Abstract

This study examines the dynamics of religiously-based marriages and divorces across several nations, including Indonesia, Tunisia, Turkey, the United States, and the United Kingdom. The study is driven by the varied methodologies about marriage and divorce, influenced by a confluence of statutory regulations, cultural customs, and religious tenets. The primary concern is how these nations manage the multiplicity of religious traditions while upholding justice and safeguarding individual rights. The study seeks to analyze the regulation of religious marriages and divorces by legal systems in various countries and to pinpoint best practices that could inform the reform of marriage laws in Indonesia. The research utilizes a literature review methodology to assess secondary data from books, research reports, and legal laws in the chosen nations. We employ a descriptive normative methodology to deliver an extensive investigation of the interaction of law, culture, and religion concerning marriage and divorce. The findings indicate that certain countries have effectively delineated the functions of religion and the state in the governance of marriage and divorce while preserving religious values. These regulations emphasize justice, encompassing the safeguarding of individual rights in divorce procedures, the fair allocation of assets, and the welfare of children. This study emphasizes the necessity of enacting legislation that honors cultural and religious diversity while guaranteeing equal protection for all individuals. This research provides valuable insights for establishing an inclusive and equitable marriage law system in Indonesia.

Abstract

The Sepasaran tradition, held five days after a wedding, is an important custom in the community of Kembangkuning Village, Cepogo Subdistrict, Boyolali District. This tradition carries deep cultural and religious significance, fostering social bonds in the midst of changing times. As part of the tradition, a thanksgiving event (kendurenan) is organized, followed by the symbolic acknowledgment of those who helped with the wedding preparations. This study explores how the Sepasaran tradition is practiced in Kembangkuning Village and analyzes it through the lens of 'Urf in Islamic thought. The research adopts a qualitative approach, utilizing interviews and documentation to gather data. The findings reveal that the Sepasaran tradition serves as an expression of gratitude and a prayer for blessings following the wedding ceremony. From the perspective of 'Urf, this tradition is classified as 'Urf Amali because it is practiced consistently and widely accepted by the local community. It is also categorized as 'Urf Shahih because it aligns with Islamic principles and as 'Urf Khas due to its specific regional context. This study demonstrates that the Sepasaran tradition remains a meaningful and relevant practice in the community, reflecting local wisdom and a harmonious relationship between culture and religion. It highlights how the tradition continues to strengthen social ties while staying in harmony with Islamic values

Abstract

Perkawinan poligami bukanlah hal yang asing bagi masyarakat muslim di Indonesia, namun bagi masyarakat di Barat poligami jarang sekali diminati dan bahkan dianggap berseberangan dengan budaya mereka. Poligami adalah praktik perkawinan di mana salah satu pihak memiliki beberapa pasangan secara bersamaan. Artikel ini akan membandingkan keabsahan hukum perkawinan poligami berdasarkan sistem hukum Inggris dan Indonesia. Perbandingan ini akan dilihat berdasarkan landasan yuridis serta syarat dan ketentuan yang mengikutinya. Jenis penelitian yang digunakan adalah penelitian kepustakaan dengan pengambilan data melalui dokumentasi, serta menggunakan teknik analisis deskriptif dan studi komparatif. Hasil penelitian menunjukkan bahwa Indonesia mengakui dan mengizinkan praktik perkawinan poligami asalkan sesuai dengan syarat dan ketentuan peraturan perundang-undangan yang berlaku saat ini. Sedangkan Inggris hanya mengakui dan mengizinkan sistem perkawinan monogami, sehingga poligami dilarang dan bahkan tidak diakui. Hal ini terkecualikan bagi seseorang yang melakukan poligami di luar Inggris dan tidak berdomisili di Inggris, maka perkawinannya akan diakui sebagaimana prinsip dalam hukum perdata Internasional.   Polygamous marriages are not uncommon for Muslims in Indonesia, but for people in the West, polygamy is rarely desirable and even considered contrary to their culture. Polygamy is a marriage system in which one party has multiple partners simultaneously. This article will compare the legal validity of polygamous marriages under the English and Indonesian legal systems. This comparison will be seen based on the juridical basis as well as the terms and conditions that follow. The type of research used is library research with data collection through documentation, and using descriptive analysis techniques and comparative studies. The results show that Indonesia recognizes and allows the practice of polygamous marriage as long as it meets the terms and conditions according to the applicable laws and regulations. Meanwhile, the UK only recognizes and allows the monogamy marriage system, so polygamy is prohibited and not even recognized. With the exception of a person who commits polygamy outside the UK and is not domiciled in the UK, his or her marriage will be recognized in accordance with the principles of international civil law.

Abstract

The dualism of authority in supervising Sharia Microfinance Institutions (LKMS) in Indonesia creates legal uncertainty and weak oversight. Kemenkop UKM and OJK have different perceptions regarding the regulation of LKMS, leading to overlapping authority. This situation has the potential to hinder the development of LKMS and reduce public trust in the Sharia financial system. LKMS, such as Baitul Maal wat Tamwil (BMT), play a strategic role in empowering the community’s economy and promoting Sharia financial inclusion. However, the regulation and supervision of these institutions often overlap due to differing perceptions of authority. Kemenkop UKM considers BMT to be part of a cooperative under its supervision, while OJK views BMT as a financial entity requiring more technical oversight related to financial services. This study employs a legal-normative method with a descriptive analysis approach, examining documents such as books, legislation, and other relevant materials. The findings indicate that this overlap in authority results in legal uncertainty, weak supervision, and potential risks for customers. The impacts include unclear legal protection for consumers, risks of authority misuse, and low compliance with Sharia financial regulations. Furthermore, this condition may hinder the growth of LKMS, reduce public confidence, and slow down efforts to enhance Sharia financial inclusion. Harmonizing regulations and establishing coordination mechanisms between Kemenkop UKM and OJK are essential to strengthening supervision and ensuring the sustainability of LKMS. Regulatory harmonization is crucial in promoting better governance and increasing public trust in Indonesia’s Sharia microfinance system.
