Abstract

The purpose and benefits of this research are to find out violence against children in Gunungsitoli court, to find out legal efforts in protecting children against child abuse, to find out the inhibiting factors in protecting children in Gunungsitoli District Court. The benefit is to provide input to the Gunungsitoli district court regarding legal protection for victims of violence. This research is analytical descriptive, which means describing the facts studied and the relationship with the legislation, theories, and opinions of legal experts. Conclusions and advice on legal protection according to positive law Indonesia never guarantees the fulfillment of children's rights, especially the rights of children who receive an education. Hereby the state's legal obligations in child protection will depend on the positive laws that exist in the country, so that child protection can be adequate in the application of children, and efforts to protect children need support from the government and the community in terms of effective and comprehensive child comfort. In this case, given the increase in violence against children every year, it is necessary to have the legal protection that must be taken seriously by the government, the community and other non-governmental organizations.

Abstract

This study aims to look criminologically and juridically about crime in human actions that compromises the basic norms of society. Actions of elements that break the rules that live and develop in society. This type of research is analytical descriptive of juridical normative, the main material in this research is secondary data which is done by collecting material in the form of: Primary Legal Material, namely legal material in the form of laws and regulations, official documents that have authority related to the problem , namely the Criminal Code. Secondary Legal Material, which is all legal material which is an unofficial document publication including books, scientific works. Tertiary Legal Materials, i.e. materials that provide and explain primary and secondary legal materials, such as public dictionaries, legal dictionaries, scientific journals, magazines, newspapers and the internet that are still relevant to this research, research results and discussions to explain the elements the element of embezzlement consists of elements of subjective offense in the form of a deliberate offender to embezzle the assets of others as defined in the article of the law through the words: intentionally and the element of Oyective violation consists of: anyone's element, element of illegally controlling, object elements, elements partially or wholly owned by others and the object elements there are not for crime.

Abstract

This article discusses the study of the Legal Analysis of the Criminal Act of Exploiting Forest Areas in this case the analysis of judges' considerations of Decision Number 3684/Pid.Sus/2015/PN-Mdn and to examine the judicial barriers of judges in dropping Decision Number 3684/Pid.Sus/2015/PN-Mdn. This study uses a normative juridical approach and is presented in the form of analytical descriptive. The results found were criminal legal arrangements regarding forestry crimes regulated in Act Number 18 of 2013 concerning Prevention and Eradication of Forest Destruction. Judge consideration analysis of the decision No. 3684/Pid.Sus/2015/PN-Mdn) which states the defendant Aswin Syahfitri a.k.a. Aswin has been proven legally and convincingly guilty of committing a criminal offense Individuals who deliberately carry out plantation activities without the permission of the Minister. Internal juridical barriers in imposing a criminal act for encroachment of forest areas in the Medan District Court is that there are no internal obstacles. The Panel of Judges in considering forestry criminal cases needs to impose a criminal which also refers not only to the forestry law, but also needs to include the criminal in the environmental law and also the plantation law.

Abstract

Theoretically the existence of restorative justice through mediation of penalties is a new dimension in the Indonesian criminal justice system. However, practically, restorative justice has long been applied in Indonesian society, especially in the scope of customary criminal law. But unfortunately, the settlement of traffic accident cases that have caused serious injuries and death through mediation by the law has not yet been integrated in criminal law. The problems in this study are, how do the legal arrangements and the application of restorative justice as well as the obstacles to the implementation of restorative justice in the settlement of traffic accident cases that cause serious injuries and deaths at the Police Traffic Police Traffic Unit?This type of research is empirical juridical research, while the nature of the study is descriptive analysis. Based on the results of the study, The legal basis for implementing restorative justice in the settlement of traffic accident cases refers to the discretionary authority of the police regulated in Article 18 of the Police Law and Circular Letter of the National Police Chief Number 8 of 2018 regarding the Application of Restorative Justice Justice in the Settlement of Criminal Cases. The implementation of restorative justice in the settlement of cases of traffic accidents that cause serious injuries and deaths at the Traffic Police Traffic Unit of the Coal Police Station has gone according to community expectations. In the case of a traffic accident that results in fatalities, restorative justice cannot be carried out. Barriers to the implementation of restorative justice in the settlement of traffic accident cases that cause serious injuries and deaths at the Traffic Unit of the Coal of Polres are influenced by two factors, namely the legal substance that has not been supported and the legal culture of the community which tends to have a paradigm of material values ​​in determining the size of justice.

Abstract

Sikap pemerintah terhadap meningkatnya peredaran gelap narkotika lintas negara Malaysia ke Indonesia dan sebalikya sudah dilaksanakan kerja sama antar negara melalui MOU hubungan internasioanal baik bilateral maupun multilateral. Modus peredaran Narkotika dari negara Malaysia ke Indonesia melalui perairan Tanjung Balai, yaitu dengan mencari jalur-jalur tertentu yang luput dari pengawasan petugas dan melalui pelabuhan-pelabuhan tidak resmi yang sulit dipantau oleh petugas. Peran Polres Tanjung Balai dalam mencegah peredaran narkotika dari Negara Malaysia ke Indonesia dilakukan dengan dengan dua cara, yaitu upaya penal dan non penal.

Abstract

Pelaksanaan Polmas merupakan bagian dari internal kepolisian pertanggungjawaban pelaksanaan fungsi Polmas di tingkat Polres berada di bawah tanggung jawab dari Kapolres yang dikoordinasikan kepada Kasat Binmas, sedangkan pada tingkat Polsek menjadi tanggung jawab Kapolsek yang dikoordinasikan kepada Kanitbinmas, sedangkan pelaksana Polmas pada tingkat kelurahan adalah Bhabinkamtibmas yang dibentuk dan diangkat oleh Kapolres. Peran Polmas dalam mewujudkan sistem keamanan dan ketertiban di tengah masyarakat adalah melakukan berbagai kegiatan yang berkenaan dengan pelaksanaan fungsi Polmas, diantaranya menyelesaikan permasalahan yang terjadi di tengah masyarakat dengan mencari solusi pemecahan masalah (problem solving) atas masalah-masalah yang dihadapi terkait dengan keamanan dan ketertiban masyarakat. Kendala yang dihadapi dalam pelaksanaan fungsi Polmas diantaranya masih belum adanya kepercayaan masyarakat terhadap institusi Polri.

Abstract

Cases of narcotics trafficking and abuse in recent years have increased rapidly in big cities in Indonesia, including in Binjai City, where the average users are farmers, drivers, students, and school dropouts. The role of prosecutors as one of the important elements in the criminal justice system occupies a very important role in carrying out their duties and authorities in order to carry out law enforcement, namely prosecution in narcotics crime cases in court, so it is important to conduct research on the role of the prosecutor against the actors of narcotics crime category 1 in the Binjai District Prosecutor. This research is normative and descriptive analysis. The legal theory used in this research is the theory of the criminal justice system, law enforcement, and the purpose of the law. The data used is secondary data which can consist of primary legal materials, secondary legal materials, and tertiary legal materials. The data collection technique is library research. Data analysis is qualitative. The Prosecutor's Office as a subsystem of the criminal justice system contained in the current legislation, both in the Criminal Procedure Code and in the Prosecutor's Law No. 16 of 2004, namely as investigators and public prosecutors. Factors that hinder prosecutors in carrying out law enforcement against perpetrators of narcotics crime group I in Binjai City are the facilities or facilities that support law enforcement. Efforts made by the prosecutor in prosecuting the handling of criminal acts of narcotics abuse Category I at the Binjai City Public Prosecutor's Office that have been carried out so far include holding knowledge sharing meetings between fellow law enforcers, conducting management improvements, conducting legal counseling regarding narcotics crimes. In the general public, continuing education of prosecutors, especially narcotics crimes, and the program for prosecutors to enter schools. This activity is to provide counseling to students regarding the dangers and impacts of narcotics use among school children.

Abstract

ABSTRAKDalam penelitian ini, peneliti mengkaji bagaimana nasabah bank yang menyimpan uangnya di bank menggunakan uangnya. Salah satu contoh kasus adalah wanprestasi atas Medium Term Notes yang diterbitkan oleh perusahaan pembiayaan. Kasus ini muncul karena MTN yang diterbitkan gagal bayar meski telah mendapat peringkat bagus dari lembaga pemeringkat, serta audit laporan keuangannya oleh Kantor Akuntan Publik (KAP) ternama. Medium-term note adalah surat utang yang diterbitkan oleh perusahaan. SNP Finance mencapai Rp. Rp 4,07 triliun dari 14 bank sebagai kreditur. Mereka membayar 2,2 triliun dan 336 pemegang MTN senilai Rp. 1,85 triliun. Kasus Bank Sumut, PT MTN yang diterbitkan oleh. SNP dilakukan oleh PT. Bank Sumut Rp. 177 miliar. dan bank lainnya. Adapun permasalahan dalam penelitian ini, antara lain bank mengelola dana nasabah, bagaimana menginvestasikan dana nasabah jika terjadi fraud, dan analisis korupsi dalam investasi MTN dalam Putusan Pengadilan Tipikor. nomor lapangan 42 / Pid.Sus-TPK / 2020 / PN.Mdn. Penelitian ini merupakan penelitian hukum yang dilakukan dengan menerapkan proses analitis ilmiah. Data yang digunakan adalah data sekunder didukung data empiris. Pengumpulan data sekunder dilakukan dengan menggunakan teknik studi pustaka dan alat pengumpulan data berupa studi dokumen. Data empiris dikumpulkan dengan teknik studi lapangan dan data dikumpulkan melalui wawancara mendalam. Analisis data menggunakan metode kualitatif. Kesimpulan ditarik dengan penalaran induktif. Hasil penelitian menunjukkan bahwa: Fungsi bank adalah menghimpun dana dari masyarakat yang kemudian dipinjamkan kembali kepada masyarakat. Meskipun bank berinvestasi dalam Medium Term Notes (MTN) untuk meningkatkan pendapatannya, investasi tersebut penting terkait dengan jumlah MTN yang diterbitkan bank. Peraturan terkait investasi MTN ini sebelum tahun 2019 hanya diatur berdasarkan KUHPerdata dan KUHPerdata, karena hubungan hukum antara MTN dengan penerima MTN bersifat perdata. POJK 30/2019 dirilis setelah kasus MTN mencuat; Jika terjadi penipuan terkait investasi bank dalam medium term notes (MTN), banyak pihak yang harus bertanggung jawab, antara lain: penerbit MTN, bank sebagai penjual produk, Pemeringkat, penjamin/perusahaan asuransi. Terkait dengan Penipuan Medium Term Notes (MTN) Bank.Kata Kunci: Tipikor; Investasi MTN; Bank Sumut.

Abstract

ABSTRAKPenanganan perkara pidana Anak Berkonflik Hukum, baik pada tingkat penyidikan, penuntutan, maupun persidangan ditangani dengan metode yang berbeda-beda. Selain Undang-Undang Sistem Peradilan Pidana Anak, pada tahap persidangan terdapat Peraturan Mahkamah Agung RI No. 04 Tahun 2014 tentang Pedoman Pelaksanaan Diversi Dalam Sistem Peradilan Pidana Anak yang mewajibkan kepada hakim untuk mengupayakan diversi terhadap Anak Berkonflik Hukum. Terdapat kasus yang menarik untuk dikaji dan dianalisisyaitu Putusan Pengadilan Negeri Gunungsitoli No. 05/Pid.Sus-Anak/2016/PN.Gst., dimana anak Berkonflik Hukum dalam kasus tersebut telah memenuhi syarat-syarat untuk diupayakan diversi, ternyata diversi tidak dilakukan. Sehingga permasalahan timbul, antara lain: pengaturan penanganan perkara pidana Anak Berkonflik Hukum berdasarkan peraturan perundang-undangan dan analisis hukum terhadap putusan tersebut.Kata Kunci: Penanganan perkara pidana; Anak Berkonflik Hukum; Putusan Pengadilan.
