Abstract

The Bankruptcy Law is intended to maintain business continuity, not only debtors but also creditors and parties who are indirectly involved in the bankruptcy case. The purpose of the Bankruptcy Law is not to impoverish debtors and creditors and other parties but to ensure how after the bankruptcy decision the parties can resume their business or start a business again from scratch. The research approach used in this research is qualitative. The type of research is library research or normative juridical. Sources of data come from laws, journals, and books related to the Bankruptcy Law. The method of data collection is done through documentation in the form of books and journals. The data obtained were then processed and analyzed prescriptively and descriptively. Data processing is carried out by systematizing legal materials by classifying data to facilitate analysis and construction in normative legal research. The results of this study indicate that the Bankruptcy Law as far as possible maintains the balance of rights of debtors and creditors. Article 2 Paragraph (1) In simple terms, the procedure for bankruptcy of a person is also excluded if the debtor is hopelessly in debt or has no hope of continuing his business. Article 2 Paragraphs (2), (3), (4) and (5) provide limited access for certain lines to be bankrupt, seeing that these lines are in direct contact with the interests of the general public. Article 4 aims to maintain family harmony. Article 41 to maintain the continuity of the creditor's business when the debtor is in the process of bankruptcy.

Abstract

The ratification of Law Number 3 of 2020 (Revision of the Mining Law) on June 10, 2020 by President Joko Widodo raised a polemic so that several parties have filed a judicial review of the law. This phenomenon indicates that there are interests that are not accommodated in the Revision. The natural resource business as the sector with the greatest risk of human rights violations is in the spotlight whether the Revision are much better to guarantee human rights protection or not. The UN Guiding Principles on Business and Human Rights (UNGPs) is a recommendation that can be used as a parameter how human rights are protected on the Revision. This research is normative legal research using qualitative descriptive methods by combining statutory approaches and conceptual approaches. The results show that the absence of mandatory regulations and guidelines for human rights protection in domestic business activities is a factor in the low level of human rights protection in the Revision. Human Rights Protections by the State and Human Rights Respects by companies have not been comprehensively regulated, access to recovery for human rights impacts is still not maximal and needs to be developed as recommended in the UNGPs.

Abstract

This study aims to identify the law of agreement on the practice of online lending that is developing in Indonesia. This research is a normative research with a contract law approach. Methods Data collection is done by the library method (literature). The results show that online lending practices are developing in Indonesia, applications that operate as online loan facilities include legal, illegal applications, and applications labeled as Financial Services Authority or OJK in Indonesia, Ministry of Communication and Information of the Republic of Indonesia, and Indonesian Joint Funding Fintech Association or AFPI in Indonesia. Online loan transactions that require borrowing to obtain funds, the application operator only verifies personal identity as a condition of the agreement. Therefore, the legal concept of agreement in online lending practices is that it does not meet the provisions of the agreement system and contains rights and obligations between parties and the disclosure of public information on online lending, so that online lending practices are exclusive and have defects in all online lending practices.

Abstract

The fit and proper test (FPT) in filling the position of the board of commissioners at State-Owned Enterprises (SOEs) currently only applies to the financial service institution (LJK) cluster, and not to other clusters. Whereas, FPT aims to identify the suitability and properness of candidates, and avoids the impression of candidates filling in on the basis of political closeness to the authorities. This article urges that FPT be applied in filling the positions of the board of commissioners of all SOEs, not limited to the LJK cluster. First, due to the lack of LJK clusters, which are only 19.6 percent of the total 98 SOEs in early 2021. Second, FPT is an important instrument in supporting the application of GCG principles to SOEs, considering the inherent GCG principles on boards must be applied starting from the selection process. Third, FPT is expected to attract professional commissioners. This article encourages the strengthening of FPT regulations for all prospective BUMN commissioners carried out by independent institutions that professionally assess and measure the competence and integrity of candidates, then the FPT guidelines must be stated in a Government Regulation as stipulated in Article 16 paragraph (4) PP No. 45 Year 2005. Abstrak Uji kelayakan dan kepatutan, atau lebih dikenal fit and proper test (FPT), dalam pengisian jabatan dewan komisaris pada Badan Usaha Milik Negara (BUMN) saat ini hanya berlaku pada klaster lembaga jasa keuangan (LJK), dan tidak pada klaster lainnya. Padahal FPT bertujuan untuk mengidentifikasi kelayakan dan kepatutan para calon, dan menghindari kesan calon yang mengisi atas dasar kedekatan politik dengan penguasa. Artikel ini mendorong agar FPT diberlakukan dalam pengisian jabatan dewan komisaris seluruh BUMN, tidak terbatas pada klaster LJK. Pertama, hal ini disebabkan karena minimnya klaster LJK yang hanya 19,6 persen dari keseluruhan 98 jumlah BUMN pada awal 2021. Kedua, FPT merupakan instrumen penting dalam mendukung penerapan prinsip GCG pada BUMN, mengingat prinsip GCG yang melekat pada boards sudah harus diterapkan mulai dari proses pemilihan. Ketiga, FPT diharapkan dapat menjaring calon komisaris yang profesional. Artikel ini mendorong penguatan regulasi FPT bagi seluruh calon komsiaris BUMN yang dilakukan oleh lembaga independen yang secara profesional menilai dan mengukur kompetensi dan integritas para calon, kemudian pedoman FPT harus dituangkan dalam Peraturan Menteri sebagaimana diatur dalam Pasal 16 ayat (4) Peraturan Pemerintah No. 45 Tahun 2005.

Abstract

Abstract Economic development is one of the effort to realize "social justice for all Indonesian people", so the process of achieving should be pursued in a justice way, so that there is no imbalance that can make the goals not be attained maximally. Sharia Bank is the only banking system that explicitly states that banking activities are based on the justice principle. Based on that case, this paper will discuss what is the indicator of justice and how urgent is the application of justice principle in banking activities. Then, find out what investment policy models can enhance the role of the community to contribute to development through banking institutions that have applied the principle of justice. The results showed that: first, an indicator of justice in banking activities is based on an existence of the "harm" thing, banks with riba potentially harm both the bank and the customer; secondly, choosing banking services that contain injustice is just the same to choose madharat, because injustice is zhalim; thirdly, Indonesia can implement a policy model of separating deposit and investment accounts, which in investment products the bank acts as a facilitator rather than a fund manager as in deposit accounts. Abstrak Pembangunan ekonomi adalah salah satu upaya untuk mewujudkan “keadilan sosial bagi seluruh rakyat Indonesia”, sehingga proses untuk mencapainya sudah seharusnya ditempuh dengan cara yang adil agar tidak terjadi ketimpangan yang bisa mengakibatkan tidak maksimalnya pencapaian tujuan tersebut. Bank Syari’ah merupakan satu-satunya sistem perbankan yang secara eksplisit menyebutkan bahwa aktifitas perbankan dijalankan berdasrkan prinsip keadilan.Berdasarkan permasalahan tersebut, penelitian ini akanmembahas tentang apa indikator keadilan dan bagaimana urgensi penerapan prinsip keadilan dalam aktifitas perbankan, serta menemukan model kebijakan investasi yang dapat meningkatkan peran masyarakat untuk berkontribusi dalam pembangunan ekonomi melalui lembaga perbankan yang telah menerapkan prinsip keadilan. Hasil penelitian menunjukan bahwa: pertama, indikator keadilan dalam aktifitas perbankan yaitu berdasarkan ada atau tidaknya unsur “merugikan”, bank dengan sitem ribaberpotensi merugikan baik bagi pihak bank maupun nasabah; kedua,memilih jasa perbankan yang mengandung unsur ketidakadilan sama saja dengan memilih kemadharatan, karena ketidakadilan adalah sebuah kedzaliman; ketiga, Indonesia bisa menerapkan model kebijakan pemisahan akun deposito dan investasi, yang mana dalam produk investasi bank bertindak sebagai fasilitator bukan pengelola dana seperti dalam deposito. Abstract

Bank Pembiayaan Rakyat Syariah (BPRS) menjadi salah satu pilihan penyedia jasa pembiayaan bagi Usaha Mikro dan Kecil (UMK) di Kabupaten Banyumas yang membutuhkan pembiayaan berbasis syariah namun tidak dapat mengakses jasa layanan keuangan di Bank Umum Syariah (BUS). BPRS perlu terus meningkatkan profesionalisme lembaga terutama dengan penguasaan dan pemahaman yang baik terhadap konsep keuangan syariah, karena fakta di lapangan menunjukan bahwa tidak seluruh pengurus dan pengelola BPRS memiliki latar belakang keilmuan ekonomi/perbankan syariah. Oleh sebab itu dalam rangka pelaksanaan Tri Dharma Perguruan Tinggi, tim pengabdian dari program studi Perbankan Syariah UIN Prof. K.H. Zuhri mencanangkan program pengabdian yang berfokus pada optimalisasi manajer pendanaan dan pembiayaan terhadap akad muamalah pada BPRS di Kabupaten Banyumas. Pengabdian masyarakat untuk peningkatan literasi akad muamalah di BPRS Kabupaten Banyumas menggunakan metode perticipatory action research (PAR). Pendekatan PAR meruapakan pendekatan secara kualitatif dengan mengintegrasikan teknik mengamati, mendokumentasikan, menganalisa dan menafsirkan pola dari komunitas sasaran program. Hasil menunjukan bahwa 70% peserta pendampingan mengalami peningkatan pemahaman terhadap akad muamalah.

Abstract

Debt in Islam is a social observance with the concept of helping (ta'awun). The presence of information technology-based lending is an innovation that aims to provide convenience for consumers to access needs in the form of loan funds. However, the presence of these online lending has taken many victims with many debtors receiving loans experiencing greater losses due to default disputes and unlawful acts in online lending practices. Indonesia as a country with the largest Muslim population needs to review this phenomenon from the point of view of Islamic law. The goal is that the society will not only become good citizens, but also become Muslims who are obedient to the provisions of Islamic law. This research is normative legal research which is also called doctrinal legal research. Descriptive analysis will be presented through literature study techniques from secondary data in the form of library materials. The results of the study show that online loans that have a great potential to cause default disputes and unlawful acts are a madharat that must be eliminated. The reason for making it easy to provide benefits to the community must be reviewed, because eliminating harm must take precedence over achieving benefit

Abstract

Indonesia experienced a communication crisis in the legislative process that resulted in several laws being rejected by the public. The big demonstration against the ratification of the law began with the revision of the KPK Law, followed by the ratification of three other quite controversial laws, namely the amendment of Mineral and Coal Mining Law, the Constitutional Court Law, and the Job Creation Law. This condition is quite disturbing if it repeats itself in the future because it will be a ticking time bomb by continuously eroding public trust in the government. The law, which should be able to become social control, actually creates new problems and does not work effectively, because it does not accommodate the interests of the community, resulting in many rejections through demonstration actions. Representative democracy carried out by the legislature seems to need public assistance to make responsive laws that represent the public interests. This problem makes us aware that there must be improvements in the development of national laws by increasing public participation. This article is normative legal research that used qualitative analysis with a statute approach focused on procedures for the process of legislation. The results indicate that one of the efforts to optimize public participation in forming laws and regulations that do not get consensus from all the legislature’s members is by applying the Policy Screening Tool (PST). PST is a policy analysis tool that could be a parameter of whether a legal draft is feasible to be passed or not.Keywords: policy analysis, law development, screening tool, legal draft.

Abstract

The government continues to strive to improve the ease of doing business, one of which is legitimizing the existence of a new entity intended for micro and small enterprises (MSEs). The entity is a One-Person Limited Liability Company, which is familiar for particular countries with higher ease of doing business than Indonesia. However, this new business form for MSEs is unique and has different characteristics from other countries. The new regulation restricts the founder and shareholders, who can only be natural persons and cannot be more than one. The problem is that the law obscurity of the company's organ emerges not following previous regulations because there is no obligation to have supervisory bodies on it. Being the only different entity can be an advantage, but it can also be a rash act. This normative legal research uses the comparative law method to identify problems in statutory regulation. The result shows a legal vacuum in the new regulation of Indonesian one-person companies’ organs, whether they should implement the one-tier board or have the option to adopt the two-tier board system. The thing to consider is supervisory bodies should remain within an entity with limited liability regardless of its system.
