Abstract

Artikel ini menganalisis kebijakan hilirisasi nikel Indonesia periode 2017-2022, terutama larangan ekspor bijih nikel, dalam konteks sengketa dagang di Organisasi Perdagangan Dunia (WTO) dengan Uni Eropa. Kebijakan ini merupakan strategi Indonesia untuk meningkatkan nilai tambah komoditas mineral dan mengoptimalkan keuntungan ekonomi domestik. Melalui pendekatan kualitatif dengan analisis kebijakan, penelitian ini menemukan bahwa meskipun keputusan panel WTO menyatakan kebijakan Indonesia melanggar aturan perdagangan internasional, Indonesia tetap mempertahankan kebijakan hilirisasinya dengan alasan kedaulatan ekonomi dan kepentingan nasional. Data menunjukkan peningkatan signifikan pada nilai ekspor produk nikel olahan dan investasi di sektor hilir, terutama dari Tiongkok, serta diversifikasi produk turunan nikel seperti nickel matte dan nickel oxide. Meskipun demikian, kebijakan ini menimbulkan implikasi diplomatik dan hukum internasional yang kompleks. Artikel ini menyimpulkan pentingnya keseimbangan antara ambisi pembangunan ekonomi domestik dan komitmen terhadap regulasi perdagangan global, serta perlunya strategi adaptif dalam menghadapi tantangan perdagangan internasional

Abstract

The distrust of the legal system in Indonesia, which is becoming more and more concerning, is a trend that occurs not only in judicial institutions but also in all social strata. The influence of the product of legislation by a political institution which is strongly influenced by the great political forces in political institutions. Actors of legal politics are tools of government in a broad sense, namely tools of government in the legislative field, and tools of government in the judiciary.

Abstract

The death penalty is a sanction imposed by taking the life of a person who has violated the law. In Indonesia, there is a debate regarding the death penalty when viewed from a Human Rights perspective. Opinions supporting the death penalty argue that such action does not violate Human Rights because the perpetrator has harmed the Human Rights of the victim and society. On the other hand, there are also views that reject the death penalty on the grounds that taking someone's right to life, which should be highly respected, should not be carried out by anyone. Therefore, there is pressure for the death penalty to be abolished in the applicable regulations. The questions to be discussed in this study include How is the Implementation of the Death Penalty in Indonesia and What is the Human Rights perspective on the implementation of the death penalty in Indonesia? This paper attempts to provide insight into the death penalty from a Human Rights perspective in Indonesia, both from the perspective of applicable legal theory and from current practice. This research is a normativelegal research conducted through a literature review by analyzing various primary, secondary, and tertiary legal sources. In addition, researchers also conducted observations on the practice of the death penalty, public responses regarding the implementation of the law, and conducted interviews if necessary with practitioners or experts in the fields of law, sociology, and politics.
