Abstract

Airsoft gun merupakan sebuah replika senjata api yang dibuat sedemikian rupa dengan kemiripan 1:1. Indonesia memiliki dua peraturan tentang airsoft gun yang tertuang pada Peraturan Polri Nomor 5 Tahun 2018 dan Peraturan Kapolri Nomor 8 Tahun 2012. Penelitian ini bertujuan untuk menganalisis apakah peraturan airsoft gun dapat digunakan sebagai dasar hukum untuk menentukan suatu tindak pidana dan menjelaskan mengenai urgensi perlunya dilakukan kriminalisasi perbuatan berkaitan dengan airsoft gun. Penelitian dilakukan menggunakan metode yuridis normatif dengan pendekatan undang-undang, pendekatan konseptual, dan pendekatan kasus, pengumpulan bahan hukum dilakukan dengan studi pustaka dan dianalisis dengan metode preskriptif. Hasil pembahasan menunjukkan, bahwa peraturan tentang airsoft gun yang ada, tidak dapat dijadikan sebagai dasasr hukum untuk menentukan suatu tindak pidana dan hakim dalam memutus perkara tentang airsoft gun akan menggunakan peraturan lain yang menyertai perbuatan pidana yang dilakukan dengan airsoft gun. Hal demikian terjadi karena peraturan tentang airsoft gun tidak berada pada level undang-undang, serta juga tidak sejalan dengan asas no punish without representative yang menyatakan bahwa dalam pencantuman norma pidana perlu persetujuan dari rakyat. Karena persetujuan rakyat hanya pada level undang-undang dan Perda. Dikaitkan dengan asas legalitas, peraturan tentang airsoft gun juga tidak secara eksplisit menyebutkan norma sanksi pidana di dalamnya. Karena asas legalitas bermakna peraturan harus jelas, tegas dan tertulis. Perlu dilakukan upaya kriminalisasi untuk menciptakan sebuah kepastian hukum dengan dilakukan upaya adendum dengan menambahkan airsoft gun dalam Undang-Undang Darurat Nomor 12 Tahun 1951 supaya eksistensi airsoft gun memiliki kedudukan dalam peraturan perundang-undangan.

Abstract

In the context of preventing the increasingly widespread Covid-19 which has claimed many lives, the Indonesian government has made various efforts to overcome this and the most recent effort is giving Covid-19 vaccinations to the public. In practice, various conflicts emerge and one of them is the conflict between Law Number 6 of 2018 concerning Health Quarantine which states that vaccines are an obligation and Law Number 36 of 2009 concerning Health which states that vaccines are a right. This type of research is juridical normative using a statutory and conceptual approach. The results of this study indicate that Covid-19 is an emergency so that the principle of non-habet legem necessity applies, which means that in a state of legal emergency it does not apply, so that regulatory conflicts regarding Covid-19 vaccination do not become a problem, because the current government's efforts are the safety of the people. the highest law in an emergency, this is also in line with the salus populi suprema et lex principle. To ensure the safety of the people, the government is obliged to make efforts to vaccinate Covid-19 to restore the situation to its original state, this is in line with the principle of restutio in integrum. In its enforcement, sanctions are needed to make the community obey. However, several regulations have different norms regarding sanctions for those who do not comply and until now there have been no specific regulations from the center regarding the provision of the Covid-19 vaccine. As a conclusion, currently giving the Covid-19 vaccine is mandatory because it is an emergency, but the government also needs to make special regulations from the center regarding vaccine administration regulations so that there are no disparities between each of the regulations from the vaccine-giving regions.

Abstract

Untuk memaksimamkan kinerjanya manajemen akan memanfaatkan kesempatan dengan memilih pilihan yang tepat guna terhindar dari opini going concern yang diberikan oleh auditor. Penelitian ini akan menguji intervensi manajemen yang melakukan opinion shopping, audit delay, opini audit tahun sebelumnya guna terhindar dari pemberian opini audit going concern oleh auditor. Jenis penelitian ini merupakan penelitian kuantitatif. Penelitian ini menggunakan sampel 98 perusahaan manufaktur yang terdaftar di BEI, dengan kriteria mengeluarkan laporan keuangan yang telah diaudit pada tahun 2020 – 2022. Hasil penelitian ini menunjukkan hasil yang negatif dari seluruh hipotesa. Hal tersebut dapat terjadi karena pada tahun 2020 – 2022 terjadi pandemic covid -19 dimana wabah yang terjadi pada manusia juga sangat mempengaruhi kinerja ekonomi entitas bisnis. Industri manufaktur merupakan industri dengan dampak terbesar sehingga auditor akan cenderung menghindari untuk melakukan intervensi, karena akan berpengaruh pada akuntabilitas, independensi, kredibilitas auditor dan akan membuat kinerja auditor menjadi buruk.

Abstract

Cryptocurrency regulation presents a unique and monumental challenge for policymakers. Many countries have threatened to impose complete bans on the use and trading of cryptocurrencies. This study aims to describe the responsibility of the State in protecting crypto asset customer in Indonesia. The normative juridical research method with data sources including primary data and secondary data is used as an analytical tool. The results of the study show that in order to protect crypto asset customer in Indonesia, the government refers to the Commodity Futures Trading Law No. 10 of 2011 which can provide legal protection for investors. Hedging of commodity futures contracts is carried out under the direct supervision of the Commodity Futures Trading Regulatory Agency (BAPPEBTI).

Abstract

Penelitian ini bertujuan untuk menganalisis perhitungan rugi daya pada sistem kelistrikan PT. Freeport Indonesia, yang merupakan salah satu perusahaan tambang terbesar di Indonesia. Rugi daya listrik merupakan fenomena yang terjadi akibat perbedaan antara daya yang diproduksi dan daya yang diterima oleh konsumen akhir, yang dapat disebabkan oleh faktor-faktor seperti resistansi kabel, transformator, dan komponen sistem lainnya. Dalam penelitian ini, dilakukan analisis terhadap sistem distribusi listrik di area operasional PT. Freeport Indonesia Feeder#1, dengan menghitung rugi daya yang terjadi pada setiap komponen dan jalur distribusi. Metode yang digunakan meliputi pengukuran langsung, dan perhitungan rugi daya berdasarkan data historis penggunaan daya. Hasil analisa dan simulasi didapatkan nilai rugi – rugi daya pada bus 6  sebesar 1,841 kW dan 1,4 kW. Hal ini disebabkan karena bus 6 mempunyai panjang saluran 0,456 km dan pembebanan yang cukup besar yaitu 56,546 A. Untuk mengurangi nilai rugi daya tersebut dengan melakukan pergantian penghantar tipe ACSR yang semula luas penampang 67,4 mm2 menjadi 85 mm2. Dari hasil perbaikan tersebut dengan simulasi rugi – rugi daya pada bus 6 dari 1,4 kW turun menjadi 1,1 kW, sehingga mendukung keberlanjutan operasional perusahaan dalam jangka panjang.

Abstract

Decentralized Finance (DeFI) has positively impacted the development of crypto asset trading and has been adopted by various countries except for Indonesia. This study aims to identify the urgency of regulating DeFi as the development of crypto asset trading in Indonesia and construct the ideal regulation. This research is normative legal research with a statutory and conceptual approach. The research results stated the urgency of regulating DeFi as the development of crypto asset trading is: a) other countries have used DeFi because it can develop crypto asset trading for the better by creating value stability in crypto assets, having a function for lending and borrowing crypto assets, having transparency in transactions and lower crypto asset trading fees; b) DeFi technology adopted in the development of the Digital Rupiah project by BI and adopted by physical traders of crypto assets in Indonesia; c) as a form of legal protection from risks arising from technical or non-technical negligence or intention to protection from crime. Ideal legal regulation for decentralized finance as the development of Indonesia crypto asset trading is the formation of a regulation by CoFTRA in the form of technical guidelines and implementation mechanisms, in the form of a new written CoFTRA Regulation, in the form of a decree from the Head of CoFTRA whose focus is to regulate DeFi as development Crypto asset trading.

Abstract

One of the rights of every person who is universal is equal recognition and treatment before the law, not least for Foreign Nationals (WNA). Therefore, the protection of the existence of WNA within the legal umbrella of a country is a principle to be implemented; Considering that WNA has a legal interest in the country. Nevertheless, there is a probe into the legal rights of the WNA; One of them is the legal position of WNA to conduct judicial review to defend its legal interests. This type of research is legal research. This legal research uses a statutory and conceptual approach. The legal materials used in this legal research are primary legal materials and secondary legal materials; where the two materials are inventoried to obtain an elaborative and prescriptive juridical study. The purpose of this legal research is to describe the basic principles regarding the relationship between legal standing and judicial review; as well as describe the constitutional perspective on the possibility of granting legal capacity to foreign nationals to be able to conduct judicial reviews in Indonesia. The results of the study indicate that the relationship between legal position and judicial review has a very strong relationship. Therefore, legal position is the basis of legal subjects to carry out legal actions as in a judicial review. Thus, if a statutory regulation is deemed detrimental to the rights of everyone including foreigners, the foreigner has the right to conduct a judicial review of the statutory regulations. Then, the spirit and provisions of the Indonesian constitution actually provide the possibility for foreigners to conduct a judicial review. Thus, it is necessary to make improvements to the Law relating to the Constitutional Court regarding the legitimacy of foreigners to have a legal standing to conduct a judicial review
