Abstract

ABSTRAK Kedudukan hak pengelolaan dalam hukum tanah nasional dirasa belum memberikan kepastian hukum. Hal tersebut tidak terlepas dari pengaturannya yang belum memberikan kepastian hukum khususnya pengaturan mengenai subjek dan kewenangan hak pengelolaan. Dengan berlakunya UU Nomor 11 Tahun 2020 yang turut pula mengatur tentang hak pengelolaan, perlu ditinjau sejauh mana Undang-Undang tersebut memberikan solusi terhadap permasalahan yang berkenaan dengan hak pengelolaan, khususnya berkenaan dengan objek tanah yang merupakan hak pengelolaan sekaligus juga dikategorikan sebagai Barang Milik Negara/Daerah. Metode penelitian yang digunakan adalah yuridis normatif. Hasil penelitian menunjukan UU Nomor 11 Tahun 2020 mempertegas kedudukan hak pengelolaan sebagai hak menguasai negara dan akibat hukum dari pengaturan hak pengelolaan dalam UU Nomor 11 Tahun 2020 terhadap kepemilikan barang milik negara/daerah adalah tidak akan ada dualisme pengaturan terhadap satu objek tanah yang menyangkut hak pengelolaan dan barang milik negara/daerah berupa tanah. Kata kunci: Hak Pengelolaan ; Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja ; Barang Milik Negara/Daerah. ABSTRACT The position of management rights in national land law does not provide legal certainty. this is inseparable from the regulation which does not provide legal certainty, especially the regulation regarding the subject and purpose of management rights. With the enactment of Law Number 11 of 2020 which also regulates management rights, it is necessary to review the extent to which the law provides solutions to problems related to management rights, especially with regard to land objects which are management rights and are also categorized as State/Regional Property. The research method used is normative juridical. The results of the study show that Law Number 11 of 2020 emphasizes the position of management rights as rights to control the state and the legal consequences of regulating management rights in Law Number 11 of 2020 on state/regional property ownership is that there will be no dualism in the regulation of one land object concerning management rights. and state/regional property in the form of land. Abstract

The President of the Republic Indonesia announced the capital’s relocation to East Kalimantan, potentially impacting indigenous communities by threatening their land rights, forests, cultural identity, and traditional rights. The objective of this research is to understand the implementation of land acquisition in the new capital city concerning indigenous land ownership and to analyze the legal protection provided for indigenous communities whose land is used for the capital city’s development. The research method used is normative juridical, employing a descriptive-analytical approach. The research stages involve library research, with data collection conducted through document studies and the review of secondary data relevant to the issues studied. This library research was undertaken to gather primary, secondary, and tertiary legal materials. The data analysis method employed is qualitative juridical analysis. The findings of this study indicate, Land acquisition for the new capital city faces significant challenges in respecting the rights of indigenous communities, despite being legally recognized. In practice, it has not met social aspects, fair compensation, and legal protection. The participation of indigenous communities, such as the Balik Paser Tribe, has been ineffective, and post-dispute compensation is often delayed and insufficient. The legal void regarding compensation for customary land worsens legal uncertainty, potentially violating indigenous rights. A more inclusive, transparent, and fair mechanism is needed to protect their rights.

Abstract

ABSTRAKTujuan penelitian ini adalah untuk mendapatkan pemahaman mengenai penerapan asas terang dan tunai dalam pembuatan akta jual beli tanah waris yang belum dibagi dihadapan Pejabat Pembuat Akta Tanah. Peralihan hak atas tanah melalui jual beli di Indonesia turut tunduk pada asas terang dan tunai yang ada pada hukum adat. Pada saat ini jual beli yang obyeknya berupa tanah waris, beberapa menimbulkan permasalahan yang dapat merugikan pihak tertentu. Metode penelitian yang digunakan adalah metode pendekatan yuridis normatif. Dari hasil penelitian disimpulkan bahwa penerapan asas terang dan tunai dalam pembuatan akta jual beli tanah waris yang belum dibagi dihadapan PPAT telah disesuaikan dengan peraturan perundang-undangan yang berlaku. Sehingga dalam melakukan perbuatan hukum jual beli yang objeknya berupa tanah waris, harus melibatkan seluruh ahli waris untuk memberikan persetujuan dengan hadir dihadapan PPAT dan turut menandatangani akta jual beli. Kata Kunci : Asas, Terang dan Tunai, Tanah. AbstractThe purpose of this research is to gain an understanding of the application of the clear and cash principles in making deeds of sale and purchase of inherited land that has not been divided before the Land Deed Official. The transfer of land rights through buying and selling in Indonesia is also subject to the principles of clear and cash existing in customary law. Currently, buying and selling where the object is inherited land, some of it causes problems that can be detrimental to certain parties. The research method used is a normative juridical approach. From the research results, it was concluded that the application of the clear and cash principles in making deeds of sale and purchase of inherited land that has not been divided before the PPAT has been adjusted to the applicable laws and regulations. So, when carrying out legal acts of sale and purchase whose object is inherited land, all heirs must be involved in giving their consent by appearing before the PPAT and participating in signing the sale and purchase deed. Keywords: Principle, Light and Cash, Land.
