Abstract

Marriage and adat are closely related to Malay tribal customs because ninik-mamak or traditional elders play an important role in wedding planning. The recommended marriage is back to bako, where a man marries the nephew of his maternal uncle, this is the ideal marriage according to the Petalangan people. There are other restrictions on marriages among the Petalangan tribe, one of which is that partners cannot come from the same matrilineal clan (tribe). Since ancient times, there has been a ban on same-ethnic marriage, and some argue that breaking this rule can be fatal. People who do not comply with these rules face customary punishments, such as fines or expulsion from the Petalang tribe. In addition, this is in accordance with the decision of the traditional elders or ninik-mamak. This research is field research with a descriptive qualitative type of research with empirical and normative juridical approaches. This research concludes that: 1. The practice of marriage among the Malays in Lubuk Terap Village still follows the customary rules that have existed since the time of their ancestors. 2. The prohibition on same tribe Malay marriages in Lubuk Village has been around since ancient times. 3. There are no verses in the Qur'an and Hadith that oblige or prohibit same tribe marriage, as well as positive law marriage regulations. In the Indonesian legal system, such as the Islamic Law Compilation (KHI), there is also no prohibition on same tribe marriages. Because of this the law of carrying out this marriage is permissible. In addition, this rule does not apply to the general public, but only to the Malays in Riau.

Abstract

Dalam konteks Islam, anak memiliki preferensi untuk selalu berdekatan dengan orang tuanya sehingga berdampak pada hubungan timbal balik yang kuat dengan orang tua yang bertanggung jawab merawat anak hingga membesarkannya. Selain sebagai kenyataan bahwa mengasuh anak juga merupakan rahmat dan amanah yang Allah berikan kepada orang tua sebagai wujud keadilan Allah atas makhluk-Nya. Kewajiban orang tua memelihara anak meliputi pengawasan, pelayanan, dan n pembelajaran sesuai dengan kebutuhan dan tingkat sosial ekonomi keluarga.

Abstract

This study aims to describe and analyze the empowerment of zakat, infaq, alms and waqf (ZISWAF) mosques in Banjarmasin. The research data is classified according to the categorization of mosques, where one with another has different functions and user communities (congregations) so that they are different in terms of income and management of Ziswa. The mosques that were the object of research were (a) Sultan Suriansyah Mosque; (b) Jami Sungai Jingah Mosque; and (c) Sabilal Muhtadin Grand Mosque. With a descriptive approach, in general, the collection of Ziswaf in each mosque is different in ways and strategies, but generally the empowerment of Ziswaf is stronger for the benefit of worship than economic empowerment and social piety.

Abstract

Buying and selling is a fundamental daily activity with a long history for humans. It is a social interaction that highlights the necessity for mutual assistance. Islamic law regulates this process to address concerns such as doubts about quality due to prices below market value. This study examines the Islamic perspective on such practices. The research adopts a qualitative approach, focusing on literature review and sourcing information from various sources such as Books, E-books, E-journals, Thesis, Al-Qur'an, and Hadiths. The study findings highlight the application of sharia principles in marketing and product promotion strategies within the context of Islamic law. The Islamic law governing the purchase and sale of promotional products entails the application of sharia principles in these transactions.

Abstract

In contemporary religious fatwas, the term emergency (dharurat) often appears, such as health emergencies (dharurat al-shihhiyah), cultural civilization emergencies (dharurat al-tsaqafiyah), and so on, all of which are aimed at dealing with certain emergency issues that are really urgent (mulji'ah). This paper tries to analyze the MUI Fatwa Number 33 of 2018 concerning the Measles-Rubella Vaccine. According to LPPOM MUI, this vaccine contains an element that is considered haram (unlawful) in Islam. Because of this, the use of the vaccine raises the question of whether or not it is religiously permitted. After conducting a comprehensive study, MUI, through the MUI Fatwa Number 33 of 2018, stated that even though the Rubella Measles Vaccine contains haram elements, its use is permitted. This permission, as this research concludes, is based on reasons of emergency. Such because until now there has been no other vaccine that is classified as halal  (lawful) that can be used against the measles diseases. Thus, the use of the vaccine is deemed essential and urgent in the interests of the next generation of Muslims in Indonesia and the safety of the life of the wider community.
