Abstract

Penelitian ini dilatarbelakangi oleh sering terjadinya kasus pencabulan yang dari tahun 2012-2016 di Kabupaten Jepara, dimana sebagian besar korban merupakan anak dibawah umur. Sebagaimana telah diatur dalam Undang–Undang bahwa korban pencabulan wajib diberikan perlindungan terutama bagi remaja, anak dan wanita. Pihak kepolisian yang difokuskan dalam menangani permasalahan remaja, anak dan wanita tersebut adalah Unit IV (PPA) Satuan Reskrim. Untuk itu dilakukan penelitian yang bertujuan untuk mengetahui bentuk perlindungannya, Peran Unit IV (PPA) sesuai dengan yang diharapkan atau tidak serta faktor–faktor yang mempengaruhi proses perlindungan terhadap anak dibawah umur korban pencabulan yang dilakukan oleh Unit IV (PPA) Polres Jepara. Penelitian ini menggunakan pendekatan kualitatif, menggunakan teknik pengumpulan data dengan wawancara, pengamatan dan telaah dokumen. Hasil penelitian menemukan bahwa bentuk perlindungan kepada korban pencabulan berupa (1) perlindungan sementara, koordinasi terkait layanan kesehatan, pendampingan korban, shelter, layanan dengan KPAI, pemberian keterangan terkait hak korban meliputi kerahasiaan korban, perkembangan perkara, lidik dan sidik perkara pencabulan, mengetahui identitas pelaku, menjaminan keselamatan korban sampai hasil keputusan terhadap perkara, (2) faktor-faktor yang mempengaruhi dalam pemberian perlindungan terhadap anak dibawah umur meliputi penyidik Unit IV (PPA) serta sarana dan prasarana yang kurang mendukung dalam pelaksanaan perlindungan anak dibawah umur. Namun, peran Unit IV (PPA) belum seluruhnya sesuai dengan yang diharapkan, terdapat faktor-faktor yang mempengaruhi dalam memberikan perlindungan antara lain penyidik Unit IV (PPA) sebagai aparat penegak hukumnya, sarana dan prasarana terkait RPK (Ruang Pelayanan Khusus) yang belum memadai pihak kepolisian. Maka, penulis merekomendasikan beberapa hal berikut berdasarkan hasil (1) mengikutsertakan anggota Unit IV (PPA) dalam pendidikan dan kejuruan (2) berkoordinasi dengan Satuan Kerja Binmas untuk bersama-sama mengadakan penyuluhan diseluruh sekolah yang ada di Kabupaten Jepara dan koordinasi dengan instansi terkait seperti KPAI terkait perlindungan sementara terhadap anak dibawah umur korban tindak pidana pencabulan.

Abstract

Electronic Trafficking Law Enforcement (ETLE) is an electronic system for monitoring traffic law enforcement which takes the form of ETLE Implementation itself, generally designed with the provisions of Law Number 22 of 2009 regarding Lailu Liintais and Aingkutain Jailain, including other enforcement agencies ETLE reaches the limit with this goal but still no success effective. Maikai dairii is necessary to research regarding the maisailaihain. This thesis is entitled "Ainailiisiis Yuriidiis Pelaiksainaiain Sainksii Dendai Tiilaing paidai Electronic Traiffiic Laiw Enforcement (ETLE) terhaidaip Pelainggaair Lailu Liintais According to Undaing-Undaing Number 22 Taihun 2009 regarding Lailu Liintais dain Aingkutain Jailain (in the Law of Diitlaintais Poldai Sumai terai Utairai)”. The method used in writing this thesis is the empiric jurisprudence research method, namely the method that focuses on the working of the laws of Maisyairaikait. The writing of this research was obtained from the source of the study, namely the study of research using the online questionnaire method which was given to the public and supported by regulations and legal matters relating to the writing of this research. The ainailiisai daitai method which is used in the ainailiais method which is obtained from the haisiil waiwaincairai using the Diitlaintais Poldai Sumaiterai Utairai method. The results of the research found that the results of ETLE's achievements to this extent have not yet been effective in terms of the results of the implementation, both internal and external, some of the results that have occurred, namely sairainai and praisairainai factors, government factors aihaimain source daiyai mainusiiai dailaim hail inii piihaik poliisiiain, faiktor cuaicai dain faiktor maisyairaikait. These haimbaitains are limited because the government has not yet achieved synergy and governmental powers, and the police have not yet achieved success. Apart from that, there are other solutions that can be differentiated into other non-compliance solutions

Abstract

Electronic Traffic Law Enforcement (E-TLE) is an electronic-based traffic law enforcement system that aims to increase the effectiveness of monitoring traffic violations. Although the implementation of E-TLE in Indonesia is based on Law Number 22 of 2009 concerning Road Traffic and Transportation, its implementation in several regions, including Medan City, has not run optimally. This study aims to analyze the legal basis of E-TLE, the application of ticket fines to traffic violators, and identify obstacles and resolution efforts so that the implementation of E-TLE runs effectively in Medan City. The research method used is empirical juridical method with a qualitative approach. The research data were obtained through interview studies and online questionnaires involving the community and the North Sumatra Police Traffic Directorate, and supported by a review of related regulations and literature. The results showed that the implementation of E-TLE has not been effective due to various obstacles, such as limited facilities and infrastructure, underutilization of human resources, the influence of weather, and the lack of synergy between local governments, police, and the community. These obstacles indicate the need for improvement in terms of technical and policy to support the optimal success of E-TLE implementation.
