Abstract

In the current context, the fiqh concepts of ulama nusantara(Nusantara Moslem Scholars) are important to be discussed as it has local wisdoms, progressivity, and adaptability in giving solutions to the society’s problems. This paper will discuss the fiqh concepts ofSyeikhArsyad al-Banjari in his book entitled SabilalMuhtadin that discusses fiqh(Islamic jurisprudence) in the perspective of Nusantara’s society, especially Banjarese society. This paper uses normative-sociological approach in analyzing the fiqh concepts of SyeikhArsyad al-Banjari, such as, zakat receivers, floating lavatory, corpse burial in coffin (tabala), and providing food for mourners. The results of the study indicate that al-Banjariwas mainly relied on “custom is law” (al-adatumuhakkamah) and “generating benefits or mashlahah and declining damage” (jalb al-mashalihwadar’ al-mafasid) in his ijtihad (independent reasoning). He also believed that law evolved according to the society’s situation and condition (taghayyur al-ahkamyata’allaqu bi taghayyur al-azminahwa al-amkinah). All of al-Banjari’s concepts are in-line with Syafi’iyyah school. Keywords: Ijtihad, Fiqh, Nusantara, and Sabilal Muhtadin

Abstract

In the realm of methodology of Islamic jurisprudence (ushul al-fiqh), qiyas, a method of deriving Islamic law, holds a prominent position. It entails analogizing a legal ruling from a situation devoid of explicit textual guidance (nash) to a situation with established textual guidance, based on the shared underlying cause (illat). This is a descriptive research with a philosophical approach. The type of research used is library research with primary data referring to the original source, namely the book of logic by Aristotle. While secondary data is taken from works containing Aristotelian logic. This study found that Imam al-Shâfi’i stands as the pioneer in formulating qiyas as a method of ijtihad (legal reasoning). His rigorous formulation of qiyas drew theoretical underpinnings from Aristotelian logic. The incorporation of Aristotelian logic into qiyas imbued the method with a strict and contrapositive nature, adhering to the principles of syllogistic logic. In syllogistic reasoning, the conclusion invariably follows from the major premise, which in qiyas is derived from the sacred text (the Quran). To overcome this intellectual stagnation, a burhani methodology, as championed by Ibn Rushd, Ibn Khaldun, Ibn Hazm, and al-Shâtibi, emerged. This methodology successfully established a liberal rational epistemology grounded in the spirit of burhani logic and contextualized Quranic interpretation.

Abstract

Online gambling has created new forms of rifts in the family structure that occur silently but have a wide impact, especially on children. The fragmentation of relationships in digital households disrupts parenting functions and creates vulnerable psychosocial conditions for children in the domestic environment. Unfortunately, the child protection system in Indonesia lacks a mechanism to respond to indirect threats arising from the dynamics of cyberspace within the family. This study aims to critically examine the limitations of the legal and social systems in protecting children from family disintegration due to online gambling. The study employed a qualitative approach, drawing on library research and the analysis of relevant literature and secondary data. Data were analyzed using a thematic approach to uncover regulatory and social gaps that have not been able to anticipate structural damage in digital families. The results of the study show that existing regulations are still partial, and sectoral, and fail to touch on the complexity of families exposed to destructive digital practices. Child protection has not integrated new risk indicators that arise from uncontrolled online environments. A redesign of the child protection system is needed to be more inclusive, multisectoral, and adaptive to the challenges of digital families so that the best interests of children can be guaranteed comprehensively.

Abstract

Polygamy is a term that contains various meanings, often exciting men's imaginations as an ideal while triggering deep emotions in women. Many women, naturally jealous and reluctant to share their husband's love, oppose polygamy. Despite this, some extraordinary women accept it patiently. On one side, critics link polygamy to gender inequality and discrimination against women, while supporters believe it can reduce infidelity and prostitution. Misconceptions about polygamy, often fueled by anti-Islamic sentiment, have influenced Muslim society, leading some to view it negatively and others to defend it as a part of Islamic perfection. This research then aims to find out how orientalists criticize polygamy law and refute orientalist understanding of polygamy law. This research method will be carried out using a qualitative approach. The data used in this research comes from the results of a literature study of previous literature and research that is still relevant. The results of this research then found that the polygamy law in Islam has a strong historical basis, aiming to protect and regulate the practice of polygamy with the principles of justice and responsibility. Islam sets strict limits and conditions to ensure that polygamy is not abused and that women's rights are protected. Misinterpretations by Orientalists often ignore this context and spread biased views regarding polygamy law. Despite challenges and criticism of the practice of polygamy, education and fair enforcement of the law can provide significant social and individual benefits.
