Abstract

The Quick Response Code Indonesian Standard (QRIS) is a QR code-based payment system that integrates various codes from different payment service providers, enabling micro, small, and medium enterprises (MSMEs) to conduct transactions using a single code. This study aims to analyze the practice of adding fees to sales transactions using QRIS from the perspectives of Indonesian Positive Law and Sharia Economic Law. The research employs a qualitative method with a literature review approach, drawing on books, journals, scholarly works, and other relevant sources. The analysis examines the concept of ijarah as a contract for the use of services—either as rent for the benefit of goods or wages for labor—and the legal provisions for additional charges in non-cash transactions. The findings indicate that, from the perspective of Sharia Economic Law, additional fees are permissible if they meet the principles of fairness, transparency, and compliance with Sharia, as service providers are entitled to compensation for the services rendered. Meanwhile, under Indonesian Positive Law, such practices must adhere to consumer protection regulations and cost transparency requirements. Therefore, additional fees in QRIS transactions can be deemed acceptable as long as they comply with the legal principles of both systems.

Abstract

Pariwisata merupakan salah satu penggerak utama pertumbuhan ekonomi Jepang, dengan kontribusi signifikan terhadap Produk Domestik Bruto (PDB) nasional. Seiring meningkatnya jumlah wisatawan Muslim di seluruh dunia, Pemerintah Metropolitan Tokyo secara aktif mendorong pengembangan wisata halal guna mengakomodasi kebutuhan pengunjung Muslim internasional. Pemerintah daerah menyadari potensi ekonomi dan budaya dari segmen ini, sehingga melaksanakan berbagai inisiatif strategis untuk menarik wisatawan Muslim.Penelitian ini bertujuan untuk menganalisis kebijakan pemerintah Jepang—khususnya di Tokyo—dalam implementasi Tourism Nation Promotion Basic Law tahun 2007 yang berkaitan dengan wisata halal, serta mengidentifikasi langkah kebijakan konkret yang diambil oleh Pemerintah Metropolitan Tokyo. penelitian yang digunakan adalah deskriptif kualitatif, dengan teknik pengumpulan data melalui studi literatur, analisis dokumen, artikel ilmiah, dan publikasi resmi dari lembaga pariwisata Jepang. penelitian menunjukkan bahwa pemerintah, khususnya di tingkat metropolitan, berperan aktif dalam pengembangan wisata halal melalui kebijakan seperti sistem sertifikasi halal, penyediaan fasilitas ibadah, promosi destinasi ramah Muslim, serta pelatihan bagi pelaku industri pariwisata. Meskipun terdapat sejumlah tantangan, langkah-langkah tersebut menunjukkan komitmen kuat pemerintah dalam menciptakan lingkungan pariwisata yang inklusif dan ramah terhadap wisatawan Muslim. Penelitian ini memberikan wawasan penting mengenai pentingnya integrasi nilai-nilai halal dalam pengembangan pariwisata global.

Abstract

This study aims to analyze the status of the People’s Tribunal within the context of land dispute resolution in the Dago Elos community. This study uses a normative legal research method. The collected legal material is then qualitatively analyzed to describe the problem and answer the study objectives. The results show that despite lacking legally binding power, the People’s Tribunal plays a crucial role in fighting for justice and giving a voice to communities who feel their rights have been neglected by the formal judicial system. In the context of the Dago Elos land dispute, the People’s Tribunal serves as a platform for the community to articulate their dissatisfaction with court decisions perceived as unjust, and to fight for recognition of their rights to land and natural resources. The People’s Tribunal also symbolizes resistance against the legacy of colonialism and encourages more responsive legal reforms. Therefore, it is recommended that law enforcement agencies consider the People’s Tribunal’s verdict as valuable input in the law enforcement process, especially in cases involving structural injustice and human rights violations. The government needs to be more responsive to the aspirations of the community and strive for agrarian legal reforms that are more just, by recognizing and protecting the rights of local communities to land and natural resources. The community is advised to continue to strengthen the role of the People’s Tribunal as an alternative means of dispute resolution and upholding justice. In addition, the community is expected to participate in the decision-making process and oversee public policies related to the management of land and natural resources to ensure that these policies benefit the wider community and are sustainable.
