Abstract

ABSTRAKTradisi Merarik di Desa Merembu, Lombok Barat, menjadi sorotan menarik dalam kajian antropologi hukum. Praktik perkawinan di bawah umur yang marak dalam tradisi ini menghadirkan tantangan dalam konteks hukum positif Indonesia. Penelitian ini secara mendalam mengurai mekanisme penyelesaian perkawinan Merarik, dengan fokus pada implikasi hukum yang timbul. Metode penelitian menggunakan metode hukum empiris dan pendekatan kualitatif dengan data primer dari lokasi penelitian dan data sekunder dari sumber terpercaya. Teknik pengumpulan data meliputi observasi, wawancara, dan studi dokumen. Hasil Penelitian ini mengungkapkan bahwa Tradisi Merarik di Desa Merembu, Lombok Barat, meski sarat dengan nilai budaya, namun berpotensi menimbulkan permasalahan hukum akibat ketidaksesuaiannya dengan ketentuan perkawinan dalam hukum positif Indonesia. Penelitian ini menyoroti pentingnya mencari titik temu antara hukum dan budaya untuk melindungi hak-hak individu dan memastikan kepastian hukum dalam konteks perkawinan adat. Temuan ini mengindikasikan adanya pertentangan antara nilai-nilai budaya lokal dengan ketentuan hukum nasional. Oleh karena itu, diperlukan upaya untuk mencari solusi yang dapat mengakomodasi kedua aspek tersebut, sehingga perlindungan hukum bagi individu, khususnya perempuan dan anak, dapat terjamin tanpa mengabaikan nilai-nilai kearifan lokal. The Merarik tradition in Merembu Village, West Lombok, is an interesting highlight in the study of legal anthropology. The rampant practice of underage marriage in this tradition presents challenges in the context of Indonesian positive law. This research deeply analyzes the mechanism for resolving Merarik marriages, with a focus on the legal implications that arise. The research method uses empirical legal methods and a qualitative approach with primary data from the research location and secondary data from trusted sources. Data collection techniques include observation, interviews, and document studies. The results of this study reveal that the Merarik Tradition in Merembu Village, West Lombok, although full of cultural values, has the potential to cause legal problems due to its incompatibility with the provisions of marriage in Indonesian positive law. The research highlights the importance of finding common ground between law and culture to protect individual rights and ensure legal certainty in the context of customary marriage. The findings indicate a conflict between local cultural values and national legal provisions. Therefore, efforts are needed to find solutions that can accommodate both aspects, so that legal protection for individuals, especially women and children, can be guaranteed without ignoring local wisdom values.

Abstract

This study aims to examine the phenomenon of voter abstention, known as voter abstention (Golongan Putih or Golput), from the perspectives of Islamic law and Indonesian electoral legislation. The research utilizes a qualitative approach, relying on literature reviews and primary governmental documents to analyze how these two legal frameworks address and regulate voter abstention. The study explores the intersection of Islamic jurisprudence, particularly the 2009 fatwa by the Indonesian Ulama Council (Majelis Ulama Indonesia or MUI) that declared Golput haram (forbidden), and Indonesia’s electoral law, specifically Law No. 7 of 2017, which encourages voter participation without penalizing abstention. The findings reveal that while Golput is not prohibited by electoral law, it is framed as a violation of religious duty within Islamic legal thought. Additionally, the study highlights Golput as a form of civil resistance and political expression in Indonesia's democratic system. The analysis of these dual legal systems provides insights into the complexities of voter behavior and presents recommendations for strengthening democratic engagement. The implications of this research suggest that integrating religious principles with legal norms could enhance voter turnout and foster more inclusive electoral participation in Indonesia.

Abstract

This article aims to understand the challenges of children's legal status after divorce. The method used in this research is qualitative descriptive, which examines the review from the perspective of maqashid sharia and national law. Humans cannot live by themselves. Humans require assistance from others to fulfill their needs in life. As explained in Surah Ar-Rum verse 21, 'Allah has created humans with their pairs so that they may live in tranquility.'

Abstract

This article examines the syncretism between Islamic law and local customary norms in the dowry tradition of Sekati Mesa Tedong in Kalukku District, West Sulawesi. This dowry practice serves not only as a symbol of responsibility and respect toward the bride but also as a reflection of the community’s cultural identity, with its form and value shaped by inherited customary norms. The study aims to analyze the forms of Sekati Mesa Tedong, explore the perspectives of the community and religious leaders on the integration of customary values and Islamic legal principles within the tradition, and evaluate its conformity with Islamic law. The research employs a qualitative approach using a juridical-empirical method through observation, interviews, and documentation.The findings indicate that Sekati Mesa Tedong is practiced in two forms: the original form, consisting of a roll of kaci cloth and a buffalo, and an adapted form involving money, land, or other valuable items agreed upon by both parties. Community members and religious leaders view this tradition as a harmonious blend of adat and Islamic teachings, as long as it is based on sincerity and does not impose an excessive burden on the groom. From the perspective of Islamic law, the Sekati Mesa Tedong tradition does not conflict with the Sharia, as it upholds the principles of mutual consent (taradhi), fairness, and deliberation, thereby illustrating a form of legal syncretism that reflects the integration of religious values and local cultural norms.

Abstract

The death of the Prophet Muhammad (peace be upon him) essentially marked the end of revelation and the finalization of divine guidance for Muslims, as accumulated in the Qur'an and the Hadith. However, the complexity of social dynamics and contemporary developments demonstrate the need for adaptation and relevance of Islamic law to the contemporary context. In this context, the role of Qawā‘id al-Aḥkām (legal principles) is a fundamental element in efforts to understand and interpret Islamic law comprehensively. The focus of this study is to elaborate on Islamic legal principles and their implementation in order to provide innovative, sharia-guided solutions to new challenges, as well as to strengthen the philosophical foundation of contemporary ijtihad. The research method used is library research in normative legal studies with data sources from various books and research articles
