Abstract

AbstractAs a constitutional state as stated in Article 1 paragraph (1) of the 1945 Constitution of the Republic of Indonesia (1945 Constitution), everything must refer to the law. But is the nature of the reference likely to lead the country to act behind the law? With the perspective of a modern legal state, where a private is separated from the state. The private sector cannot be claimed as part of the state because of its limited nature. Abstract

The research with the title "Government Administration, especially the Legal Section at the Regional Secretariat of Madiun Regency", is motivated by the administration of the Madiun district government, especially the legal department. Based on this, the authors drew two problem formulations in this study, including: (1). What is the function of the Legal Section of the Madiun Regency Regional Secretariat in administering government within the Madiun Regency Government? (2). What are the factors that hinder the Legal Section of the Madiun Regency Regional Secretariat in carrying out its duties and functions in the administration of regional government within the Madiun district government? The legal theories used in this study include the theory of decentralization and the theory of establishing good laws and regulations. The research method uses normative juridical research, namely research used to examine legal principles and principles. The research was conducted at the Regional Secretariat of the Madiun Regency Legal Department of the Madiun Regency Regional Secretariat (SETDA), regarding the role of the legal department in administering government. The results of the research that the authors obtained included: (1) the function of the legal section of the regional secretariat of Madiun Regency through the administration of regional government with an average performance of very well (2). Factors that hinder the legal division of the Madiun Regency Secretariat in administering government include: (a). the lack of human resources in the legal section of the madiun regional secretariat has resulted in a high workload which is feared to have an impact on future performance decline. (b). there isno structured, continuous and massive training for statutory subdivision staff. (c). the lack of interest in the functional position of the drafter of legislation due to the difficulty in obtaining credit point numbers for promotion.

Abstract

The study of constitutional law does not only study positive law, but also includes national and state ethics. Indonesia actually has TAP MPR No. 4 on the Ethics of National Life. Although in its application the ethics of nation and state are still not effective in practice in society. This study aims to examine TAP MPR No. VI concerning the Ethics of National Life and its implementation in various aspects and future arrangements. This research is a normative legal research. Legal materials in this study include primary, secondary, and non-legal materials. The approach in this study uses a conceptual approach and a statutory approach. The results of the study confirmed that the implications of TAP MPR No. VI concerning the Ethics of National Life in constitutional law in Indonesia actually requires special arrangements in the Act so that it becomes the Law on the Ethics of National and State Life. The future implementation and regulation of the TAP MPR on National and State Ethics in Indonesian constitutional law can be carried out by establishing a Law on National and State Ethics which contains basic principles and is instrumentally and specifically determined by each agency, profession or group in society, combining the socialization of the four pillars of the MPR with the socialization of awareness of national and state ethics, and making awareness of national and state ethics as part of the national education system.

Abstract

Tourism is the activity of temporary travel of one or more people to a location other than their place of residence. In Batu Bengkung, residents depend on tourism for their livelihood. This study discusses legal protection for tourists by focusing on two aspects. First, Law no. 10 of 2009 concerning Tourism regulates legal protection for tourists and tourism industry players in the event of loss from both parties. Second, the manager's obligation to guarantee the security and safety of Batu Bengkung beach visitors if an incident occurs. The research method used is an empirical research technique with a sociological legal perspective. The results of the study show that Law Number 10 of 2009 concerning Tourism provides fair protection for travelers and tourism industry players. This protection covers the full rights and obligations of both parties. The responsibility of the manager for the safety and security of Batu Bengkung Beach tourists is to provide insurance claims and hospital medical expenses for victims.
