Abstract

The implementation of GCG is important for companies to carry out careful phasing based on an analysis of the situation and condition of the company, and the level of readiness, so that GCG implementation can run smoothly and get support from all elements within the company. As a step to improve performance, efficiency and professionalism, then emerged a principle that is believed to encourage an increase in the performance of the company, this principle is the principle of Good Corporate Governance (GCG). GCG is defined as a system that regulates and controls a company to create value added for all stakeholders, including in its application to State-Owned Enterprises (SOEs). The obstacles that often prevent SOEs from functioning economically are the government itself and the poor quality of human resources and a corporate culture that tends to be KKN. To avoid greater losses, it is necessary to change the management of SOEs. In terms of legal material, legal structure and legal culture as well as problems arising from its implementation by presenting a new SOEs law using the principles of GCG. This study employs normative legal research using qualitative juridical analysis methods. The role of State-Owned Enterprises in the national economy in realizing people's welfare is not optimal. SOEs plays a role in producing the goods and or services needed in order to realize the greatest prosperity of the community.

Abstract

ABSTRAKTujuan dari penelitian ini adalah Menganalisis Implementasi Pengelolaan Keuangan Desa menurut Undang-Undang Nomor 6 tahun 2014; Mengetahui hambatan dalam mewujudkan transparansi pengelolaan keuangan desa di Kabupaten Bone Bolango; Menciptakan Model Pengawasan yang ideal dalam mewujudkan transparansi Pengelolaan Keuangan Desa di Kabupaten Bone Bolango. Penelitian ini menggunakan jenis Penelitian hukum empiris. Penelitian hukum empris atau dengan istilah lain biasa disebut penelitian hukum sosiologis atau disebut pula penelitian lapangan. Pendekatan yang dugunakan dalam penelitian ini adalah pendekatan Undang-undang (statute Approach); Pendekatan kasus (Case Approach); dan Pendekatan Konseptual (Conceptual Approach). Hasil Penelitian ini menunjukkan: Pertama, bahwa Implementasi pengelolaan keuangan desa yang sebagaimana diamanatkan oleh UU Tentang Desa dan Permendagri 20 Tahun 2018 tentang pengelolaan keuangan desa. Dalam tahap perencanaan, sebagian dari Desa yang diteliti secara prosedur sudah sesuai dengan peraturan, namun secara target waktu tidak sesuai dengan peraturan. Dalam tahap pelaksanaan pada desa yang diteliti, secara prosedur sebagian sudah sesuai peraturan meskipun tuntutan terhadap pemerintah desa untuk mewujudkan transparansi belum maksimal. Dalam tahap penatausahaan dan Tahap pelaporan pada desa yang diteliti dapat dikatakan sudah sesuai aturan walaupun subtansi terhadap penatausahan belum sempurna kemudian dapat sebagian desa dikatakan sudah tepat waktu dan sesuai dengan peraturan. Kedua, Hambatan dalam mewujudkan transparansi dalam pengelolaan keuangan desa di lokasi desa yang diteliti dapat disimpulkan adalah keterbatasan pemahaman perangkat Desa terhadap Regulasi, faktor ketersediaan Sumberdaya manusia (SDM) , Partisipasi Masyarakat dan serta faktor pengawasan. Ketiga, bahwa Untuk mewujudakan Model Pengawasan yang ideal terhadap pengelolaan keuangan desa, peneliti merekomendasikan Model Pengawasan berbasis masyarakat (Community Based Monitoring) dimana lebih memperkuat keterlibatan masyarakat desa didalam pelaksanaan pembangunan desa, tidak hanya dari aspek perencanaan dan pelaksanaan, tetapi juga adalah keterlibatan dalam pengawasan.Kata Kunci: Transparansi; Keuangan Desa; Pengawasan berbasis masyarakaABSTRACTThe purpose of this study is to Analyze the Implementation of Village Financial Management according to Law Number 6 of 2014; Knowing the obstacles in realizing transparency in village financial management in Bone Bolango Regency; Creating an ideal Oversight Model in realizing transparency in Village Financial Management in Bone Bolango Regency. In the administration stage and the reporting stage in the villages studied it can be said to be in accordance with the rules even though the substance of the administration is not yet perfect then some villages can be said to be on time and in accordance with the regulations. Second, the obstacles in realizing transparency in the management of village finances at the location of the village under study can be concluded is the limited understanding of the Village apparatus on Regulation, the availability of human resources (HR), Community Participation and as well as supervision factors. Third, that in order to create an ideal Oversight Model for village financial management, researchers recommend a Community Based Monitoring Model which further strengthens the involvement of rural communities in the implementation of village development, not only from the planning and implementation aspects, but also is an involvement in supervision .Keywords: Transparency; Village Finance; Community-based supervision.

Abstract

Life in Indonesia does not recognize Samenleven's relationship because the rules of law and religion do not justify it, but there are still many things like that in Bajo Village. Bajo customary law includes the Bajo Customary Institution. In this institution, its existence helps the village government develop and regulate matters relating to local customs and solving problems regarding adultery, namely Samen Leven. This paper describes how customary law can be used as a law enforcement instrument to resolve the Samenleven offense. Semenleven is living together between a man and a woman without a legal marriage bond. This research uses the type of empirical normative research. The data types used are primary and secondary data sources using several approaches. The results show that the use of Bajo customary law, as a form of law enforcement against the perpetrators of the Samen Leven offense, will create a bargaining justice where customary law is used as the first route in resolving a conflict between victims, perpetrators, and the community. The consequence is that the perpetrator must admit that he has been guilty and is willing to take responsibility for his mistake following applicable customs. The Bajo Customary Council uses customary law as a reference to resolve any problems that occur in Bajo Village, Tilamuta District, namely customary law by deliberation/mediation.

Abstract

The investigation process is an integral part of the investigation. Put merely, and the research is an essential part of the study. The emphasis of investigations is on finding and gathering evidence so that the criminal act found becomes apparent and can find the culprit. In principle, the analysis of a criminal case is a continuation of the research carried out previously. For an event that has been declared a criminal act by the investigator, the next step is to investigate who the perpetrator of the crime is. This research was conducted by examining field data. This writing is to provide an ideal concept of supervision in the process of suspected criminal acts and then goes to the supervision of the investigation process. The investigation is carried out by officials appointed by Law as referred to in applicable laws and regulations. Still, management needs to be carried out by all parties, including the community. This management is a fundamental affirmation that all stakeholders play a significant role in eradicating corruption that threatens society's stability and security and weakens the institutions and values of democracy and justice, endangers sustainable development and law enforcement.

Abstract

ABSTRACTThe purpose of this study is to Analyze the position of Village Regulations after the enactment of Law Number 12 of 2011 concerning the Formation of Legislation and Know and Analyze the Urgency of Village Regulations in the Implementation of Village Government Affairs. The study uses a type of normative juridical legal research using the approach to the Act (Statute Approach), and Conceptual Approach (Conceptual Approach). The results of this study indicate: First, That the Position of the Village Regulation Post the Law No. 12 of 2011 is legally normative is not explicitly recognized in Law No. 12 of 2011 although the previous law still recognizes this point clearly in Law Number 10 of 2004 Village regulations state that Article 7 paragraph (2) letter c states "Village regulations / equivalent regulations, made by village representative bodies or other names together with village heads or other names." However, with the change from Law No. 10 to Law No. 12 In 2011, it is clear that Article 7 only mentions the type and hierarchy of laws only to Regional Regulations. Second, That the Urgency of Village Regulations in the Implementation of the Government Administration Desadalam in its development to carry out government functions in the village. The governmental function is derived from co-administration tasks originating from a higher level of government, namely regency / city. Law Number 6 of 2014 concerning Villages provides space for villages and village apparatus to be creative and has a legal basis in terms of improving village welfare, as we know that the village is the lowest unit of state administration in Indonesia.Keywords: Position of Village Regulation; Village Government. Abstract

Tujuan penulisan artikel ini sebagai luaran laporan Program Pengabdian KKN sebagai bentuk upaya untuk meningkatkan dan mengembangkan potensi desa yang ada, sehingga dapat mewujudkan pembangunan desa. Selain itu sosialisasi dan penyuluhan terkait dengan rancang bangun peraturan desa tentang pengembangan potensi Desa Dudepo di Kabupaten Pohuwato tersebut kepada aparat dan masyarakat desa dimaksudkan untuk memberikan pengetahuan sekaligus keselarasan persepsi dalam melakukan ikhtiar kolektif pembangunan desa melalui pengembangan potensi desa di Kabupaten Pohuwato, serta Pembentukan SATGAS P2D (Satuan Tugas Pengembangan Potensi Desa) yang dimaksudkan untuk mengidentifikasi dan melakukan pendampingan mulai dari tahapan identifikasi potensi desa, perencanaan, pengelolaan dan pengembangan potensi desa sebagai bentuk perwujudan desa tangguh dan berkembang untuk mencerminkan pelaksanaan pembangunan di desa. Hasil dari kegiatan ini adalah pelaksanaan pendampingan pembentukan peraturan desa sesuai dengan potensi Desa Dudepo, data-data terkait potensi yang ada di Desa Dudepo, Pembentukan SATGAS P2D (Satuan Tugas Pengembangan Potensi Desa) yang melibatkan aparat desa dan masyarakat untuk memudahkan koordinasi, komunikasi program dan kegiatan pengembangan potensi desa di Desa Dudepo.Kata Kunci: Pengembangan; Rancang Peraturan Desa; Potensi Desa.

Abstract

A divorce filed by a wife is known as a divorce suit, is filed based on reasons permitted by Islamic law and is processed in the Religious Court according to the wife's place of residence. In divorce suit cases, women become active parties in the legal proceedings. Law Number 1 of 1974 and the Compilation of Islamic Law regulate the rights of women and children after divorce, including child support, spousal support, and mut'ah (a form of compensation for the wife). However, these regulations primarily focus on cases of divorce initiated by the husband. This research uses a qualitative method with a normative legal approach and descriptive techniques to synchronize legal regulations. The findings indicate that divorce must go through a court process to be legally valid. If mediation fails to preserve the family, the court is considered the final solution. Husbands filing for divorce are obligated to provide maintenance according to Islamic law. In cases of divorce suit, the husband cannot reconcile with the wife except through a new marriage contract. However, the implementation of women's and children's rights in divorce suit cases remains limited, influenced by the lack of claims from the plaintiff, weak implementation of Supreme Court Circular Letters, and insufficiently strong regulations. These rights are outlined in Circular Letters but have weak binding power because they are not part of formal legislation.

Abstract

The principle of Equilibrium (balance) in indigenous and tribal peoples is an ethical demand considering the moral, social, and legal values prevailing in society. This concept is closely related to the communal mentality of customary law. This writing aims to understand how the principle of Equilibrium (balance) is applied to the cosmological rights of indigenous and tribal peoples as an effort to implement Pancasila values. The method used in this research is normative legal research with a statutory approach, supported by observation and interviews, then analyzed prescriptively to achieve a clear understanding of the issues discussed. This principle of balance serves as a guide for creating a balance between rights and obligations which can be realized concretely through legal and non-legal norms in the context of customary law communities. This allows various rights owned by indigenous peoples to be recognized and respected. Therefore, the government needs to prioritize Pancasila values in development and pay attention to the cosmological rights of indigenous and tribal peoples. Thus, customary law can be a means to answer various legal problems faced by the people in their daily lives in certain areas while maintaining the cosmological rights of the indigenous peoples themselves.

Abstract

In this context, the government needs to prioritise Pancasila values in development and pay attention to the cosmological rights of indigenous and tribal people. Customary law must address various legal issues faced by people in specific areas and uphold the fundamental rights.
