Abstract

Fakultas Hukum, Universitas Brawijaya dindadelfina07@gmail.com ABSTRAK Penelitian ini bertujuan untuk mengetahui kedudukan anak kandung penderita sindrom Klinefelter menurut Hukum Waris Islam.  Terdapat kasus yang terjadi pada seorang anak mengalami sindrom Klinefelter yang terjadi pada seorang anak laki-laki yang berusia 13 tahun yang mendatangi RSCM dengan keluhan seperti gejala-gejala bagi penderita sindrom Klinefelter yakni pria dengan kelebihan kromosom X pada tubuhnya, serta terdapat pula kasus yang sama pada seorang anak laki-laki berusia 22 tahun hanya saja pada kasus yang satu ini penderita sindrom tersebut memiliki gangguan mental serta adanya hipogonadisme atau dapat dikenal dengan kekurangan hormon testosteron pada laki-laki. Diantara kedua kasus tersebut belum ada yang mempermasalahkan mengenai kedudukan mereka menurut Hukum Waris Islam. Bagaimana kedudukan anak kandung penderita sindrom Klinefelter menurut Hukum Waris Islam. Maka peneliti memperoleh hasil bahwa anak kandung penderita sindrom Klinefelter memiliki kedudukan sebagai laki-laki dikarenakan karena secara genetik ia miliki kromosom Y yang terdapat pada laki-laki normal, serta memiliki organ reproduksi laki-laki dan tidak adanya organ reproduksi perempuanya. Kata Kunci : Kedudukan, Sindrom Klinefelter, Hukum Waris Islam (HWI)   ABSTRACT This research is aimed to find out the position of a biological son developing Klinefelter syndrome according to Islamic inheritance law, conducted based on normative juridical method and conceptual approach. The data was obtained from literature review, followed by an analysis of legal materials based on argumentation of analogical argumentation of law. This observation began with a boy aged 13 years old visiting RSCM with symptoms matching Klinefelter syndrome with extra copy of X chromosome in his body. Similarly, another 22-year-old boy described similar syndrome but accompanied with mental disorder and the presence of hypogonadism or the condition when a person has not enough testosterone. Based on this situation, boys with the above conditions are still considered as male since they genetically have Y chromosome as normal males have, and they have their male reproduction organ. Abstract

The increasing complexity of business disputes that arise and the need for fast and effective resolution encourage further exploration of the role of mediation in the context of the digital era. Analysis of business disputes in the digital era is very important considering the rapid development of technology and its impact on the business world. The research method used is normative descriptive qualitative. Mediation has a significant role in resolving business disputes in the digital era. The advantages of mediation in terms of time and cost efficiency are a very valuable added value for the parties involved in business disputes. Clearer regulations are needed to accommodate technological developments and regulate competition in the digital era. Dispute resolution also needs to be supported by adequate legal infrastructure. Collaboration between government and business actors is key in dealing with business disputes in the digital era.

Abstract

Penelitian ini dilatarbelakangi oleh urgensi untuk memahami dan menerapkan hukum persaingan usaha yang sehat di tengah tantangan dan perubahan dalam lingkungan bisnis. Kasus-kasus pelanggaran persaingan usaha, seperti kartel dan monopoli, menunjukkan bahwa tanpa adanya pemahaman yang benar dan mekanisme pengawasan yang efektif, persaingan dapat menjadi tidak adil dan merugikan pihak-pihak tertentu, terutama konsumen. Metode pelatihan merupakan kerangka penting yang digunakan untuk memastikan bahwa peserta dapat menyerap dan memahami materi secara efektif. Dalam konteks pelatihan tentang hukum persaingan usaha yang sehat, pemilihan metode yang tepat dapat memperkaya pengalaman belajar dan memfasilitasi pemahaman yang lebih mendalam mengenai isu-isu kompleks dalam hukum persaingan. pelatihan hukum persaingan usaha yang sehat memainkan peran krusial dalam meningkatkan pemahaman para pelaku usaha mengenai prinsip-prinsip persaingan sehat. Penegakan hukum persaingan usaha merupakan langkah penting dalam memastikan terciptanya lingkungan bisnis yang adil dan sehat. Di Indonesia, penegakan hukum ini diatur berdasarkan Undang-Undang No. 5 Tahun 1999 tentang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat. Tujuan dari penegakan hukum ini adalah untuk melindungi konsumen dan mendorong efisiensi ekonomi dengan memastikan bahwa pelaku usaha bersaing secara jujur dan tidak melakukan praktek yang merugikan.

Abstract

This study analyzes relevant legislation, court decisions, and literature, complemented by a case study of Ridwan Kamil to illustrate practical implementation challenges and social implications. Using a normative legal approach, this study highlights barriers such as social stigma, family rejection, and regulatory gaps, while emphasizing the need to harmonize religious norms with state law. with a focus on the limitations set by Article 43 paragraph (1) of Law Number 1 of 1974 concerning Marriage Constitutional Court Decision Number 46/PUU-VIII/2010. The findings offer a comprehensive legal analysis and policy recommendations aimed at promoting inclusive family law reform that upholds constitutional principles of justice and non-discrimination. This study contributes to the development of fairer legal protection for children born out of wedlock in Indonesia, by promoting their rights to maintenance and inheritance regardless of marital registration status.

Abstract

This study aims to: (1) examine the legal aspects of smart contracts in the Indonesian legal system and propose adaptations to existing laws and regulations to suit the characteristics of smart contract technology; (2) identify normative and implementative challenges in the legal adaptation process, such as normative gaps and the lack of a standard framework; and (3) formulate the direction of legal reform needed to form responsive and contextual smart contract regulations. Unlike previous studies which are generally descriptive and technological in nature, this study provides a legal contribution by mapping gaps in national contract law and presenting a comparative analysis as a basis for formulating a smart contract regulation model in Indonesia. This research uses a juridical-normative and empirical-qualitative approach, with a doctrinal legal analysis of the legislation, legal literature study, and in-depth interviews with legal practitioners and technology actors. The main findings of this research indicate that there is no legal framework that explicitly regulates the validity and execution of smart contracts, which creates legal uncertainty. Therefore, it is recommended that the principle of freedom of contract in the Civil Code be expanded to include digital contracts that are executed automatically. In addition, special regulations are needed in the form of derivative regulations or technical guidelines that bridge blockchain technology with national civil law principles. The practical contribution of this research is to provide a starting point for policymakers and academics in designing smart contract regulations in Indonesia that are comprehensive and responsive to technological developments, so that they can provide legal certainty while supporting digital innovation.

Abstract

Red onion (Allium ascalonicum L.) is a spice plant whose needs as a kitchen spice continue to increase. Some of the obstacles faced in meeting community needs include the availability of inorganic fertilizer needs and seed preparation before planting. From this fact, it is necessary to cultivate through the use of organic fertilizers by cutting bulbs on shallot seeds before planting, so that it is expected to obtain the expected results. The study was conducted from May to July 2021. Field experiments were carried out using the split plot design method, as the main plot. Cutting tubers (P): P0 tubers that were not cut, P1 cutting in parts, P2 cutting in parts and subplots, namely the dose of organic chicken manure (D) D0 control, D1 15 tons/ha, D2 20 tons/ha. Plant variables include plant length (cm), number of leaves (strands). number of tubers per clump (tubers), number of tubers per plot (tubers), fresh weight of tubers per clump (g), fresh weight of tubers per plot (kg). The results showed that by giving a dose of chicken manure 20 tons/ha by cutting onion bulbs, the highest yield was 1.64 kg/plot or equivalent to 4.47 tons/ha
