Abstract

Pembaharuan hukum dibutuhkan setiap waktu untuk melengkapi dan mengisi kekosongan hukum terhadap masalah yang terjadi di masyarakat. Undang-undang sebagai instrument hukum membutuhkan pembaharuan dan perubahan, namun kendalanya adalah prosesnya yang sedemikian Panjang membuat pembaharuan dan pembuatan undang-undang kadang tidak mampu mengisi kekosongan hukum yang terjadi di masyarakat. Penelitian ini membahas mengenai: Bagaimana urgensitas carry over dalam proses pembuatan undang-undang di Indonesia? Bagaimana perspektif siyasah syar'iyyah terhadap proses pembuatan undang-undang di Indonesia?. Jenis penelitian yang digunakan yaitu pustaka. Adapun pendekatan penelitian ini yaitu pendekatan syar'I dan undang-undang. Sumber data primer berupa peraturan perundang-undangan yang berkaitan dengan penelitian, serta sumber data sekunder berupa jurnal hukum dan buku fiqih. Hasil penelitian ini menunjukkan dalam dinamika pembentukan undang-undang di Indonesia hanya dua kali mengalami masa dimana produk hukum yang dihasilkan bersifat responsif (masa awal kemerdekaan dan reformasi). proses pembuatan undang-undang di Indonesia berjalan selaras dengan prinsip inferensi. Yakni metode pembuatan undang-undang dengan memahami prinsip-prinsip syari'ah dan kehendah syar’i dari berbagai sumber yang ada utamanya al-Qur’an dan Hadist. Abstract

The Constitutional Court as the guardian of the constitution has a central role in a constitutional-democratic state. This study aims to reveal the extent of the development of the authority of the Constitutional Court in the constitutional system using a normative juridical approach. The results showed that the Constitutional Court experienced a "growth" of authority born from interpretations as an effort to renew and complement its constitutional authority. There are some powers that are not explicitly attributed to the 1945 NRI Constitution, but in practice, judges of the Constitutional Court interpret them to legitimize the basis of their authority. as in Perppu testing (formal and material), settlement of authority disputes between state institutions whose authority is delegative and settlement of disputes over regional head elections. The move confirms the inclusiveness of Constitutional Court judges on the dynamics of developments and legal needs in resolving every constitutional issue even though it is not stipulated in the Constitution and also as an effort and commitment to protect the constitutional rights of citizens.

Abstract

The design of simultaneous national regional elections in 2024 has led to a vacancy in the position of regional head, to anticipate this, the government appoints an acting regional head to carry out the duties, functions, and authorities of the regional head until the inauguration of the definitive regional head. This research aims to analyze the application of democratic principles in the appointment of acting regional heads by using conceptual and statutory approaches. The process of appointing acting governors by the president and acting regents and mayors by the Minister of Home Affairs has ignored several fundamental principles such as the principle of free elections, equal political participation, accountability and transparency, protection of human rights (political rights), and the principle of placing officials with a merit system instead of a spoil system. The Constitutional Court in Decision Number 67/PUU-XIX/2021 has emphasized that the process of appointing acting regional heads must still be carried out democratically. The filling of acting regional heads also lacks strong social legitimacy because it does not involve active participation from the community.

Abstract

The existence and position of the Judicial Commission has added to the list of independent state institutions (state auxiliary institutions) in the Indonesian state structure. The existence of the Judicial Commission in monitoring and enforcing the code of ethics for constitutional judges within the structure of the Honorary Council of the Constitutional Court has undergone a long discussion. For this reason, this research is normative research which aims to determine the legal position of the Judicial Commission in enforcing the judge's code of ethics and the ups and downs of the Judicial Commission's authority in the structure of the Honorary Council of the Constitutional Court. The results of the research show that the efficiency of the Judicial Commission's supervisory function actually strives for judges' compliance with the code of ethics and behavioral guidelines for judges in order to create public trust in judicial institutions in Indonesia, while the presence of the Judicial Commission in the supervision dimension of Constitutional Judges experiences a tug-of-war regarding the norms of Law Number 22 of 2004 concerning Judicial Commissions with material review in Decision 005/PUU-IV/2006, Law Law No. 8 of 2011 with a material review in the Constitutional Court decision no. 49/PUU-IX/2011, Law no. 4 of 2014 concerning Stipulation of Government Regulations in Lieu of Law no. 1 of 2013 concerning the Second Amendment to Law No. 24 of 2003 with material review in Decision No. 1-2/PUU-XII/2014 and Law No. 7 of 2020 with a material review in decision No, 56/PUU-XX/2022. Therefore, the institutional structure of the Judicial Commission in the Honorary Council of the Constitutional Court underwent several repositionings until it was finally judged as a form of legal contravention and unconstitutional (contrary to the 1945 Constitution).
