Abstract

A Driving Permit is a type of an individual license (Persoonlijke Vergunning), therefore a Driver's License for issuance requires certain conditions that are related to the conditions of a Driving License. In the Regulation of the Head of the Indonesian National Police No. 9 of 2012 Article 52 Paragraph 2 Regarding Driving License. Mention that the person authorized to issue a SIM (Driving License) to the public is the Chief of Police in each area and delegated to the Head of the Traffic Unit. The existence of the Klungkung Regional Police Headquarters is very much needed to provide legal awareness to the public on the importance of a SIM which is Persoonlij Vergunning based on the provisions of the Republic of Indonesia National Police Chief Regulation No. 9 of 2012 concerning Driving License. The first problem formulation is how is the principle of Persoonlijke Vergunning in the implementation of Perkap Polri No. 9 of 2012 concerning Driving License and the second Is the factor inhibiting the implementation of the Police Headquarters No. 9 of 2012 concerning Driving License.This research includes empirical legal research. Data Sources consist of Primary Data Sources, Secondary Data, Data collection techniques used in this study are interviews, data analysis used in this study is qualitative analysis. As for the discussion discussed namely the understanding of a driving license, the definition of service, the term police / police, the Persoonlijke Vergunning Principle from the perspective of a driving permit, the Relationship of a Driving License with the Authorized Authority to Manage Highway Traffic, Implementation of the Police Headquarters No. 9 of 2012 concerning Driving Permits at the Klungkung Police Station Traffic Sat, the effectiveness of the driving permit service (SIM) at the Klungkung Police Traffic Management Unit based on the Police Headquarters No. 9 of 2012 concerning Driving License, Factors inhibiting the implementation of the Police Headquarters No. 9 of 2012 concerning Driving License.Based on the results of research that have been reviewed and described, the conclusions that can be conveyed are as follows: The effectiveness of the driver's license service (SIM) at the Klungkung Regional Police Station is related to the Effectiveness of the Republic of Indonesia's National Police Chief Regulation Number 9 of 2012 Regarding Driving License, can run effectively in the service of a driver's license (SIM), if it can fulfill the effective element of the legal method of the Regulation of the Head of the Indonesian National Police Number 9 of 2012 concerning Driving License. Abstract

ABSTRACTLand leases have become commonplace in society and are implemented through written agreements with the aim of providing legal certainty, but disputes in land leases occasionally take place as civil disputes over land may result from the transfer of land rights, for example by sale and purchase agreements, leases, inheritance and so on. Disputes that occur in land lease agreements can occur various factors due to the parties in the agreement that did default. The formulation of the issues raised in this study is how fairness for tenants due to wanprestasi done by landowners and how the efforts can be made by the tenant due to the existence of default by landowners. This type of research is empirical legal research moving from the dispute that occurred in land lease agreements can occur various factors due to the parties in the agreement that did wanprestasi. This study examines the problem being reviewed from legal perspective by conducting research which emphasize on empirical nature that is direct field study that is at Bali International Medical Center Kuta Hospital. The conclusion of this research is the legal protection for the tenants because the wanprestasi done by the land owner is between the landowner and the tenant of the land made in the agreement and proclaims that they have entered into an agreement and asked the Notary to make a deed, then this deed is a deed made in the presence of a Notary (Notarial Deed), the Contracting Party having legal certainty and, therefore, a dispute in the execution of the treaty, the judge with his / her decision may apply so that the infringing party shall file the right and suit according to the agreement. Legal efforts that can be made by the lessee due to a default by landowners who feel aggrieved due to a default can apply for the fulfillment of the agreement, cancellation of the agreement or to seek redress for the defauding party. Determination of wanprestasi is built on a letter from the debtor to the creditor who is usually in the form of a warning (reprimand) The minimum duration has been made three times by the tenant of the land. If the notation is ignored, the land tenant is entitled to take the matter to court. And it is the courts who will decide whether or not the separation of defaults. Abstract

ABSTRACT The beauty and hospitality of Bali with its various cultural and social uniqueness has been too often discussed. The island of Bali, which is called the Thousand Temple Island, has been famous throughout the world since before. Bali has become a symbol of tourism from Indonesia with various problems that may be faced. Community security and order building is the authority of the police. The social construction of Balinese people in maintaining public order and security still exists and is maintained from the past until now. Judging from the outline, there are threats that can disrupt the security situation in Bali are as follows: (a) Threats of narcotics crimes, (b) Threats of terrorism crimes (c) Threats of corruption habits, (d) Uncontrolled threat of population migration to Bali. In addition to these threats, Bali still has conventional threats that are always difficult to solve until now. What is meant is uncontrolled population growth. The arrival of immigrants from all over Indonesia from outside Bali is not wrong, but the problem is the density of the Balinese population who cannot be controlled and exceed the tolerance limit. The result is clearly felt today, the percentage of crime has increased sharply, snatching, muggings, pratima theft, rape and murder have become commonplace news in Bali.This thesis is a normative legal research by applying a historical approach, conceptual approach and legislation approach in analyzing the problems mentioned above. In addition, the sources of primary, secondary and tertiary legal materials collected by library techniques and document studies were processed and analyzed using qualitative descriptive methods. Abstract

Abstrak Jumlah Narapidana di Lembaga Pemasyarakatan Kelas IIB Karangasem yang mendapatkan pembebasan bersyarat selama dalam kurun waktu 3 (tiga) tahun terhitung sejak tahun 2017 sampai dengan tahun 2019 berjumlah 149 orang, jumlah yang mendapatkan pembebasan bersyarat lebih sedikit belum ada setengahnya dibandingkan dengan jumlah rata-rata narapidana per tahunnya yaitu 200 narapidana di Lembaga Pemasyarakatan Kelas IIB Karangasem. Rumusan masalah penelitian ini adalah untuk bagaimana mekanisme pelaksanaan pembebasan bersyarat bagi narapidana di Lembaga Pemasyarakatan Kelas IIB Karangasem dan bagaimana efektivitas pelaksanaan pembebasan bersyarat bagi narapidana di Lembaga Pemasyarakatan Kelas IIB Karangasem. Penelitian ini menggunakan pendekatan kualitatif. Teknik pengumpulan data yang digunakan dalam penelitian ini adalah berupa teknik studi dokumen, wawancara dan observasi, dimana yang dipilih sebagai responden 149 orang. Teknik analisis data yang digunakan dalam penelitian ini adalah dengan menggunakan analisa kualitatif. Dilakukan pengolahan terlebih dahulu terhadap data yang telah diperoleh baik primer maupun data sekunder kemudian data tersebut dianalisis secara kualitatif dan tersaji dalam bentuk deskripsi. Mekanisme pelaksanaan pembebasan bersyarat bagi narapidana di Lembaga Pemasyarakatan Kelas IIB Karangasem pada prinsipnya seorang narapidana lembaga permasyarakatan perlu untuk mengikuti program pembinaan lapas bersangkutan. Untuk itu juga dipersyaratkan terpidana telah menjalani 2/3 masa tahanan dan minimum telah menjalani 9 bulan. Efektivitas pelaksanaan pembebasan bersyarat bagi narapidana di Lembaga Pemasyarakatan Kelas IIB Karangasem diketahui bahwa sangat efektif. Karena jumlah narapidana keseluruhan yang menjalani pembebasan bersyarat mulai dari tahun 2017 sampai tahun 2019 sebanyak 149 orang. Dari 149 (seratus empat puluh sembilan ) orang narapidana yang mendapatkan pembebasan bersyarat hanya 4 (Empat) orang yang gagal (melakukan pelanggaran hukum lagi) selama dalam masa percobaan. This research problem formulation is for how the mechanism of the implementation of parole for prisoners in Karangasem Class IIB Penitentiary and how effective the implementation of parole for prisoners in Class IIB Penitentiary Karangasem. This research uses a qualitative approach. Data collection techniques used in this study were in the form of document study techniques, interviews and observations, of which 149 respondents were selected as respondents. The data analysis technique used in this study is to use qualitative analysis. First, the primary and secondary data are processed first, then the data are analyzed qualitatively and presented in the form of a description. The mechanism for implementing parole for prisoners in Karangasem Class IIB Penitentiary Principals in principle a prison institution prisoner needs to participate in the prison counseling program. For this reason, the convicted person must have served 2/3 of the detention period and a minimum of 9 months. The effectiveness of the implementation of parole for prisoners in Karangasem Class IIB Penitentiary is known to be very effective. Because the total number of prisoners undergoing parole from 2017 to 2019 is 149 people. Abstract

Perlindungan anak sebagaimana diatur dalam Pasal 1 angka 1 UU Perlindungan Anak mendefinisikan anak ialah seseorang yang belum genap berusia 18 tahun termasuk pada anak yang masih berada didalam kandungan ibunya. Perlindungan hukum terhadap anak yang diberikan oleh Negara merupakan wujud dari terjaminnya hak-hak setiap anak demi kelangsungan hidup, dan tumbuh kembang anak tersebut. Dalam era globalisasi saat ini, banyak anak melakukan tindakan melawan hukum yang salah satunya adalah tindak pidana peredaran narkotika. Apabila terbukti seorang anak sebagai pelaku pengedaran atau penyalahgunaan narkotika, maka anak tersebut akan menjalani peradilan khusus untuk memperoleh sanksi pidana dengan mengacu pada Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak. Dalam beberapa kasus penyalahgunaan narkotika oleh anak yang pernah ditangani oleh Polres Klungkung, sanksi yang diberikan pada anak yaitu dengan metode diversi (penyelesaian perkara pidana diluar peradilan) sebagai bentuk pertanggungjawaban pidana oleh anak. Berdasarkan hal tersebut, dapat dirumuskan rumusan masalah sebagai berikut: 1. Bagaimana pertanggungjawaban pidana peredaran narkotika terhadap anak dibawah umur di wilayah hukum Polres Klungkung, dan 2. Apa upaya Polres Klungkung dalam menangani peredaran narkotika yang dilakukan oleh anak dibawah umur. Jenis penelitian yang digunakan adalah menggunakan jenis penelitian hukum empiris, dengan menggunakan asas legalitas, asas kepastian hukum, asas tindak pidana anak dan asas pertanggungjawaban pidana, dan dalam perumusan analisisnya. Dalam penulisan karya ilmiah ini menggunakan dua jenis data yakni data primer dan data sekunder, dua teknik pengumpulan data yakni, teknik wawancara dan Teknik studi dokumen, selanjutnya data ini akan di analisis meggunakan analisis kualitatif yang dikombinasikan dengan logika hukum deduktif yang mana data tersebut akan disajikan secara deskritif kualitatif dan sistematis. Hasil penelitian ini menyimpulkan bahwa pertanggungjawabann pidana yang dapat ditempuh oleh anak pelaku tindak pidana peredaran narkotika salah satunya ialah dengan dilakukannya metode diversi diversi (penyelesaian perkara pidana diluar peradilan), tindakan perawatan (treatment), perbaikan/rehabilitasi (rehabilitation) serta pemidanaan. Sedangkan upaya penanggulangan oleh Kepolisian terhadap tindak pidana penyalahgunaan narkotika dilakukan dengan upaya preventif dan upaya represif. Child protection as stipulated in Article 1 number 1 of the Child Protection Act defines a child as someone who is not 18 years old yet, including children who are still in their mother's womb. Legal protection of children provided by the State is a form of guaranteeing the rights of every child for the sake of survival, and the growth and development of the child. In the current era of globalization, many children commit acts against the law, one of which is the crime of narcotics trafficking. If it is proven that a child is a perpetrator of narcotics distribution or abuse, then the child will undergo a special trial to obtain criminal sanctions with reference to Law Number 11/2012 concerning the Child Criminal Justice System. In several cases of narcotics abuse by children that have been handled by Klungkung Police, the sanctions given to children are the diversion method (settlement of criminal cases outside the judiciary) as a form of criminal responsibility by children. Based on this, the following problem formulation can be formulated: 1. How is the criminal liability for narcotics trafficking of minors in the Klungkung Police jurisdiction, and 2. What are the efforts of Klungkung Police in handling narcotics trafficking committed by minors. The type of research used was empirical legal research, using the principle of legality, the principle of legal certainty, the principle of juvenile crime and the principle of criminal responsibility, and in the formulation of its analysis. In writing this scientific work using two types of data namely primary data and secondary data, two data collection techniques namely, interview techniques and document study techniques, then this data will be analyzed using qualitative analysis combined with deductive legal logic where the data will be presented in a qualitative and systematic description. The results of this research concluded that one of the criminal responsibility that can be taken by children who commit criminal acts of narcotics trafficking is the diversion method (settlement of criminal cases outside the judiciary), treatment, repair / rehabilitation and punishment. Meanwhile, countermeasures by the Police against criminal acts of narcotics abuse are carried out with preventive efforts and repressive efforts.
