Abstract

Data di Pengadilan Agama Kayuagung menunjukkan minimnya perkara perceraian yang berakhir mencabut gugatannya lalu hidup rukun kembali, bahkan jika dipersentasekan dalam 3 tahun terakhir hanya 6,5% saja perkara perceraian yang berakhir mencabut gugatannya dari total keseluruhan perkara. Penelitian ini bertujuan untuk mengetahui apa saja upaya rekonsiliasi dan faktor pendukung serta faktor penghambat dari rekonsiliasi di Pengadilan Agama Kelas 1B Kayuagung. Jenis penelitian ini adalah empiris normatif atau penelitian studi lapangan (field research), dengan menggunakan sumber data primer langsung dari narasumber, observasi, dokumentasi dan wawancara, untuk sumber data sekunder yang bersumber dari tulisan seperti Al- Qur’an, Hadis, Undang- Undang, buku, jurnal maupun artikel. Teknik analisis data yang digunakan ialah dengan metode deskriptif kualitatif. Hasil penelitian ini menunjukkan bahwa upaya rekonsiliasi pada perkara perceraian di pengadilan agama kayuagung, yaitu : 1) Upaya perdamaian dari hakim; 2) Mediasi; 3) Pemaafan. Adapun faktor pendukungnya yaitu : 1) Kembalinya kesadaran dari para pihak mengenai perdamaian dan tujuan perkawinan; 2) Kepiawaian mediator dalam mengungkap inti permasalahan diantara para pihak; 3) Masih adanya rasa saling menyayangi diantara para pihak; 4) Para pihak yang berperkara masih memikirkan masa depan anak; 5) Para pihak yang berperkara sudah saling memaafkan dan hidup rukun kembali; 6) Dukungan dari pihak keluarga. Sedangkan faktor penghambatnya adalah : 1) Kurangnya pemahaman para pihak akan tujuan perkawinan dan pentingnya perdamaian; 2) Hati para pihak yang sudah terkunci; 3) Ketidakhadiran pihak tergugat; 4) Pihak ketiga; 5) Egois. Kata Kunci : Rekonsiliasi; Perceraian; Pengadilan Agama

Abstract

Rukun Islam yang kedua yaitu sholat, salah satu syarat sahnya sholat adalah menghadap ke arah kiblat. Bagi orang-orang berada di Mekah dan sekitarnya perintah yang demikian ini tidak menjadi suatu permasalahan karena dengan mudah dapat melaksanakan perintah tersebut, namun bagi orang-orang yang jauh dari Mekah tentu timbul permasalahan tersendiri. Arah kiblat yang menyimpang beberapa derajat saja, maka akan berakibat melenceng secara signifikan arah kiblat dari yang seharusnya tepat menuju Mekah (Ka’bah) menjadi ke arah lain yang bukan Mekah (Ka’bah). Hal ini tentu akan mengurangi kemantapan dalam melaksanakan ibadah, utamanya adalah keyakinan akan sah atau tidaknya salat yang dikerjakan. Observasi awal kami mengenai arah kiblat di Masjid Istiqlal Desa Ibul Besar III Pemulutan ogan ilir ini mengalami penyimpangan beberapa derajat ketika di Uji dengan Kompas Biasa, oleh karena itu peneliti tertarik untuk meneliti bagaimana Riwayat Penentuan arah Kiblat di Masjid Istiqlal Desa Ibul Besar III, Kecamatan Pemulutan, Kabupaten Ogan Ilir? bagaimana ketepatan arah kiblatMasjid Istiqlal Desa Ibul Besar III, Kecamatan Pemulutan, Kabupaten Ogan Ilir.

Abstract

In this all-digital era, the use of Android devices is no longer just a medium for communication, but on your smartphone device, there are already many applications circulating on the Play store developed by software companies and astronomers that are easy to use to assist you in determining. qibla direction. To fulfill the need for information on the Qibla direction of a place, you have to activate the technology on your smartphone that provides real-world Qibla direction information, namely by using the miqat application. This research is to find out the method of using the miqat application in determining the Qibla direction and knowing how the Qibla direction of the Sultan Mahmud Badarudin Jayo Wikramo mosque and Al-Islam Muhammad Cheng Ho Mosque is using the Miqat application. This research is classified as field research, namely research conducted by direct observation of the object studied in the field, aiming to determine the level of accuracy of the use of the miqat application in determining the Qibla direction. The use of the Miqat application in determining the Qibla direction is a method that is very easy to use wherever you are, but before using the application, it is better if you first calibrate the magnetic compass on your smartphone by shaking the phone so that the needle on the compass is stable. The accuracy of the Qibla direction of the Sultan Mahmud Badarudin Jayo Wikramo Mosque and the Al-Islam Muhammad Cheng Ho Mosque with the Miqat application, that in terms of whether or not this application is accurate, in principle, depends on usage. If used in places that contain metal it will make the magnetic sensor on the compass inaccurate which results in degree deviations on the compass being affected by the magnetic field and the metal around it which will result in a larger deviation of degrees on the compass, this application should be used outside the building because in principle, the compass on the cellular relies on magnetic sensors and GPS on the smartphone itself.

Abstract

The purpose of the research is to find out the implementation of kekampi customs and a review of Islamic family law on kekampi customs in the village. The method used in this study is field research or qualitative (field research) collecting data directly dealing with the phenomena that occur data, namely by interview and documentation. Data analysis techniques use descriptive analysis by presenting the results of interviews and drawing conclusions deductively. The results of the study obtained are that the practice of the kekampi custom consists of several stages, namely the first is the arrival of the prospective groom, the second is the arrival of the prospective groom with his family, the third is the arrival of the woman's family to the groom's house, the fourth is gathering the family, the fifth is the cooking event and the arrival of residents, the sixth is the marriage contract, the seventh is the reception. And the legal consequences of the agreement between the two parties who carry out the kekampi custom are regarding property, residence, inheritance, and the position of the man. Therefore, Islamic law states that the marriage of kekampi custom is a custom that is not prohibited in Islamic law, but looking at the incompatibility of the legal consequences of kekampi custom, it is not in accordance with Islamic law. For this reason, kekampi custom marriage can be said to be corrupt because kekampi custom is a customary custom in which there are legal consequences in terms of property, inheritance and the position of the man that is not in line with Shari'ah.

Abstract

This study examines the legal issue of fathers deliberately neglecting child support obligations following divorce, despite existing court rulings mandating such support. The research aims to analyze the criminal liability of fathers who intentionally disregard post-divorce child support obligations and to assess this issue within the context of national and Islamic law. This study employs a normative juridical method with a descriptive qualitative approach. The findings reveal that fathers who intentionally fail to provide child support after divorce can be classified as committing child neglect, which constitutes a criminal offense under Indonesian law, specifically the Child Protection Law No. 35 of 2014 and the Criminal Code, with potential penalties of up to five years' imprisonment or fines. From the perspective of Islamic law, a father’s obligation to support his child remains intact regardless of marital status, as stipulated in the Qur'an and the Compilation of Islamic Law. This research highlights that protecting children’s rights is a fundamental responsibility of the state, family, and society, which must be enforced firmly through civil and criminal measures to create a deterrent effect for fathers who neglect their obligations. Consistent and integrated legal enforcement is essential to ensure that children receive their rightful support, enabling them to grow and develop properly while preventing psychological and social harm resulting from the father's deliberate neglect after divorce. These findings call upon legal practitioners, policymakers, and community leaders to strengthen enforcement frameworks, foster legal awareness among fathers, and uphold children’s welfare as a priority within post-divorce family structures.
