Abstract

Penelitian ini bertujuan untuk mendeskripsikan ketentuan implementasi Prinsip Subrogasi di dalam Perjanjian Asuransi Kendaraan Bermotor; hal-hal yang menjadi hambatan pihak tertanggung dalam pengajuan klaim; serta tanggungjawab PT Pan Pacific Insurance mengenai prinsip subrogasi atas kerugian yang disebabkan oleh keterlibatan pihak ketiga. Untuk mencapai tujuan tersebut, penelitian ini menggunakan pendekatan yuridis-normatif yang dilaksanakan dengan berdasar pada tinjauan bahan pustaka atau data sekunder. Selain itu, penelitian ini juga dipertajam dengan metode penelitian studi empiris yang biasa pula disebut dengan penelitian hukum sosiologis. Adapun jenis penelitian ini adalah deskriptif analisis, dengan jenis data yang terdiri dari 2 (dua), yakni data primer dan data sekunder. Sedangkan teknik analisis data yang digunakan dalam penelitian ini adalah teknik analisis data kualitatif. Hasil penelitian menunjukan bahwa PT Pan Pacific Insurance sama halnya dengan perusahaan asuransi pada umumnya dalam pengaplikasian asuransi, dimana menawarkan prinsip subrogasi sebagai salah satu dasar dalam pengaplikasian asuransi. Dalam pelaksanaannya, terdapat berbagai hambatan yang berasal dari perusahaan asuransi sendiri maupun pihak tertanggung. Tanggung jawab perusahaan asuransi atas klaim ganti rugi, sesuai dengan nilai limit nominal pertanggung. Dengan demikian, maka sisa kekurangan dari biaya perbaikan terhadap objek asuransi ditanggung oleh pihak ketiga sesuai dengan kesepakatannya bersama pihak tertanggung.

Abstract

Fire Insurance protects against the danger of property loss or damage. Parties with an interest in the insured object accept the risk of loss. Indemnity (or the principle of loss) plays a role in ensuring equitable compensation. Subrogation will apply against the insured to ensure that the insurance policy runs properly and without loss between the insurer and the insured. The goal of this study is to discuss and explain the Indemnity Principles and Insurable Interest in relation with Fire Insurance. The descriptive qualitative method was employed in the research. Primary and secondary sources of data were gathered. Data analysis techniques included data collection, data reduction, data presentation, and data verification. The study's findings show that PT. Tokio Marine merely recovers the insured's financial condition to its pre-incident state. PT. Tokio Marine will not face risk adjustments as a result of an occurrence because the company only accepts risks that are uncertain and occur suddenly. Subrogation does not occur when the insurer pays the insured a balanced loss (indemnity principle). However, if the insurance covers only a portion of the loss, the subrogation principle applies.

Abstract

Ideally, legal protection for children born out of wedlock should ensure that they receive civil rights equivalent to those of legitimate children without discrimination. In reality, there are still differences in treatment between positive law in Indonesia, especially after the Constitutional Court Decision No. 46/PUU-VIII/2010, and Islamic law, which holds differing views on the status of children born out of wedlock. The challenge lies in how to harmonize legal protection for these children amidst the differing perspectives between positive law and Islamic law, ensuring that their civil rights are upheld while also minimizing negative social impacts, such as fornication. The purpose of this study is to analyze and compare legal protection for children born out of wedlock according to the Constitutional Court Decision and Islamic law and to seek solutions that can integrate both perspectives to create fair and dignified legal protection. The methodology used in this study is a normative juridical approach, examining various laws, court decisions, and related Islamic legal literature. The results of the research indicate that although there are differences in views between the Constitutional Court's decision and Islamic law, the integration of both approaches can provide more comprehensive legal protection for children born out of wedlock. By balancing both perspectives, it is hoped that it will guarantee the civil rights of these children while also preserving societal morality by minimizing the practice of fornication.

Abstract

Purpose: of the study is to provide knowledge and comparative analysis of witness rules in the burgerlijk wetboek/civil procedural law in Indonesia and Islamic civil procedural law as well as to provide a comparison of witness arrangements in the burgerlijk wetboek/civil procedural law in Indonesia and the burgerlijk wetboek/Islamic civil procedure law. Result: Civil procedural law makes witnesses not perfect evidence. However, for the religious court in the case of divorce, the witness seems to have the same power as a letter, even thought in principle it is different. Contribution: This condition seems to make civil procedural law in the Islamic religious court the same as the law stipulated in the Quran&Hadith. Where as civil procedural law in Indonesia is the same between state and religious courts.

Abstract

Salah satu dari jenis aktivitas usaha yang dilakukan oleh perusahaan pembiayaan selaras dengan Perpres No.9 Tahun 2009 perihal lembaga pembiayaan serta permenkeu No 84/PMK.012/2006 Perihal Perusahaan Pembiayaan adalah Pembiayaan Dalam Bentuk leasing atau Sewa Guna Usaha Pada prinsipnya leasing hadir ditengah-tengah pelaku usaha atau masyarakat adalah sebagai satu diantara alternatif yang memberikan kemudahan kepada masyarakat pelaku usaha untuk menjalankan usahanya dalam pengadaaan barang-barang atau modal usahanya. Praktek pelaksanaan perjanjian sewa guna usaha dilaksanakan belum sepenuhnya mengacu kepada asas-asas hukum perjanjian dan prinsip leasing. Permasalahan yang akan diteliti adalah bagaimana pengaturan perjanjian leasing dan bagaimana konstruksi ideal perjanjian leasing yang berkeadilan . Hasil dari penelitian ini adalah bahwa pengaturan perjanjian leasing seharusnya mengacu kepada asas-asas perjanjian pada hukum perjanjian beserta beberapa pasal tertentu dari Buku III KUHPerdata. Konstruksi ideal pembiayaan sewa guna usaha (leasing) yang berkeadilan harus didasarkan kepada asas-asas hukum perjanjian dan prinsi-prinsip leasing.

Abstract

This article aims to analyze the legal regulations concerning defamation within the Indonesian legal system and to evaluate the judicial considerations in Decision Number 613/Pid.B/2020/PN Stb. The focus is on how positive law responds to defamation cases embedded in local social and cultural values. This study applies theories from classical and progressive criminal law. Data were collected through document analysis and library research, and examined using a normative juridical approach. The study concludes that defamation is comprehensively regulated under the Indonesian Penal Code (KUHP), the Electronic Information and Transactions Law (ITE Law), and the 1945 Constitution, though its application should account for societal context. The court’s decision reflects sensitivity to the local social structure and emphasizes the need for a balance between protecting individual reputation and ensuring freedom of expression. The article recommends a more restorative legal approach to support social reconciliation alongside the imposition of criminal sanctions.

Abstract

Investment plays an important role in the economic sector, especially in developing countries such as Indonesia which is very strategic. Without sufficient investment, it is difficult to expect high economic growth that results in economic welfare for developing countries. This study also uses a normative legal approach, namely conducting field research on events that give rise to the principle of subrogation and the implementation of the principle of subrogation in online investment agreements which examines legal protection for fraudulent investment investors. The results of the study show that in practice Sunton Capital does not meet the provisions of the Commodity Futures Trading Law because it does not have certification from Bappebti, which indicates that its investment activities are illegal. Sunton Capital also offers high returns that are not proven, so it has the potential to be a form of fraud against investors. To prevent the increasing prevalence of illegal investment, preventive and repressive legal protection efforts are needed. Preventive efforts are carried out through education and socialization by Bappebti and OJK to increase public awareness of legal and safe investments. Meanwhile, repressive efforts involve law enforcement against perpetrators of illegal investments, including investigation, prosecution, and imposition of sanctions in accordance with Article 378 of the Criminal Code concerning criminal acts of fraud. In addition, victims of illegal investments have the right to obtain restitution in the form of compensation for lost assets, medical costs, and counseling services as regulated in the Witness and Victim Protection Law. However, because illegal investments such as Sunton Capital do not have a clear legal basis, direct compensation from the broker is often difficult to obtain

Abstract

Franchise agreements have become a prevalent business model in Indonesia, facilitating entrepreneurial opportunities and driving economic growth. However, the inherent power imbalance between franchisors and franchisees often leads to conflicts that challenge the principles of justice and fairness. This research aims to explore the harmonization of Islamic law (Sharia) and positive law principles in regulating franchise agreements in Indonesia. By adopting a qualitative approach, the research examines the convergence and divergence between these two legal frameworks, with a focus on upholding the ethical tenets of Islamic business practices, such as justice, honesty, and trust. The findings highlight the importance of developing a comprehensive legal framework that balances the interests of both franchisors and franchisees, ensures transparent dispute resolution mechanisms, and promotes the equitable distribution of rights and obligations. This study contributes to the ongoing discourse on the integration of religious and secular legal principles in the context of franchise relationships, providing practical insights for policymakers, legal practitioners, and industry stakeholders to foster a more harmonious and sustainable franchise ecosystem in Indonesia.

Abstract

This study aims to examine the form, characteristics, and regulatory challenges of digital technology-based insurance services (Insur Tech) in Indonesia, as well as to evaluate the form of legal protection available to policyholders in the context of the digital economy. The method used is a normative legal approach with an analysis of regulations such as POJK No. 36/2024 and POJK No. 8/2024, as well as literature and secondary sources from scientific articles and credible references. The research findings indicate that the development of InsurTech has not been matched by an adequate regulatory system, leading to potential legal uncertainty and weak consumer protection. The gap between technological innovation and regulatory response is evident in the lack of legal clarity regarding data security, service transparency, and dispute resolution mechanisms. The conclusions of this study emphasize the importance of regulatory updates that can ensure a balance between digital innovation and legal protection, through a collaborative approach between regulators, industry players, and the public. This research contributes to the development of digital law in the financial sector, particularly in shaping a legal framework that is more responsive to digital transformation in the insurance industry.

Abstract

This research uses the normative juridical method by examining the laws and regulations in the field of insurance as well as the policy provisions of PT Prudential Life Assurance Indonesia. The results of the study show that PT Prudential applies two health insurance claim settlement mechanisms, namely individual claims and collective claims, each of which is subject to the terms and procedures set out in the policy. Normatively, the company is obliged to provide health protection to insurance participants, but the effectiveness of this protection is highly dependent on the fulfillment of the rights and obligations of participants in accordance with applicable regulations. In practice, there are often obstacles in the form of claim rejection due to document completeness, late reporting, or participant ignorance of the contents of the policy. This research highlights the importance of legal protection for the insured so as not to be harmed by unilateral provisions in the policy. The novelty of this research lies in the normative analysis of the imbalance of legal positions between insurance companies and participants in the claims process, which can lead to legal uncertainty. Therefore, it is necessary to strengthen regulations that guarantee justice and legal certainty for insurance participants in filing health claims.
