Abstract

Penelitian ini bertujuan untuk menganalisis konsolidasi tanah perkotaan dalam rangka penyediaan tanah untuk penataan perumahan dan pemukiman kumuh. Metode yang digunakan adalah metode metode yuridis normatif yang bersifat preskriptif. Hasil penelitian dapat disimpulkan bahwa, pertama Konsolidasi tanah perkotaan untuk pembangunan perumahan berdasarkan UU No. 1 Tahun 2011 dengan cara pelaksanaan konsolidasi tanah bertujuan untuk menyediakan tanah bagi pembangunan rumah, perumahan, dan kawasan permukiman, juga dapat dilaksanakan bagi pembangunan rumah tunggal, rumah deret, atau rumah susun yang meliputi penataan kembali bidang-bidang tanah termasuk hak atas tanah dan/atau penggunaan tanahnya dengan dilengkapi prasarana jalan, irigasi, fasilitas lingkungan dan/atau fasilitas penunjang lainnya yang diperlukan, dengan melibatkan partisipasi para pemilik tanah dan/atau penggarap tanah Kedua konsolidasi tanah bagi penyediaan tanah sebagai kebijakan pembangunan terhadap penataan perumahan di Perkotaan bisa dilakukan dengan melalui penerapan konsep konsolidasi tanah vertikal dan bank tanah.

Abstract

Indonesia has implemented various policies to accelerate stunting reduction, however whether these policies have effectively reduced stunting, because the prevalence of stunting is still high, at 30.8%. The government's involvement in creating and implementing stunting policies in Indonesia still needs to be effective in terms of legal substance, structure, and culture. This research employs socio-legal research methods and a comparative approach with Finland. This research shows, first, that the existing acceleration policy has yet to effectively overcome the problem of stunting in Indonesia because there is still a policy of implementing taxes on nutritious food commodities, which affects people's purchasing power. There is a need for socialization and integration of stunting policies across sectors, technical coordination between central and regional government organizations, and community participation in policy implementation. Second, comparative studies in Finland can provide new information regarding understanding health and formulating regulations for implementing taxes on unhealthy foods. Therefore, this research has the potential to enhance the prevention of stunting and provide valuable insights for the Indonesian government to formulate and implement policies.

Abstract

The aim of this research is to determine the implications of eliminating the minimum threshold of 30% of forest areas in river basins and islands to ensure environmental protection and management in the Gunung Lawu forest area, Karanganyar Regency from an Indonesian legal perspective. and the impact that will have on the protection and management of environmental preservation in the Mount Lawu forest area, Karanganyar Regency. This research is normative where the author will analyze and study it using relevant laws to find the necessary solutions.The results of his research, according to historical chronology, the figure of 30 percent was the doctrinal practice of the Dutch East Indies government. So the specifications are less relevant to the current implementation. If this consolidated Omnibus Law is implemented, then Article 18 of the Forestry Law which regulates a minimum of 30 percent of forest area will no longer apply.. This elimination aims to remove obstacles in areas where the forest area is less than 30% so that development can continue, such as in other forest areas which still have a forest area of more than 30%. Opportunities for increasing conservation and environmental management in the Mount Lawu forest area, Karanganyar Regency can be made into National Park status. National Parks are natural conservation areas that have original ecosystems, managed using a zoning system that are used for scientific research, education, cultivation support, tourism and natural recreation.

Abstract

This study examines the role of PPAT and Notaries in the digital transformation of land certificates in Gunungkidul Regency, triggered by the issuance of Minister of ATR/Ka BPN Regulation No. 1 of 2021 on Electronic Certificates. The regulation's implementation is phased and has not been uniformly applied across Indonesia, including in Gunungkidul Regency. The study aims to explore the urgency of PPAT and Notaries' roles, obstacles encountered in the digital transformation process, and its implications from a State Administrative Law perspective. Using a combination of normative and empirical legal methods, the research employed qualitative descriptive analysis and normative analysis techniques. Data collection was conducted at the Wonosari District PPAT Office, the INI Wonosari Office, and the ATR/BPN Gunungkidul Regency Office. The findings highlight that PPAT and Notaries play essential roles in electronic certificate verification, electronic processing, creation of land zoning files, and land registration. Electronic certificates enhance data security, validity, and prevent duplication or forgery. However, obstacles such as limited human resource competence, inadequate office infrastructure, unintegrated data, and the need for document formalization hinder optimal implementation. External challenges include public unfamiliarity with digital technology and device ownership limitations. From the perspective of State Administrative Law, PPAT and Notarial deeds are formalized under civil law, not public law, and are not classified as unilateral acts (beschikking). This is confirmed by court decisions, including Decision No. 22/PUT.TUN/1993/PTUN.SBY and Decision No. 34 PK/TUN/2001, which clarify that such deeds cannot be disputed in State Administrative Court

Abstract

Occupational Safety and Health (OSH) is a crucial aspect of the geothermal energy industry to ensure worker safety and prevent occupational diseases. This study examines the implementation of legal protection for OSH at PT Geo Dipa Energi (Persero) Unit Dieng, focusing on the company's Health, Safety, and Environment (HSE) policies, compliance with labor regulations, and workplace risk management. PT Geo Dipa Energi enforces various safety measures, including HSSE (Health, Safety, Security, and Environment) mandatory procedures, OSH training programs, and social security coverage through BPJS Employment and BPJS Health. The findings indicate that the company’s OSH management aligns with national regulations and international standards such as ISO 45001. However, several challenges persist, including a lack of discipline in using personal protective equipment (PPE), potential exposure to toxic gases such as hydrogen sulfide (H₂S), high noise levels from machinery, and inadequate ventilation. These factors pose significant risks to workers’ health and productivity. To address these challenges, PT Geo Dipa Energi has implemented the Hazard Observation (OrBa) program, which encourages employees to actively identify and report workplace hazards. This initiative aims to foster a stronger safety culture and enhance proactive risk management. By continuously improving its OSH strategies, PT Geo Dipa Energi is committed to ensuring a safer, healthier, and more compliant work environment, ultimately minimizing workplace hazards and improving operational sustainability.

Abstract

The online buying and selling of songbirds in Surakarta has grown significantly with the rise of e-commerce, offering convenience, efficiency, and broader market access. Consumers can easily browse and purchase birds through various online platforms without geographical limitations. However, this type of transaction also presents several risks, including fraud, uncertainty about the bird’s quality, and potential issues during shipping, such as injury or death. Legal protection for consumers engaging in online transactions is regulated under Law No. 8 of 1999 on Consumer Protection (UUPK) and Law No. 11 of 2008, amended by Law No. 19 of 2016, on Electronic Information and Transactions (UU ITE). These regulations outline the rights and obligations of both business actors and consumers to ensure fair and secure transactions. Despite the benefits of online transactions, challenges such as lack of transparency, unreliable sellers, and logistical issues remain prevalent. Consumers are advised to conduct transactions with reputable sellers, such as members of bird enthusiasts’ communities, to reduce the risk of fraud. Additionally, in cases of consumer losses, dispute resolution mechanisms are available through e-commerce complaint services or institutions such as the Consumer Dispute Settlement Agency (BPSK), Consumer Protection Organizations (LPKSM), and the Indonesian Consumers Foundation (YLKI). As online commerce continues to evolve, strengthening consumer protection mechanisms is essential to creating a more secure and reliable marketplace for songbird enthusiasts.
