Abstract

The importance of protecting children’s right is a legal obligation for Indonesia. One of The national goal of Indonesia that contained in prambule of constitution is to educate the life of the nation, either way through protecting the right to education for fostered children. The urgency of this research is to see the implementation of the children who must be protected in Indonesia. The formulation of the problems in this research are : 1) How is the implementation of the right to education of children at LPKA Regional Office II Jakarta? 2) what are the obstacles to the implementation of the right to education of children at LPKA Regional Office II Jakarta?. This research is empirical legal research using primary and secondary data. The approach in this research are statutory research and conseptual approach. The results of the research showed that the implementation has been done even thougt it was not fully in accordance with the regulation (The decision of Minister of Law and Human Rights about Guidelines for the treatment of children in Bapas, LPAS, dan LPKA 2014). The obstancles to the implementation of the right to education of children at LPKA Regional Office II Jakarta are infrastructures consisting of inadequate classrooms, sufficient stationery, and teachers who not apply pedagogical competencies.

Abstract

Trademark disputes often arise despite existing laws, due to similarities that lead to bad faith registration. This act exploits a trademark's fame, affecting its economic value and potentially deceiving consumers. The first-to-register principle determines the winner of trademark disputes, with legal consequences including rejection, transfer, or cancellation of the disputed trademark. A court case illustrates this, where the plaintiff was initially found guilty, but upon appeal, it was discovered that their trademark was registered earlier with valid documents, including an Apostille certificate. The Supreme Court annulled the previous decision, upholding the plaintiff's trademark rights and canceling the defendant's trademark. This study used a juridical normative research method, analyzing primary legal materials and laws. The results showed that the defendant acted in bad faith by creating a similar trademark identity. An information gap regarding well-known trademarks and Apostille certification contributed to the bad faith utilization. This study aims to inform policy development in trademark legislation, highlighting the need for clearer regulations to prevent similar disputes. By understanding the causes of trademark disputes, policymakers can create more effective laws to protect trademark rights and promote fair competition. Ultimately, this study contributes to the ongoing effort to refine trademark laws and regulations.

Abstract

Prinsip actori incumbit probatio menegaskan bahwa pihak yang mendalilkan harus membuktikan dalilnya melalui alat bukti yang sah, sebagaimana diatur dalam hukum acara perdata Indonesia. Salah satu alat bukti yang umum diajukan adalah keterangan saksi. Namun, sistem hukum acara perdata di Indonesia tidak mengakui kekuatan pembuktian dari satu orang saksi saja (unus testis nullus testis) apabila tidak didukung alat bukti lain. Penelitian ini bertujuan untuk mengkaji sejauh mana keyakinan hakim dapat dibangun berdasarkan alat bukti satu saksi dalam perkara perdata. Metode yang digunakan adalah pendekatan normatif dan studi kasus terhadap tiga perkara perdata di Pengadilan Negeri Bekasi: Permohonan Akta Kematian No. 21/Pdt.P/2025/PN Bks, Gugatan Wanprestasi No. 457/Pdt.G/2024/PN Bks, dan No. 520/Pdt.G/2024/PN Bks. Hasil kajian menunjukkan bahwa keterangan satu saksi tidak dapat berdiri sendiri sebagai alat bukti yang sah, namun dapat digunakan apabila diperkuat dengan alat bukti lain seperti bukti surat. Oleh karena itu, keyakinan hakim dalam perkara perdata tetap dapat dibangun secara sah selama terpenuhinya batas minimal pembuktian. Dalam praktik peradilan perdata, hakim juga mulai mengambil peran aktif secara proporsional dalam menggali kebenaran materiil untuk menjamin keadilan dan kepastian hukum.

Abstract

Indonesia, as an archipelagic country with a strategic geographical position, faces complex maritime security challenges amid advancements in information technology and globalization. This study aims to evaluate the potential and challenges of integrating advanced technology in detecting and preventing maritime crimes. A qualitative research method was employed by collecting data from relevant legal sources and applying a deductive approach. The results indicate that, although advanced technologies such as remote sensing and automation offer significant potential in enhancing maritime surveillance, there are substantial challenges, including the effectiveness of technology, accessibility, and related legal aspects. Collaboration between agencies and the integration of technology in maritime security strategies are deemed essential to address these challenges. In confronting this, Indonesia focuses on developing a comprehensive maritime security system and integrating advanced technology. Even though technology provides innovative solutions, its implementation also carries various challenges, including effectiveness, accessibility, and legal considerations. A thorough evaluation is necessary to ensure the efficient application of technology in detecting and mitigating maritime crimes.

Abstract

Loan agreements usually contain clauses related to the rights and obligations betwen the debtor and creditor, but sometimes a force majeure clause is included if there is a situation beyond the will of the parties, such as natural disasters or war. The force majeure clause stipulated in Article 1244 and 1245 of Civil Code, in which there are for elements, first is there is an event that causes an achivement to be impossible, second is there is a cause that lies outside debtor’s fault, third is the causative factor was unexpected, and forth is the incident could not be blamed on the debtor. COVID-19 is considered a natioal disaster through the Presidential Decree of the Republic Indonesia Number 12 of 2020 dated April 13, 2020 concerning the Determination of the Non-Natural Disaster of The Corona Virus Desease 2019 (COVID-19) as National Disaster. Because of this, COVID-19 falls into category of relative or temporary force majeure. In addition, the government has made efforts to help the comunity, in this case UMKM actors who became debtors affected by COVID-19 by providing concessions for debtors to carry out kredit restructuring through the Finansial Services Authority Regulation Number 11/POJK.03/2020 Concerning National Economic Stmulus as Policy Countercyclical Impact of Coronavirus Disease 2019 Spread. The hope is to increase the resiliance of the debtor’s business in the midst of crisi due to the COVID-19 pandemic.

Abstract

This study aims to find out the substance of the breakthrough from the existence of Law Number 12 of 2022 concerning Crimes of Sexual Violence (“Law Number 12 of 2022”) and the accommodation of the Supreme Court Regulation of the Republic of Indonesia Number 3 of 2017 concerning Guidelines for Trialing Cases of Women Confronting the Law (“Supreme Court Regulation Number 3 of 2017”) related to the accessibility of justice for women as victims of criminal acts of violence sexual. The formulation of the problem taken is Law Number 12 of 2022 in obtaining accessibility to justice for women as victims and how can the Supreme Court Regulation Number 3 of 2017 concerning Guidelines for Trialing Cases of Women Confronting the Law accommodate women to gain accessibility justice in crimes of sexual violence. The results of this study are that in substance the protection of victims of sexual violence encourages material and formal changes in the formation of Law Number 12 of 2022. The change in the formal aspect is the development of criminal procedural law in the law on criminal acts of sexual violence, especially in terms of evidence. The development of evidence from witnesses such as the exception to the principle of unus testis nullus testis in Law Number 12 of 2022, the strength of evidence for the defendant's family as a witness. Matters that must be considered by judges in order to try and ensure that women dealing with the law obtain justice in crimes of sexual violence based on Supreme Court Regulation Number 3 of 2017, namely: (a) losses suffered by victims and compensation/restitution; (b) whether there is a power relation and the condition of the victim's powerlessness; (c) the impact of the case physically, psychologically, socially, economically; (d) there is a cycle of sexual violence, a history of sexual violence from the perpetrator to the victim; (e) the condition of women victims/witnesses; (f) Women's experiences related to sexual violence; (g) potential dangers that threaten the lives of women victims; (h) the need for recovery; and (i) results of post mortem et repertum and post mortem et repertum psychiatricum.

Abstract

The rapid development of franchise businesses has had an impact on economic growth in Indonesia. Franchising is a promising business and is popular with the public. In this case, the franchise agreement must have an STPW, but many business owners still do not have one. Therefore, the franchise case which fulfills the unlawful act in the Surabaya court decision number 837/Pdt.G/2021/Pn.Sby is caused by not being in accordance with Government Regulation Number 42 of 2007 concerning Franchising and Minister of Trade Regulation Number 31/M-DAG/PER /8/2008 which causes losses to franchise recipients. In the agreement, Hanashobu does not have a Franchise Registration Certificate. This research is normative research using descriptive analysis methods based on court decree number 837/Pdt.G/2021/Pn.Sby. The results of this research can be concluded as legal protection is given after the dispute is resolved in a court decision. Thus, the franchiser, in this case Hanashobu Japanese Noodle Bar, is responsible for returning all costs for losses to the franchisee and the agreement is deemed null and void.
