not to violate existing laws and regulations. However, in terms of democracy, it is considered to harm the spirit of democracy which prioritizes people's sovereignty through the results of regional head elections rather than the results of appointments from the central government. The problems raised are: 1) How are the arrangements for the appointment of Acting Regional Heads based on a legal perspective?; 2) How is the appointment of 271 Acting Regional Heads ahead of the 2024 Simultaneous Elections based on a democratic perspective? This research is a normative legal research using a statute approach, a conceptual approach and a case approach. Normative legal research relies on secondary data derived from primary legal materials, secondary legal materials, and tertiary legal materials, so the data collection technique is to use documentary studies, namely studies that examine various documents, both those related to laws and regulations and existing documents. The research data is analyzed through qualitative legal analysis and the results are presented in a descriptive analytical manner

Abstract

This research aims to understand how legal protection is for consumers in e-commerce transactions if a dispute occurs, whether consumer protection regulations accommodate problems that occur in the era of society 5.0 and how the effectiveness of existing dispute resolution can resolve these problems and fulfill a sense of justice. Technological developments are changing the order of human values and life, one of which is the development of the economy in the digital era. The need for laws that can guarantee the rights of parties in business in the current digital era, especially consumer protection, is increasing rapidly as problems become increasingly complex. However, the regulations governing consumer protection were regulations that were born long before digitalization. The research method used is empirical juridical with analytical descriptive research specifications. Data collection was carried out through field studies with observations and interviews with related agencies BPKN, BPSK, LPK-RI, consumers and business actors, and literature studies, data analysis was carried out qualitatively through deductive logical thinking. The Consumer Protection Law, as a regulation that specifically regulates consumer protection, was published in 1999 before digitalization, so it does not regulate consumer problems in digital transactions. Although consumers can use the Information and Electronic Transactions Law as a legal basis, the ITE Law does not yet provide technical regulations regarding consumer protection. Despite regulatory limitations, there are new innovations related to dispute resolution models, namely ODR (Online Dispute Resolution) which is a synergy between ADR (Alternative Dispute Resolution) and ICT (Information and Computer Technology) which is able to simplify the dispute resolution process so that it is not obstructed by space and time by cheap and fast. The author hopes that this paper will achieve results by publishing it in the accredited journal Andalas Nagari Law Review University and can put it in the form of a book with an ISBN.
