Abstract

This research was conducted to find out whether the implementation of agricultural land-sharing agreements are in accordance with laws and regulations and whether there are obstacles in the implementation of agricultural land-sharing agreements in Ngemplak District, Boyolali Regency. This type of research used by the author is empirical juridical research. The type of data used is secondary data. Data collection techniques used were interviews and literature study. This study uses qualitative data analysis techniques to group data obtained from research in the field, and is associated with theories, principles, and legal norms obtained from library studies. Based on the results of the study the authors found that in the implementation of the production sharing agreement in Ngemplak District, Boyolali Regency was not in accordance with Law Number 2 of 1960, it was caused by the community still using local customary law, namely an oral or unwritten agreement made on the basis of trust and agreement from both parties, both landowners and tenants. The timeframe for the production sharing is divided into 2 (two), namely determined and unspecified, it is still ongoing until now and the expiration of the production sharing agreement is based on the agreement of both parties. The obstacle in implementing Revenue Sharing according to the Revenue Sharing Law is the lack of community knowledge, even the village administrator does not know about the Production Sharing Agreement.

Abstract

Penelitian ini bertujuan untuk menganalisis konsolidasi tanah perkotaan dalam rangka penyediaan tanah untuk penataan perumahan dan pemukiman kumuh. Metode yang digunakan adalah metode metode yuridis normatif yang bersifat preskriptif. Hasil penelitian dapat disimpulkan bahwa, pertama Konsolidasi tanah perkotaan untuk pembangunan perumahan berdasarkan UU No. 1 Tahun 2011 dengan cara pelaksanaan konsolidasi tanah bertujuan untuk menyediakan tanah bagi pembangunan rumah, perumahan, dan kawasan permukiman, juga dapat dilaksanakan bagi pembangunan rumah tunggal, rumah deret, atau rumah susun yang meliputi penataan kembali bidang-bidang tanah termasuk hak atas tanah dan/atau penggunaan tanahnya dengan dilengkapi prasarana jalan, irigasi, fasilitas lingkungan dan/atau fasilitas penunjang lainnya yang diperlukan, dengan melibatkan partisipasi para pemilik tanah dan/atau penggarap tanah Kedua konsolidasi tanah bagi penyediaan tanah sebagai kebijakan pembangunan terhadap penataan perumahan di Perkotaan bisa dilakukan dengan melalui penerapan konsep konsolidasi tanah vertikal dan bank tanah.

Abstract

Penelitian ini bertujuan untuk mengetahui perlindungan hukum terhadap Pekerja Migran Indonesia yang diberikan oleh BP3TKI. Metode penelitian yang digunakan adalah penelitian hukum normatif atau doktrinal yang dilakukan dengan cara meneliti bahan pustaka. Bahan hukum yang digunakan dalam penelitian ini berupa bahan hukum primer dan bahan hukum sekunder. Bahan hukum primer adalah perundang-undangan dan bahan hukum sekunder berupa publikasi tentang hukum. Berdasarkan hasil penelitian dan pembahasan, diperoleh kesmpulan bahwa,  Perlindungan hukum atas hak-hak pekerja migran dalam bekerja sudah berjalan dengan baik dan telah sesuai dengan Undang-Undang No. 18 Tahun 2017 tentang Pelindungan Pekerja Migran Indonesia dimana perlindungan diberikan yakni fase sebelum bekerja, selama bekerja dan setelah bekerja.

Abstract

Dengan semakin meningkatnya kegiatan pembangunan, menyebabkan kebutuhan tanah semakin meningkat. Kebutuhan tanah untuk kepentingan umum tidak jarang menimbulkan permasalahan karena dalam proses pengadaan tanah seringkali ditemukan ada yang tidak sepakat mengenai besaran ganti kerugian. Dalam menentukan besaran ganti kerugian tersebut harusnya dilakukan dengan cara musyawarah antara panitia pengadaan tanah dan pihak yang berhak, akan tetapi pada kenyataannya dalam menentukan besaran ganti kerugian tersebut hanya diputuskan sepihak saja oleh panitia pengadaan tanah. Seringkali aspek keadilan dalam pengadaan tanah dikesampingkan dan yang diutamakan adalah aspek kemanfaatannya. Pihak pemilik tanah beranggapan bahwa besaran ganti rugi tersebut masih belum layak sedangkan pihak pemerintah menganggap bahwa besaran ganti rugi tersebut sudah layak dan adil sehingga hal tersebut menimbulkan ketidaksepakatan antar kedua belah pihak. Penelitian ini bertujuan untuk mengetahui aspek hukum ganti rugi dalam pengadaan tanah untuk kepentingan umum. Dalam penelitian kali ini metode yang digunakan yaitu metode penelitian empiris dengan sifat penelitian deskriptif. Data yang digunakan yaitu data primer yang diperoleh langsung dari wawancara dan data sekunder yang meliputi dokumen. Secara ringkas kesimpulan dari hasil pembahasan adalah Pelaksanaan Pengadaan Tanah belum sepenuhnya sesuai dengan peraturan perundangan karena tidak adanya musyawarah antara pihak yang berhak dan Panitia pengadaan Tanah dalam hal menetapkan besaran ganti kerugian oleh karena itu ada beberapa pihak yang tidak sepakat dengan besaran ganti kerugian tersebut.

Abstract

The study aims to analyze the indefeasible title concept on electronic land certificates for preventing land mafia. This research is normative legal research using legal and conceptual approaches. Legal materials include primary and secondary legal materials. According to the study, one of the causes of the land mafia is the land registration system's tendency to publish harmful material, as contained in Government Regulation 24 of 1997 on Land Registration. Therefore, reforming and developing the land law system into a positive publication system is necessary. By the Regulations of the Minister of Agrarian No. 1 of 2021 on Electronic Certificates, Electronic certificates are expected to be a database of landlords to reduce land disputes and strengthen the legitimacy of land certificates as a guarantee of ownership of land rights in Indonesia. Suppose an error in the registration procedure of a positive publication causes the losses of the party that should be more entitled. In that case, the state will guarantee compensation in substance to the party whose right is proven correct using the indefeasible title concept.

Abstract

With  the  Covid-19  pandemic  that  has  hit  all  of  Indonesia,  it  has  caused  losses  that  have  had  a  huge  impact  on  people's  lives.  This  of  course  not  only  has  an  impact  on  the  central  government  but  also  has  an  impact  on  regional  governments  because  each  region  has  its  own  responsibility  to  protect  and  serve  the  community.  in  the  region,  in  this  way  the  regional  government  also  gets  a  very  pronounced  impact,  especially  in  the  Original  Regional  Income  (PAD)  sector.  Original  Regional  Income  itself  is  very  important  for  regional  governments  because  Original  Regional  Income  itself  is  one  of  the  sources  of  regional  government  financing  and  regional  development,  In  ithe  future,  Regional  Original  Income  will  be  used  to  finance  expenditure  from  the  regional  government  itself  and  for  development  costs  for  the  region  itself,  for  example  the  development  of  tourist  areas,  government  programs  that  benefit  the  community  and  the  regional  government  itself,  and  so  on.  In  the  explanation  above,  of  course,  in  implementing  this  regional  program,  there  are  of  course  obstacles.  With  the  obstacles  that  arise,  they  must  be  resolved  and  there  must  be  a  solution  that  might  or  could  be  implemented  in  other  regions  and  be  beneficial  for  other  regions  in  terms  of  the  Agrarian  Regional  Program.

Abstract

Penelitian ini bertujuan untuk mengetahui perencanaan dan pemanfaatan ruang berkeadilan untuk mengantisipasi alih fungsi tanah pertanian. Banyaknya terjadi alih fungsi tanah pertanian ke tanah non pertanian, menyebabkan hal yang urgent untuk dilakukan penataaan karena tentunya akan berpengaruh terhadap ketahanan pangan, dan menurunnya daya dukung lingkungan. Dengan perencanaan dan pemanfaatan yang berkeadilan diharapkan dapat mengantisipasi alih fungsi tanah pertanian. Berdasarkan hasil pembahasan maka: Perencanaan dan pemanfaatan ruang berkeadilan diperlukan dalam mengantisipasi alih fungsi tanah pertanian. Perencanaan dan pemanfaatan ruang berkeadilan dilakukan dengan mengingat prinsip: (1) Tidak bertentangan dengan undang–undang; (2) Sesuai dengan tata ruang wilayah; (3) Menyejahterakan rakyat; (4) Menjaga keseimbangan lingkungan, hal ini dilakukan untuk mencegah terjadinya alih fungsi tanah pertanian., sehingga berdampak terhadap menurunnya daya dukung lingkungan; (5) Adanya penghormatan terhadap pemilik hak atas tanah; (6) Memperhatikan fungsi sosial hak atas tanah. Dalam undang–undang penataan ruang, untuk mengendalikan pemanfaatan ruang dilakukan dengan pengendalian pemanfaatan ruang melalui penetapan peraturan zonasi, perizinan, pemberian insentif dan disinsentif, serta pengenaan sanksi. Dalam pengendalian tersebut dilakukan perencanaan dan pemanfaatan ruang yang berkeadilan sebagai usaha dalam mengurangi dampak terhadap menurunnya daya dukung lingkungan.

Abstract

This research examines the legal protection of consumers' rights to clean water services by the Regional Public Company (Perumda) Tirta Mulia, Pemalang Regency. The research background illustrates the importance of the availability of clean water as a basic human need in the context of Indonesian law, which is regulated by Law Number 8 of 1999 concerning Consumer Protection. The main focus of the research is to analyze how Perumda Tirta Mulia fulfills its obligations as a business actor in line with the Consumer Protection Law. In this context, research also identifies obstacles that may arise in protecting consumers legally, especially concerning clean water services. The method used is empirical legal research with a statutory and conceptual approach. Primary data was obtained through interviews with Perumda and consumers, while secondary data came from legal literature, statutory regulations, and related information sources. Data analysis was conducted qualitatively by referring to legal theories and consumer protection concepts. It is hoped that the results of this research can contribute to understanding the implementation of Law Number 8 of 1999 in the context of clean water services by Perumda. Apart from that, it is also hoped that this research can provide recommendations for increasing consumer legal protection and improving clean water services provided by Perumda Tirta Mulia, Pemalang Regency.

Abstract

This research aims to examine the fulfillment of the Right to Health, Safety, Comfort, and Convenience by the Surakarta city government, namely the flats Manager for the Begalon II Tipes flats Residents. The background of this research is a complaint from the voice of the Low-Income Community or MBR for the Government to pay more attention to their rights. In addition, the gap between the rights obtained between residents in flats which were built longer is not as good or as appropriate as the rights obtained by residents in flats which were built more recently. The main focus of this research is the fulfillment of health, safety, comfort, and convenience rights that should be fulfilled by the manager fairly. The efforts of the manager in fulfilling these rights are also the focus of this research. This research also describes the rights and obligations of flats residents so that the research is also balanced. This research method is empirical legal research. Primary data is obtained through interviews with the Head of UPT Rusunawa of the Surakarta City Housing and Settlement Office and residents of Begalon Tipes II flats. While secondary data is sourced from legal literature, laws and regulations, and from various related sources of information. Data analysis is done qualitatively by referring to the rights of occupants of houses or buildings from various laws and regulations. The results of this research are expected to contribute to the understanding of the implementation of regulations on flats and the protection of the rights of residents, especially the rights to health, safety, comfort, and convenience.
