Abstract

Abstract - The current buying and selling practice in Indonesia is very high, by using a mobile phone, one click the goods will be sent home easily. The famous online buying and selling application or online advertising, one of which is the online shop buying and selling application. Various kinds of products provided by consumers can choose what items to buy. However, sometimes the order that we buy doesn't match what we ordered. This results in losses for consumers. Lack of consumer protection in online buying and selling in Indonesia due to a lack of regulations that protect consumers, business actors, online application parties, carriers, and related parties. Abstract

The objective of this study is to ascertain Bharada Eliezer's stance on Decision Variety: 798/Pid.B/2022/PN.Jkt.Sel, which pertains to the position of Justice Collaborator police officers, as well as the Police Code of Ethics Decision concerning Bharada Eliezer's police status. This study employs a normative juridical research methodology, together with conceptual and statutory techniques. Essentially, when an individual unlawfully ends another person's life, it constitutes a violation of human rights and a denial of the right to life, particularly when the perpetrator is a law enforcement officer who continues to serve in the police force. However, in this particular case, the judge and the responsible official overseeing the KKEP hearing must take into account the defendant's status as a justice collaborator, who is feared by irresponsible parties and at risk of abuse. Ensure that all personnel of the National Police receive guidance to prevent them from engaging in actions that contravene laws, regulations, and the ethical standards of the police profession, which could damage the reputation of the police organization or agency. It is necessary to revise the requirements and guidelines for justice collaborators due to certain criminal offenses that pose a threat to the state and involve exceptional crimes. Justice collaborators play a crucial role in clarifying initially ambiguous criminal offenses.

Abstract

This study analyzes the evolution of Beneficial Ownership regulations in Indonesia, focusing on their crucial role in corporate governance and the prevention of financial crimes, particularly Money Laundering and Terrorism Offenses. This study traces the legal framework from its basic instrument, namely Presidential Regulation No. 13 of 2018, to the significant strengthening marked by the issuance of Regulation of the Minister of Law and Human Rights No. 2 of 2025. The problems raised in this paper are (1) What is the role of beneficial ownership for corporations in Indonesian business? and (2) How can money laundering and terrorism financing be prevented in beneficial ownership for corporations? The type of research used is legal-normative, which focuses on the study of legislation and legal literature related to beneficial ownership in Indonesia. The analysis was conducted using a legislative and conceptual approach by understanding the legal framework, effectiveness, and challenges of implementing regulations in corporate practice. The results of the study show that (1) Beneficial Ownership plays a central role in increasing corporate transparency and accountability; (2) Prevention can be done with clear regulations and the implementation of beneficial ownership transparency, even though regulations have made significant progress, compliance and supervision challenges remain major obstacles. Therefore, increasing corporate awareness and capacity is essential so that the principle of beneficial ownership can effectively support the prevention of corporate crime and the creation of a transparent and accountable business environment in Indonesia. Abstract

The presence of Artificial Intelligence in Indonesia currently has no statutory regulation that regulates it, but in several sectors in the field of Information Technology, Artificial Intelligence has been developed in Indonesia. Some developed countries already use Artificial in the field of law, such as advocacy, making laws and regulations, learning law, and so on. Objective: Applying Artificial Intelligence in Indonesia in the field of law to facilitate work in the legal field Methods: This research uses a normative juridical research method, a conceptual approach and a statutory approach. Findings: Artificial Intelligence can be used in Indonesia, not only in the legal field but also in all areas of ease of work and shortening of work. Function: the usefulness of this research is to assist in the legal field, facilitate the work of legal experts such as making laws and regulations which first take a long time to make, legal consultations for the public now do not need to come to lawyers or legal consultants can use Artificial Intelligence to provide consultations. consultation on legal matters. There have been many law offices abroad that have implemented Artificial Intelligence in their offices, if they are unable to attend to provide consultations to their clients, using Artificial Intelligence applications can already help provide solutions. Legal learning can also use Artificial Intelligence, already in Indonesia, pioneering legal learning for law students and the public who want to study law. Novelty: this research is related to Artificial Intelligence, it is still rare for people to know about its use in the legal field, therefore we made research related to Artificial Intelligence to provide information related to this.

Abstract

Abstract The urgency of this research is to overcome and detect homograph attacks that are currently rampant in Indonesia. The purpose of this research is to know and detect the pattern of homographed attack criminal offense. To determine the criminal liability for the perpetrators of homographed attack criminal offense. The research method used is normative juridical research, which uses a statutory approach and conceptual approach. So that this research looks for patterns of detection of homographed attack perpetrators to trick victims by using writing similar to the original web to trick victims with fake or phishing webs to enter information or personal data, for victims who are not careful about web names and official web url links that are spoofed by the perpetrators of homographed attack crimes, the perpetrators of homographed attack crimes will carry out their actions by breaking into the victim's personal data to enter banking access and accesses that can be broken into by the perpetrators of homographed attack crimes. Criminal sanctions for perpetrators of homograph crimes are temporarily regulated in Article 35 of the ITE Law and get a maximum sanction of 12 years with a fine of 12 billion rupiah contained in Article 51 of the ITE Law and Article 378 of the old Criminal Code and Article 492 of the new Criminal Code with the crime of fraud. The creation of a website by requesting the same form of writing as the original website so that the perpetrator of this homograph crime can make the website look like the original website.

Abstract

Tujuan dari penelitian ini agar mengetahui bentuk atau tindakan penyalahgunaan aplikasi Deepfake bagi pelaku tindak pidana dan ketentuan hukum pidana yang diterapkan pada pelaku penyalahgunaan aplikasi Deepfake bagi pelaku tindak pidana. Deepfake sendiri adalah teknologi rekayasa atau sintetis citra manusia menggunakan teknologi kecerdasan buatan AI. Banyak kejahatan yang timbul dari Deepfake yaitu kejahatan pornografi yang merubah wajah seseorang yang berada dalam video tanpa izinya untuk mengambil keuntungan dengan tanpa izin orang yang memiliki wajah tersebut. Meminjam uang di aplikasi pinjol dengan meminjam wajah orang lain, merubah suara seperti Presiden Joko Widodo yang berbahasa mandarin dan lain sebagainya. Pemerintah masih belum membuat aturan yang kongkrit terkait kajahatan menggunakan AI ini, sementara hanya menggunakan UU ITE, UU Pornografi, UU Perlindungan Anak, UU PDP, untuk pencegahannya saja. Metode penelitian yang digunakan adalah penelitian yuridis normative, dengan menggunakan pendekatan Perundang-undangan, dan Pendekatan Konseptual. Semakin banyak korban dan pelaku kejahatan Deepfake ini, namun masih kabur dalam penerapan hukumnya. Hal ini menyebabkan korban tidak mendapatkan kepastian hukum dan bagi pelaku tidak akan memberikan efek jera.  Kata Kunci: Artificial Intellegence, DeepFake, Teknologi Informasi. Abstract The purpose of this research is to find out the forms or actions of misuse of the Deepfake application for criminal offenders and the criminal law provisions applied to the perpetrators of misuse of the Deepfake application for criminal offenders. Deepfake is a technology of engineering or synthetic human images using AI artificial intelligence technology. Many crimes arise from Deepfake, namely pornography crimes that change the face of a person in a video without his permission to take advantage without the permission of the person who owns the face. Borrowing money in the pinjol application by borrowing someone else's face, changing the voice like President Joko Widodo who speaks Mandarin. The government still has not made concrete rules related to crimes using AI, while only using the ITE Law, Pornography Law, Child Protection Law, and PDP Law, for prevention. The research method used is normative juridical research, using a legislative approach, and a conceptual approach. There are more and more victims and perpetrators of this Deepfake crime, but it is still blurred in the application of the law. Abstract

Dalam penelitian ini mengkaji mengenai Undang-Undang Cipta Kerja Klaster Ketenagakerjaan dimana tujuan pemerintah adalah untuk meningkatkan perlindungan dan kesejahteraan pekerja dengan menciptakan lapangan kerja yang dilakukan melalui perubahan Undang-Undang sektor yang belum mendukung terwujudnya sinkronisasi dalam menjamin percepatan cipta kerja. Tujuan dari penelitian ini adalah untuk menganalisis urgensi pengesahan Undang-Undang Cipta Kerja dan menganalisis alasan Undang-Undang Cipta Kerja yang mempunyai tujuan memberikan perlindungan dan kesejahteraan pekerja justru mendapat penolakan dari para pekerja dan serikat pekerja. Metode penelitian yang penulis gunakan adalah penelitian hukum normatif. Tujuan disahkannya UU Cipta Kerja yaitu untuk memicu pertumbuhan investasi perlu dan perbaikan kualitas angkatan kerja, termasuk menginklusi para pekerja informal yang selama ini belum terakomodasi dalam UU No 13/2003. Karena itu, aspek ketenagakerjaan yang semestinya diatur di dalam UUCK adalah aspek pengembangan kualitas angkatan kerja, bukan menyangkut hak-hak pekerja, dengan tujuan menjadikan kualitas tenaga kerja sebagai daya tarik investasi.  Kata kunci : Cipta Kerja; Perlindungan; Kesejahteraan; Pekerja  Abstract This study examines the Employment Cluster Job Creation Law where the government's goal is to increase the protection and welfare of workers by creating jobs through changes in sector laws that have not supported the realisation of synchronisation in ensuring the acceleration of job creation. The purpose of this study is to analyse the urgency of passing the Job Creation Law and to analyse the reasons why the Job Creation Law, which aims to provide protection and welfare for workers, has been rejected by workers and trade unions. The research method that the author uses is normative legal research. The purpose of the Job Creation Law is to trigger necessary investment growth and improve the quality of the labour force, including including informal workers who have not been accommodated in Law No. 13/2003.
