Abstract

The title of this research is “Analysis of Legal Responsibility for Environmental Impacts Due to Land Eviction in the Farm Road Construction Project in Tidore Islands City”. The object of this research was the impacts of land eviction to construct farm roads in Tidore Islands City as well as the government’s legal responsibility. It aims to study the environmental impacts of land eviction in the construction of farm roads and the government's legal responsibility for its environmental impacts in Tidore Islands City. This study is an empirical legal study that uses a qualitative approach with observation, interview and documentation methods. Results show that the land eviction project activities in the Ake Sahu Environment, Tosa Village, East Tidore District have a very bad impact on the environment in the form of landslides in the eviction project area, floods that bring soil and rock material to the highway so that it greatly disrupts the access activities of the surrounding community, such impacts are not only caused by the eviction of the project but also the utilization activity (C excavation) by Cv. Mafututu Indah. The government has taken action to handle floods and landslides, then gave warnings and stopped the project.

Abstract

Standard Agreement at PT Finansia Multi Finanse (A Review of Law Number 8 Year 1999 concerning Consumer Protection) This study aims first to determine the implementation of the Standard Agreement at PT Finansia Multi Finanse in Ternate City Second To find out the Standard Agreement Settlement in the event of default by parties Creditors This type of research is empirical normative, because what is being studied is a problem regarding matters that are juridical and the existing facts regarding empirical normative research methods, because what is being studied is a problem regarding matters that are juridical and the existing facts regarding juridical review of the implementation of the agreement. standard at PT Finansia. And the Standard Agreement Settlement in the event of default by the debtor party in Ternate City, while normative determines what is allowed and what cannot be regulated in the Civil Code. Based on the results of research and discussion, it can be concluded that First, the implementation of the Credit Agreement at PT Finansia Kota Ternate, from the last 5 months in 2020 there has been an increase, it can be seen that customers who make credit loans in the form of money or other electronic goods increase every month until the time This is because every customer who makes a credit loan at PT Finansia Kota Ternate is not convoluted so that from May to September 1743 customers made credit loans, or up to 98%. Second The legal consequence is that if there is default at PT Finansia Kota Ternate, the last 5 months in 2020 reached 10 customers or 0.5.5% of 1743 customers, the customer as a debtor has the authority to carry out and maintain the customer's credit loan items if PT Fainansia does default in accordance with the applicable law.

Abstract

In this paper, the authors will analyze: (1) the details of the home ownership loan agreement in the Labuha Branch of Bank Syariah Indonesia (The Indonesian Sharia Bank/BSI) and (2) how to resolve the issue of default carried out one of the parties in the home ownership loan agreement in the Labuha Branch of BSI. Members of society who wish to own a home but lack funds may utilize the credit facilities provided by BSI by making a credit agreement (home ownership loan). It is one of the solutions for prospecting housing consumers to quickly have a house. This paper is urgent because the increasing Indonesian population leads to an increase in demand for housing. Banks like BSI can help society obtain house ownership loans amid the increasing house prices. This paper employed the normative empirical legal research method. Results showed that the agreement carried out by the debtor and creditor is already according to the applicable regulations. It was shown that there was an increase in the number of debtors who obtained home ownership loans from the Labuha Branch of BSI. In total, 83 debtors obtained such facilities from 2021 to 2023. In the case of problematic debtors, ten debtors experienced a default in the Labuha Branch of BSI from 2021 to 2023. In the case where debtors fail to carry out their obligations in paying installments or in repaying their debt, then the bank will sell the collateral object or the house.

Abstract

Penelitian ini bertujuan Pertama Untuk mengetahui Bagaimana Upaya Mengatasi Tiingginya Angka Perceraian di Kecamatan Batanglomang Kedua Untuk mengetahui Faktor-Faktor Yang Mempengaruhi Tingginya Angka Perceraian di Kecamatan Batanglomang Tipe Penelitian ini adalah penelitian Normatif Emiris. Data yang digunakan adalah data primer dan data sekunder. Teknik pengumpulan data yang digunakan adalah wawancara, observasi dan dokumentasi. Teknik analisis data yang digunakan adalah analisis data kualitatif yang dilakukan secara interaktif. Dampak Terhadap Tinginya Angka Perceraian di Kecamatan Batanlomang. Hasil penelitian upaya mengatasi tingginya angka percerian yang dilakukan di Kecamatan Batanglomang yaitu dengan menerapkan Peran Badan Penasihatan Pembinaan dan Pelestarian Perkawinan (BP4). Selain Bp4 Sebagai upaya untuk mencegah sebuah kasus perceraian adalah nasehat dari pihak keluarga dan hendaknya dapat memberikan penjelasan seperti. Memberikan Bimbingan Penasehatan Pelestarian Perkawinan dan Perceraian sebelum melangsungkan Pernikahan. Mengadakan penyuluhan tentang pelaksanaan pernikahan/perceraian dan rujuk. Membentuk majelis ta’lim yang berfungsi memberikan motivasi dalam berumah tangga. PPN memberikan bantuan buku tentang kehidupan dalam berumah tangga, khususnya pernikahan, perceraian dan rujuk. Adapun jumlah perceraian pada kurun waktu tersebut di atas yang telah ditangani oleh Pengadilan Agama Labuha sebanyak 64 kasus perceraian. Tingginya angka perceraian di Kecamata Banglomang tidak mudah ditekan meskipun telah diminimalisir oleh Pengadilan Agama Labuha, yaitu dengan melakukan proses mediasi lewat mediator dan pemberian nasihat di setiap persidangan oleh majelis hakim namun hasilnya tetap meningkat pertahunnya. Penyebab faktor terjadi perceraian yang terjadi di Pengadilan Agama pada kurun waktu 2018-2022 sangat bervariasi.
