Abstract

in Serang city of Banten  there are fifteen women civil state apparatus who work in office of Religious Affairs (KUA). They worked in the office for many years but did not get the right to be promoted as penghulu or head office. The reason why women should not be penghulu or head office is the law and legislation norm, especially unauthorized women become marriage guardians (wali hakim). Whereas at Hanafiyah Mazhab there is an opinion that allows women to take the judge position. This article describes the women law possibility to be become penghulu or head oofice at KUA, legally and normatively Ada lima belas ASN (aparatur sipil negara) perempuan yang telah lama bertugas di KUA Kecamatan se-Kota Serang akan tetapi tidak ada yang dipromosikan menjabat menjadi penghulu maupun kepala kantor KUA. Di antara alasan mereka tidak berhak menjadi pejabat pencatat nikah adalah karena salah satu tugas yang melekat pada jabatan itu terdapat wali hakim yang didominasi laki-laki. Padahal dalam mazhab Hanafi ada pendapat yang membolehkan perempuan menduduki jabatan hakim. Dalam tulisan ini dijelaskan kemungkinan hukum perempuan menjadi penghulu maupun kepala KUA menurut hukum dan ketentuan normatif.

Abstract

Abstraksi Pemidanaan pelanggaran perkawinan dalam Putusan Mahkamah Agung adalah berkisar seputar poligami dan perkawinan di bawah tangan. Dasar hukum material yang diterapkan untuk menjerat pelanggaran perkawinan adalah KUHP (Pasal 279). Sedangkan Perundang-undangan administrasi perkawinan yang bersanksi pidana (administrative penal law), dalam Undang-undang No. 22 Tahun 1946 jo. Undang-undang No. 32 Tahun 1954 dan Peraturan Pemerintah No. 9 Tahun 1975 tidak dipakai sama sekali. Dengan menerapkan studi hukum normative (law in book), tampaknya implementasi kebijakan pidana (penal policy) pelanggaran perkawinan lebih baik diatur dalam Undang-undang pidana (KUHP) daripada Perundang-undangan hukum pidana atau Perundang-undangan administasi yang bersanksi pidana. Abstract Criminalization of marriage in violation of Supreme Court decisions are revolved around polygamy and marriage under the hand. The legal basis of the material that is applied to ensnare marriage is a Criminal Code/KUHP (Article 279). But, administrative penal law, in Law No. 22 Year 1946 jo. Law No. 32 Year 1954 and Government Regulation No. 9 The year 1975 was not used at all. By applying the study of normative law (law in book), it seems penal policy on Criminal Cases of Marriage is better regulated in a Criminal Code/KUHP rather than penal law or administrative penal law.

Abstract

The Constitutional Court’s Decision number 68/PUU-XX/2022 has sparked substantial debate among various societal factions. The controversy stems from the interpretation that the ruling potentially enables ministers to misuse their authority and exploit state resources for electoral advantages while running for President or Vice President, without necessitating resignation from their current position. This study seeks to discern the ramifications of the Constitutional Court's decision number 68/PUU-XX/2022 on the roles and authorities of ministers within a presidential government structure, and to scrutinize the decision from an Islamic law/siyasah perspective. This investigation adopts a descriptive qualitative approach, grounded in library research. The normative juridical methodology is employed, focusing on decision number 68/PUU-XX/2022. The study concludes that within the context of siyasah sharia, the decision could compel the nation’s leader (the President) to promulgate legal regulations that violate the principle of fairness between high-ranking and ordinary officials. However, the President risks being deemed unconstitutional if derivative regulations stemming from the decision are not enacted. Power abuse by state officials (ministers), partly driven by conflict of interest, is a critical concern. From the perspective of Islamic law/siyasah, the decision’s implications could potentially harm society and the government.

Abstract

This study aims to describe and analyze the empowerment of zakat, infaq, alms and waqf (ZISWAF) mosques in Banjarmasin. The research data is classified according to the categorization of mosques, where one with another has different functions and user communities (congregations) so that they are different in terms of income and management of Ziswa. The mosques that were the object of research were (a) Sultan Suriansyah Mosque; (b) Jami Sungai Jingah Mosque; and (c) Sabilal Muhtadin Grand Mosque. With a descriptive approach, in general, the collection of Ziswaf in each mosque is different in ways and strategies, but generally the empowerment of Ziswaf is stronger for the benefit of worship than economic empowerment and social piety.

Abstract

The enforcement of court decisions regarding custody (hadanah) and alimony (nafkah) for children and ex-wives post-divorce is frequently inadequate, with many husbands failing to comply. Although decisions based on legal provisions (rechtsspraack naar wetboeken) should be effective according to the principle of the Effectiveness of Law, numerous children and women in Indonesia suffer from the ineffective execution of judges' rulings in alimony and custody cases. Ensuring the rights of children and women after divorce can be improved through proper implementation of laws in a preventive, curative, and supportive manner. In Indonesia, the E-Mosi Caper application has been developed in Bengkulu Province, in collaboration with the PTA Bengkulu and local government, to enhance the effectiveness of laws concerning custody and alimony. This application could serve as a model for other regions. In contrast, Malaysia has established a Family Support Division (BSK) tasked with overseeing maintenance payments to support children and ex-wives after divorce. This study employs a comparative legal method to examine the frameworks for ensuring the rights of children and women post-divorce in both countries. The findings aim to highlight the effectiveness of the existing systems and after recommendations for improving law enforcement and protecting post-divorce rights.

Abstract

This study aims to investigate the potential and difficulties of using cash waqf-based sukuk in the growth of the halal industry in the maritime sectors of two nearby nations, Malaysia and Indonesia. Green and blue sukuk have been combined in both nations to aid in the government's endeavors to accomplish the Sustainable Development Goals (SDGs). The main topics of this study's comparative analysis of the policies and strategies in both nations are the implementation mechanisms of cash waqf in supporting blue economy projects and the opportunities and problems encountered. Direct stakeholder observations, interviews, and focus groups in Malaysia and Indonesia provided the research data. Although each nation has a unique method of implementation and regulation, the research findings demonstrate parallels in using cash waqf for sustainable economic growth. Although the integration of green sukuk into blue sukuk has not yet been optimally implemented due to political and theological factors, two Muslim nations with the largest populations and the largest maritime territories have also become pioneers in using cash waqf among Muslim nations worldwide.

Abstract

Understanding the rights and obligations of husband and wife and carrying them out in a balanced manner is the main pillar for creating a family that is sakīnah mawaddah wa rahmah (peaceful, harmonious, and prosperous). Unfortunately, these rights and obligations are often ignored, resulting in various problems in the household. This research aims to find out the views of Sheikh Nawawi al-Bantani regarding the rights and obligations of husband and wife as written in his book 'Uqūd al-Lujain fī Bayāni Huqūq al-Zaujain. Apart from that, this research also tries to draw out the relevance of this view to changes in the attitudes of women members of the Da'arul Asy-ariyah taklim assembly towards their husbands in their daily household life. This research uses qualitative methods with a socio-empirical approach. The results of this research show that the study material of the 'Uqud al-Lujain book, which contains the rights and obligations of husbands and wives, has a positive influence on the mothers who are members of the study, which is marked by changes in the attitudes and behavior of wives towards their husbands from previously being disrespectful, disobedient and lacking respect for their husbands to being wives who are obedient, respectful and appreciative of their husbands. This positive attitude then makes household life more harmonious, serene, and peaceful so that a sakīnah mawaddah wa rahmah family atmosphere can be created.

Abstract

Bagaimana Pandangan Islam Tentang Kesetaraan Gender (Perspektif Kemanusiaan)? Metodologi penelitian yang digunakan adalah pendekatan kualitatif, menggunakan studi pustaka melalui buku, jurnal dan makalah yang berkaitan dengan penelitian. Manusia pada dasarnya adalah pelayan, dan tidak ada perbedaan antara pria dan wanita yang melakukan banyak tindakan baik untuk mereka, terlepas dari jenis kelamin mereka. Ada potensi dan kemungkinan yang sama bagi keduanya untuk menjadi hamba Tuhan yang ideal. Selain menjadi hamba yang penurut dan taat yang takut kepada Allah, maksud dan tujuan keberadaan umat manusia di bumi adalah agar mereka menjadi khalifah di bumi. Laki-laki dan perempuan memiliki kewajiban yang berbeda sesuai dengan kodrat masing-masing dalam keyakinan Islam. Selama pria dan wanita mempertahankan fitrah ini, mereka memiliki kesempatan yang sama untuk memiliki kehidupan penuh dalam pendidikan, sosial-masyarakat, politik, seni, dll. Sejumlah hadits Nabi yang memuji perempuan menunjukkan bahwa Islam adalah agama yang mengedepankan martabat dan nilai perempuan. Menjadi manusia tidaklah mudah, tetapi akan bodoh untuk membiarkan tantangan-tantangan ini membahayakan kehormatan kita. Secara khusus, saat menghadapi fenomena menolak perbedaan manusia, yang mengunci masyarakat dalam stigma ketidaksetaraan gender. Pria dan wanita menyadari bahwa mereka berdua adalah manusia, sebagaimana mestinya.

Abstract

The judges of Religious Courts play a crucial role in reducing underage marriages. The judges can consider marriage dispensation by emphasizing the principle of dominus litis, which can be understood as a case controller. Since the Religious Courts in Banten have granted considerable dispensation appeals, the early-age marriages have increased significantly. This research examines the implementation of the dominus litis principle and the difficulties in establishing the grounds for urgent marriage dispensation. The data were collected via observations and interviews with the judges, former judges, lawyers, and societies. This research employs the juridical-empirical research technique, examining several facts and data generated by the public. The study reveals that to approve marriage dispensation, the judges of ReligiousCourts merely focus on the legal truth from the applicants’ statements, the underage marriage candidates, witnesses from applicants’ immediate families, and document evidence presented with the application. Judges rarely summon additional witnesses from specialists and professionals focusing on the children’s issues, which might strengthen formal legal evidence. The court granted the request to safeguard the children from immoral behavior, contradicting the  common public ethics and morals and ignoring a significant principle of dominus litis.  Abstrak: Hakim Pengadilan Agama memiliki peran penting untuk menekan kasus perkawinan dini. Hakim dapat mempertimbangkan dispensasi nikah dengan menekankan prinsip dominus litis, yaitu hakim sebagai pengendali perkara. Sejak permohonan dispensasi banyak dikabulkan oleh pengadilan agama di Banten, perkawinan dini di Banten mengalami peningkatan secara signifikan. Studi ini menganalisis penerapan "dominus litis principle" dan kendalanya dalam pembuktian alasan mendesak dispensasi nikah. Data diperoleh dari hasil observasi dan wawancara dengan hakim, mantan hakim, pengacara dan masyarakat. Penelitian ini menerapkan motode penelitian hukum yuridis-empiris yang berfokus pada penilaian terhadap berbagai fakta dan data dari masyarakat. Hasil analisis menunjukan bahwa hakim Pengadilan Agama umumnya hanya bertugas mencari kebenaran formil dari keterangan pemohon, anak yang dimohonkan dispensasi, saksi-saksi dari orang dekat pemohon, dan bukti dokumen yang diajuan oleh pemohon. Hakim jarang sekali mendatangkan saksi tambahan dari para ahli dan profesional lain yang berhubungan dengan dunia anak yang bisa menguatkan alat bukti. Hakim memutuskan untuk mengabulkan permohonan  dengan alasan menjauhkan anak dari tindak asusila yang bertentangan dengan etika dan moral yang berlaku di tengah masyarakat umum dan mengabaikan peran penting prinsip dominus litis.

Abstract

Javanese marriage customs in Banten reflect philosophical, social, and religious values that play a vital role in shaping ideal families and fostering social cohesion. However, modernization and globalization threaten the continuity of these traditions, especially among younger generations who often perceive them as outdated. This study employs a qualitative approach with normative juridical methods, supported by field data collected through observations and interviews with traditional leaders, religious scholars, married couples, and academics in the Banten region. The findings reveal that Javanese marriage traditions embody values such as mutual cooperation, empathy, and respect for parents—principles that align with Islamic teachings. Nonetheless, certain symbolic practices that are burdensome or potentially incompatible with Islamic law require contextual reconstruction. The Islamic legal concept of ‘urf (custom) provides legitimacy for traditions that do not contradict sharia and offers a framework for harmonizing local culture with Islamic principles. Through adaptive reconstruction, essential cultural values can be preserved while meeting the needs of modern society. This study recommends cultural education, simplification of rituals, and supportive policy frameworks as sustainable strategies for cultural preservation.
