Abstract

This study conducted a legal review of Government Regulation Number 24 of 2018 as the forerunner to the formation of OSS. Aims to analyze the elements of justice, legal certainty and legal expediency in accordance with the objectives of the formation of law. This research is a normative juridical research with the technique of collecting material from the literature consisting of primary and secondary legal materials. The results show that the application and enactment of OSS on the basis of Government Regulation Number 24 of 2018 concerning Electronically Integrated Business Licensing Services is not in accordance with legal objectives. This is due to the absence of a transition period in the enactment of the regulations and provides an opportunity for the community and / or business actors to learn and adapt to a system that is completely new in the world of business licensing.

Abstract

The United Arab Emirates (UAE) and Israel have signed a normalization agreement called Abraham Accord on September 15, 2020. This agreement indicates that previously both countries had a reasonably good relationship and a series of cooperation. This study aims to see the UAE's interests toward Israel and how other Muslim countries respond to the agreement, which will impact their solidarity for Palestine's independence. In this research, the writer uses realism perspective, which includes the concept of national interest, the theory of balance of power, and the concept of normalization. The results showed that the UAE has an interest in expanding cooperation with Israel in various fields, especially in the political, economic, and security. The UAE made this policy because they feel threatened by Iran and because of the COVID-19 pandemic. This policy received positive response from Egypt, Jordan, Bahrain, and Sudan; and negative feedbacks from Oman, Iran, Turkey, and Qatar. Especially for Palestine itself, this agreement is a severe blow to the country's sovereignty struggle.

Abstract

The global markets for crucial COVID-19 products (medical supplies) are highly concentrated. Most of developing countries are highly dependent on imports for these products. However, majority of countries implemented the export controls and bans on medical supplies due to the limitation of resources they have. This research examines the Southeast Asian policy on medical supplies export controls and bans in response to the COVID-19 Pandemic and its justification for export restrictions based on Article XI paragraph (2), Article XX, and Article XXI GATT 1994. The research methods are based on qualitative methods and normative juridical research methods. This research uses secondary data from journals, books, official documents, and websites related to the Southeast Asian Government policy on export. The results show that the justification for the export ban and restriction on medical equipment can be exempted by referring to Article XX regarding general exceptions and regarding security exceptions in Article XXI (b) (iii). Most of the Southeast Asian countries tried to follow the provisions of GATT 1994 and its reflection to be a good international citizen by compliance the international law.

Abstract

This paper analyzes the determinants of economic growth acceleration in Indonesia, Thailand, and Vietnam. It aims to reveal Thailand's plausible explanations and Vietnam's development success compared to Indonesia during the COVID-19 pandemic. This research provides an in-depth study parallel to a case study by using comparable variables. It examines six determinants: natural resources, investment, population growth, social-culture, human resources, and political. The evidence exhibits Vietnam has better conditions in all determinants compare to Indonesia and Thailand. Lessons learned from its development experiences could improve Vietnam's successful strategy with previous outbreaks to impact the current economic development.
