Abstract

The right to privacy, especially with regard to personal health condition, seems to be an issue in China. Illegal access to personal information and illegal disclosure of personal information to others constitute the infringement of the Personal Privacy Act. Although the privacy right has been governed under the Constitution since the 1980’s, however, its implementation has not yet been satisfactory due to some reasons. This paper aims to describe the implementation of the patient’s privacy regulations in the People’s Republic of China. This normative legal research employing a descriptive-qualitative method. The study shows that the right to privacy for the patients in China needs to get more attention from government, medical personnel and ruling groups.

Abstract

ABSTRACTDisharmonization related to the application of Indonesian cyber notary is an obstacle in terms of legal substance aspects. This legal vacuum occurs because the contradiction of the conflict between Notary Public Law on Article 15 paragraph (3) of the UUJN and Information and Transaction Electronic Law on Article 5 paragraph (4) of the ITE Law. Therefore, it is necessary to harmonize the laws and digital instruments of the notary profession into the Indonesian legal system. The purpose of this research is to examine the regulations that should be applied regarding electronic deeds in Indonesia. This research uses the juridical-normative method, using secondary data legal materials. The results of this study indicate that harmonization of integrated and consistent legal arrangements in order to create the concept of cyber-notary in Indonesia. Keywords: Cyber Notary; Legal Reconstruction; Digitalization.ABSTRAKDisharmonisasi hukum terkait penerapan cyber notary di Indonesia menjadi hambatan dari segi substansi hukum. Kekosongan hukum ini terjadi karena adanya pertentangan antara Pasal 15 ayat (3) UUJN dengan Pasal 5 ayat (4) UU ITE. Hal ini mengakibatkan tidak adanya keabsahan akta yang memiliki kekuatan hukum sempurna. Oleh karena itu, perlu adanya harmonisasi aturan hukum dan instrumen digital profesi notaris ke dalam sistem hukum Indonesia. Tujuan penelitian ini adalah untuk mengkaji peraturan yang seharusnya dapat diterapkan terkait akta elektronik di Indonesia. Penelitian ini menggunakan metode yuridis normatif dengan bahan hukum sekunder. Spesifikasi penelitian ini bersifat deskriptif-analitis dengan analisis kualitatif. Hasil penelitian ini menunjukkan perlunya harmonisasi pengaturan hukum yang terintegrasi dan konsisten guna terciptanya konsep cyber notary di Indonesia.Kata Kunci: Cyber Notary; Rekonstruksi Hukum; Digitalisasi.
