Abstract

The re-existence of the TAP MPR has sparked academic interest, but there are still aspects that have gone unnoticed, namely those related to the study of the legislative struggle and why the TAP MPR is included in the types and hierarchy of laws and regulations. The re-existence of the TAP MPR ultimately has legal implications, so it is important to initiate the direction of its content material in the future. Therefore, this paper examines these issues with the aim of enriching the academic space for discussion regarding the re-existence of the TAP MPR. This study was carried out in a juridical-normative manner using a statutory approach and using secondary legal sources in the form of primary legal materials of the 1945 Constitution of the Republic of Indonesia, Law No. 12 of 2011 and UU No. 13 of 2022, minutes on the formation of laws and decisions of the Constitutional Court, and secondary legal materials, which include text books and law journals. This study found that the re-existence of the TAP MPR, apart from being a guideline for establishing a state in Indonesia, is also a direction so that the formation of laws and regulations does not deviate from the basis of the state. As for the future TAP MPR content model, this can be realized through beschickking and regelling. The two models of content material must be guided by strict requirements so that their formation is in line with the principle of conformity between types, hierarchies, and content material of laws and regulations. So it can be concluded that there are still various MPR TAPs that are relevant to be used as guidelines in the state, so it is important to emphasize them in the cluster of laws and regulations. Aside from being a foundation for the state to be in line with the law, it is also a direction so that the formation of the PUU under it does not deviate from the basic direction of the state.

Abstract

Prinsipnya suku Awyu adalah salah satu suku yang mendiami wilayah kabupaten Boven Digoel di Provinsi Papua Selatan. berangkat dari hal tersebut yang kemudian menjadi pemantik dalam mengangkat upaya advokasi yang dilakukan Greenpeace dan pemuda adat Papua dalam memperjuangkan masyarakat suku Awyu bukan tanpa sebab pengadvokasi terhadap kelompok adat minoritas adalah suatu hal yang diperjuangkan.pada hakikatnya negara sudah seharusnya mengakui dan menghormati kesatuan-kesatuan masyarakat adat beserta hak-hak tradisionalnya sepanjang masih hidup sesuai dengan perkembangan masyarakat yang ada,pengakuan dan perlindungan yang mencakup segala aspek tidak terlepas terhadap hutan adat. Konflik Ketimpangan Agraria, ketimpangan struktur penguasaan tanah dan lemahnya perlindungan hukum terhadap masyarakat adat sering menjadi akar konflik agraria.investasi skala besar seperti sawit seringkali berbenturan dengan kepemilikan tanah adat dalam UUPA, UU No. 32 Tahun 2009, UU kehutanan, UU Otsus Papua, serta PERMA No. 1 Tahun 2023 tentang perkara lingkungan hidup. Regulasi terkait Landreform dan perlindungan tanah adat diatur dalam UUPA, UU Otsus Papua, serta PERMA No. 1 Tahun 2023 tentang perkara lingkungan hidup. landreform meningkatkan kesejahteraan petani adalah amanat UU No. 5 Tahun 1960. Redistribusi tanah salah satu program landreform bertujuan meningkatkan kesejahteraan dan menguatkan secara hukum kedudukan petani atas tanah. kepentingan ekonomi dan investasi seringkali mengalahkan perlindungan hak ulayat masyarakat adat dan kelestarian lingkungan. Pemerintah daerah dan pusat lebih mengutamakan penerimaan investasi dan pembangunan ekonomi, sementara perlindungan terhadap hak adat dan keberlanjutan lingkungan menjadi prioritas yang terabaikan. Hal ini menyebabkan deforestasi besar-besaran di wilayah masyarakat adat Awyu seluas 36.000 hektar, ukuran ini sangat besar sehingga mengancam keberlangsungan ekosistem dan juga sumber penghidupan masyarakat sekitar. Keempat, adanya praktik intimidasi terhadap masyarakat adat yang menolak ekspansi sawit.

Abstract

Pada dasarnya masyarakat adat belum dilindungi secara optimal dalam melaksanakan hak pengelolaan yang bersifat individu dan komunal, baik hak atas tanah, wilayah, budaya, dan sumber daya alam yang diperoleh secara turun-temurun, maupun yang diperoleh melalui mekanisme lain yang sah menurut hukum adat setempat. Dengan belum optimalnya pengakuan dan perlindungan hak Masyarakat Hukum Adat yang bersifat individu dan/atau komunal mengakibatkan tidak tercapainya kesejahteraan bagi Masyarakat Hukum Adat dan munculnya conflict. Arus globalisasi yang sangat signifikan terbukti secara perlahan-lahan telah mereduksi nilai-nilai yang diajarkan dalam kearifan lokal. Kearifan lokal dalam sistem budaya di Indonesia tercermin dalam keberagaman agama, keberagaman suku/ etnis, keberagaman bahasa. Terdapat lebih dari 250 suku bangsa, dengan mayoritas penduduk adalah suku Jawa. bahwa sebanyak 71,8 persen desa di Indonesia memiliki komposisi warga dari beberapa suku/etnis. Hal ini menunjukkan bahwa keragaman etnis pada desa-desa di Indonesia cukup tinggi. Pada prinsipnya penulisan jurnal ini menggunakan metode yuridis normative empiris, karena secara normatif kepastian  hukum  itu  memerlukan  tersedianya suatu  perangkat  peraturan  perundang-undangan  yang  secara  operasional mampu mendukung pelaksanaan dan pengakuan terhadap keberadaan hukum adat tersebut

Abstract

This article examines the agrarian conflict between the Indigenous Awyu people in South Papua and PT Indo Asiana Lestari (IAL) within the framework of Indonesia’s land reform policy. The study highlights the weak protection of customary land rights (hak ulayat) and the violation of the Free, Prior, and Informed Consent (FPIC) principle during the granting of environmental permits and palm oil plantation concessions covering 36,000 hectares of Awyu customary forests. Using a normative juridical approach combined with case study analysis, this research reviews relevant agrarian, forestry, environmental, and Papua Special Autonomy laws. The findings reveal manipulative practices in Environmental Impact Assessment (AMDAL) documentation, overlapping institutional authorities, and the dominance of economic interests over the protection of Indigenous rights and environmental sustainability. This conflict reflects structural inequality in land reform implementation and indicates the urgent need for agrarian policy reform that positions Indigenous peoples as primary decision-makers, alongside strengthening oversight mechanisms to prevent future violations of customary land rights.

Abstract

This article examines the legal consequences of land ownership rights for heirs born from mixed marriages between Indonesian citizens and foreign nationals within the framework of Indonesia’s positive law. The study focuses on the issue of limited dual citizenship held by children from mixed marriages and its implications for inherited land ownership. According to the Basic Agrarian Law No. 5 of 1960, land ownership rights can only be held by Indonesian citizens; thus, a child who opts for foreign citizenship must relinquish such rights within a specified period. This research explores the overlap between agrarian law, citizenship law, and inheritance law, and compares it with Australia’s more flexible legal approach to foreign land ownership. Findings reveal that while Indonesia’s nationality-based land ownership restrictions aim to safeguard agrarian sovereignty, they may result in legal inequities for children of mixed marriages. The study recommends regulatory reform to provide legal certainty and protect inheritance rights without undermining the principle of nationalism.
