Abstract

Ibn Hajar al-Haytami (d. 974 AH/1567 CE) gave his own color and demonstrated the development of ru'yah al-hilāl in Islamic civilization. As an important part of determining the beginning of Ramadan for the obligation to fast, Ibn Hajar al-Haytami was of the view that the results of ru'yah al-hilāl that utilized tools such as glass could not be accepted or used as guidelines for determining the beginning of the lunar month. This view contradicts the work of science that prioritizes and produces observation aids to maintain precision and reduce human error when observing celestial objects. With a historical and hermeneutic approach, this paper seeks to reveal the historical background of Ibn Hajar al-Haytami 's view regarding ru'yah al-hilāl. The findings of this paper are that Ibn Hajar al-Haytami's opinion is in line with and influenced by the decline of scientific civilization in Islam in the 10th century AH. At that time, especially in the Ottoman Turkish region, philosophy as the basis for the development of science was rejected and/or ignored in the scientific treasures of Islamic civilization.

Abstract

Research problems and objectives – The phenomenon of sirri marriage or unregistered marriage is still rampant in Indonesia and its legality is still debated. Whereas marriage registration is intended to provide a guarantee of legal certainty for each individual in the family. In practice in the community, sirri marriages are caused by complex factors that form an interesting contemporary social construction to be studied from the perspective of Islamic family law. Purpose and Research methods - This study aims to socially examine the issue of sirri marriage in relation to state legal guarantees and benefits in contemporary Islamic family law. Using a qualitative research method with a normative-sociological approach, this study investigates the causal factors, social and legal implications of sirri marriages from the perspective of Emile Durkheim's Social Theory. Findings - The result of the research is a complex interaction between legal norms and community values in sirri marriage. Sirri marriages in contemporary Islamic family law studies, although often positioned as deviations from formal legal provisions, persist as socially accepted practices within specific cultural and religious contexts. Durkheim's concept of collective consciousness helps explain how societal norms and shared beliefs influence the legitimization of sirri marriages, even in the absence of state recognition. This phenomenon highlights the tension between formal legal frameworks and traditional social practices, underscoring the importance of understanding local values and social structures when addressing issues of legal pluralism. Research recommendations/contributions - This research underscores the need for public education on the importance of marriage registration as a bridge between religious principles and state regulations. The study's contribution lies in offering an integrative perspective that highlights the necessity of harmonizing religious norms with legal recognition to strengthen the protection of family rights within the legal framework of the state. Originality/value - Ultimately, this analysis advocates for a more nuanced and culturally sensitive approach to harmonizing legal regulations with the socio-religious realities of Indonesia's diverse society.

Abstract

Artikel ini membahas ambivalensi atau ketidakpastian hukum nikah sirri di Indonesia. Ketidakpastian ini diakibatkan oleh kontradiksi yang muncul karena adanya perbedaan pandangan antara hukum adat, agama, dan hukum nasional. Kondisi ini ternyata berbanding lurus dengan kondisi psikologis para pelaku nikah sirri. Sehingga dalam konteks ini terdapat ruang atau ada kebutuhan untuk menyelaraskan hukum adat, agama, dan hukum nasional dalam hal perkawinan. Metode pengumpulan data diambil dari data primer berupa wawancara dengan masyarakat pelaku nikah sirri dan tokoh agama di Kabupaten Lumajang Jawa Timur. Data tersebut kemudian dianalisa dengan menggunakan pendekatan normatif-psikologis baik dalam konteks hukum Islam dan hukum positif. Hasil pembahasan ini menunjukkan bahwa pertama; terdapat aturan yang bersifat ambivalen dimana dalam penerapannya masyarakat menjadi bingung sehingga berpotensi terjadinya banyak pelanggaran. Kedua terdapat banyak faktor yang mempengaruhi ambivalensi nikah sirri yakni faktor keterbatasan masyarakat dalam mengakses informasi dan kesadaran akan hak dan kewajiban dalam pernikahan. Ketiga adalah implikasi ambivalensi sangat berpengaruh kepada aspek psikis pelaku nikah sirri sehingga berpotensi menghambat efektivitas aturan hukum nikah sirri, yang mengakibatkan terjadinya pelanggaran administratif. (This article examines the legal ambiguity surrounding unregistered marriages in Indonesia. This condition stems from the contradictions between customary law, religious law, and national law, resulting in uncertainty and inconsistencies in its legal treatment. The psychological well-being of individuals involved in unregistered marriages is directly correlated with the existing legal ambiguity. Consequently, there is a pressing need to reconcile customary, religious, and national laws pertaining to marriage to address this issue. This study utilizes a qualitative research methodology, collecting primary data through in-depth interviews with individuals who have engaged in unregistered marriages and prominent religious figures in Lumajang Regency, East Java. The data is subsequently analyzed using a normative-psychological framework, integrating both Islamic jurisprudence and positive law perspectives. The results of this analysis reveal three key findings. Firstly, the existence of ambivalent regulations leads to confusion among the community, thereby increasing the likelihood of non-compliance. Secondly, the ambivalence surrounding unregistered marriages is influenced by various factors, including limited access to information and a lack of awareness about marital rights and obligations. Thirdly, the psychological implications of this ambivalence are substantial, affecting the mental well-being of individuals involved and potentially undermining the efficacy of legal frameworks governing unregistered marriages, which may lead to administrative infractions).

Abstract

This paper explores the Maulid Tradition within the socio-cultural context of urban society, focusing on the city of Semarang. The Maulid Tradition not only reflects religious spirituality but also has significant social and political implications. This research employs a field study method to analyze the Maulid celebrations across various mosque communities in Semarang. The findings indicate that these celebrations serve as a medium for strengthening community identity and social interaction, as well as creating a space for discussing relevant social issues. Furthermore, the Maulid Tradition plays a role in social mobilization and reinforces identity politics within a multicultural society. With the dynamics of tradition, transition, and innovation, communities are able to interpret the Maulid Tradition in a modern context, fostering collective awareness and cooperation, as well as promoting interfaith tolerance. The conclusion of this study emphasizes that, despite differing views on the Maulid celebrations, this tradition remains an important means to strengthen the identity and solidarity of the Muslim community in Semarang.
