Abstract

TikTok Shop is a social commerce feature that allows users and creators to advertise and sell products through TikTok. Currently, TikTok is still not licensed as social commerce. As a platform that connects sellers and buyers, TikTok Shop has the responsibility to ensure the security and validity of transactions that occur in it. However, there are still some unresolved legal issues. This study aims to identify and analyze legal uncertainty related to the Minister of Trade Regulation Number 31 of 2023 concerning Business Licensing, Advertising, Guidance, and Supervision of Business Actors in Trading through Electronic Systems where social commerce must have a license first before it can operate in Indonesia, in this situation TikTok Shop cooperates with one of the largest e-commerce platforms (marketplace) in Indonesia, namely Tokopedia, which occurs in the return of TikTok Shop as a social commerce platform in Indonesia. The method used in this research is normative juridical. This research approach is a statutory approach (statue approach). Based on the results and discussion, it is found that there is legal uncertainty where TikTok Shop is not in accordance with the regulations mentioned above, especially regarding the rules stating that social commerce is not allowed to put a payment transaction feature (checkout) in it. It is hoped that the results of this study can contribute to increasing understanding and legal awareness for TikTok Shop users and provide recommendations for related parties to increase security and trust in transactions on this platform.

Abstract

Various factors may lead to the increase of physical and mental health problems within the society, especially among teenagers and adults. Music therapy has frequently been used to deal with such problems.  Music therapy is generally conducted in private using various types of music, including musical works protected by copyright, therefore the use of music for therapeutic purpose may give rise to copyright issues.  This article aims at exploring the legal frameworks on the practice of music therapy with regard to copyright issue in Indonesia and other jurisdictions. This normative juridical research employs both statutory and comparative approaches. Comparison is made with the United States and Australia. The results show that currently, there is no regulation governing music copyright used in private settings in Indonesia. Based on four factors test, the use of musical works protected by copyright in private music therapy sessions can be regarded as a fair use, provided that it is neither publicized nor distributed to the public. When music therapy sessions conducted publicly, such as performing public demonstrations with commercial purpose, therapists may use their own original songs, songs that are part of the Public Domain, musical works with a Creative Commons License, establishing an agreement with musicians, and making royalty payments to relevant institution (LMKN).

Abstract

Beberapa perguruan tinggi di Indonesia telah bermitra dengan perusahaan pinjaman online untuk memfasilitasi pembayaran Uang Kuliah Tunggal (UKT). Untuk mendukung mahasiswa yang kurang mampu secara finansial. Tujuan dari penelitian ini adalah untuk mengidentifikasi dan menganalisis potensi risiko yang dihadapi mahasiswa ketika perguruan tinggi bekerja sama dengan perusahaan pinjaman online, mengetahui perlindungan hukum bagi mahasiswa apabila perguruan tinggi bekerja sama dengan perusahaan pinjaman online, dan memberikan beberapa contoh peran yang harus dilakukan oleh perguruan tinggi ketika menghadapi mahasiswa yang kesulitan membayar UKT. Metode penelitian yang digunakan adalah metode yuridis normatif, pendekatan yang digunakan adalah perundang-undangan dan pendekatan konseptual, teknik analisis data yang digunakan dalam penelitian ini adalah teknik analisis kualitatif dengan meguraikan secara deskriptif analisis. Mahasiswa memiliki hak atas pendidikan yang dimuat dalam 28C UUD 1945 dalam Hak Asasi Manusia. Perguruan Tinggi berbadan PTN BH diperbolehkan bekerja sama dengan pihak lain untuk mendapatkan keuntungan mengenai sumber ppendanaan di luar dana pemerintah, tetapi tidak diperbolehkan melanggar peraturan yang berlaaku. Kerja sama ini dapat memberikan kerugian berupa bunga yang terdapat pada pinjaman online. Perlindungan hukum mahasiswa masuk ke dalam Hak Asasi Manusia pada bagian mendapatkan Hak atas Pendidikan.

Abstract

The government continues to strive to improve the ease of doing business, one of which is legitimizing the existence of a new entity intended for micro and small enterprises (MSEs). The entity is a One-Person Limited Liability Company, which is familiar for particular countries with higher ease of doing business than Indonesia. However, this new business form for MSEs is unique and has different characteristics from other countries. The new regulation restricts the founder and shareholders, who can only be natural persons and cannot be more than one. The problem is that the law obscurity of the company's organ emerges not following previous regulations because there is no obligation to have supervisory bodies on it. Being the only different entity can be an advantage, but it can also be a rash act. This normative legal research uses the comparative law method to identify problems in statutory regulation. The result shows a legal vacuum in the new regulation of Indonesian one-person companies’ organs, whether they should implement the one-tier board or have the option to adopt the two-tier board system. The thing to consider is supervisory bodies should remain within an entity with limited liability regardless of its system.

Abstract

The rapid growth of the digital banking sector in Indonesia has introduced innovative services such as Account Linkage, which enables customers to conduct transactions through partner platforms. While this feature enhances banking convenience, it also raises significant concerns regarding data privacy and legal accountability in the event of a data breach. This study aims to analyze the adequacy of existing legal frameworks in regulating data protection within Account Linkage services and to determine whether current Indonesian laws provide sufficient legal certainty. Employing a normative juridical research method, the research reviews statutory regulations, financial authority policies, and relevant contractual agreements. The findings indicate inconsistencies between banking law, financial service regulations, and privacy policies concerning the allocation of liability for data breaches. Moreover, the absence of a specific regulation governing Account Linkage contributes to legal ambiguity, placing consumers at greater risk and complicating the accountability of financial service providers. This study concludes that a more robust and comprehensive legal framework is urgently needed to ensure consumer protection, clarify the responsibilities of digital banks, and support fair and transparent financial innovation.

Abstract

The rapid development of technology, whether stemming from research results or technological advancements, can be protected through intellectual property, specifically patents.  The regulation of patents is stipulated in Law Number 13 of 2016 concerning Patents, with amendments to several articles in Law Number 6 of 2023 concerning the Determination of Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation. Utilitarian theory, including its application in the context of patent licensing, is an integral part of patent regulation. However, the number of registered patent license agreements on the Directorate General of Intellectual Property's website is limited.  Yet, a proliferation of licenses can enhance a country's national resilience.  This study aims to investigate how the utilitarian theory within the patent system becomes a component of Indonesia's national resilience.  This normative legal study examined secondary literature and legal regulations related to patents, books, journals, and papers concerning intellectual property law, particularly patents.  The research findings indicate that the utilitarian theory can be implemented through licensing.  Registering patent licenses in agreements is a legal prerequisite for protection.  A high number of patent licenses can enhance Indonesia's resilience in terms of both economic and defense and security aspects

Abstract

Recognizing the fact that the quality of Indonesia's human resources (HR) is still relatively low when compared to other Asian countries, it encourages companies to bring in foreign workers (TKA) to fill a certain field of work that cannot be done by Indonesian workers (TKI), so companies can innovate and meet market demand. Behind the benefits of using foreign workers, Indonesia is faced with the problem of foreign workers who violate the permits that are applied to be able to work in Indonesia. This paper aims to examine the responsibility of companies as guarantors for foreign workers and immigration rules with facts on the ground after seeing that there are still many foreign workers (TKA) violating work permits due to the lack of responsibility of companies as guarantors for foreign workers (TKA). ). This research is a normative juridical law research using secondary data obtained through literature study which is connected with the results of studying the problem which is seen as additional data. The assessment is done deductively. The results of the study identified several problems regarding that there are still companies employing foreign workers who do not comply with the permits and procedures regulated in existing laws and regulations, there is a possibility that the supervisory system and sanctions that have been imposed have not run optimally. For this reason, Indonesia needs to reform the system related to the entry of foreign workers to be able to live and become workers in Indonesia.

Abstract

Pertanggungjawaban ahli waris tidak selalu bersifat mutlak, namun bergantung pada pilihan hukum serta persyaratan lainnya mengenai pembayaran hutang. Penelitian ini bertujuan untuk mengkaji Putusan No. 226/Pdt.Sus-PKPU/2023/PN. Niaga Jkt. Pst. yang akan mengkaji mengenai pertanggungjawaban ahli waris debitor penundaan kewajiban pembayaran utang dan kesalahan penerapan hukum oleh hakim dalam putusan tersebut. Penelitian ini merupakan jenis penelitian yuridis normatif dengan pendekatan yang digunakan adalah pendekatan peraturan perundang-undangan, konseptual, dan pendekatan kasus. Hasil penelitian penulis adalah terdapat ketidaksesuaian kesepakatan yang sebelumnya yang menjadi dasar klaim kreditor bersifat kondisional, sehingga tidak memenuhi kriteria hutang. Selain itu, hakim menyatakan dikabulkannya permohonan Penundaan Kewajiban Pembayaran Utang pada debitor, yaitu ahli waris utang yang belum menerima warisan secara resmi. Dapat disimpulkan bahwa terdapat putusan yang tidak memenuhi syarat hukum dasar dan menyimpang dari prinsip perlindungan hak krediyor serta pembatasan beban tanggung jawab ahli waris.
