Abstract

The idea of the Geographical Indication (IG) for coffee is not only to achieve high-quality of products but also to enhance the standard of benefits for coffee farmers. This article demonstrates discrepancies between hope and reality; quality and economic impact prevailing in the case of coffee products in Jambi Province of Indonesia. It is argued that such discrepancies potentially degrade coffee’s future in Indonesia due to farmers’ ignorance. Besides, the government policy concerning the IG has ended up with gaps between farmers’ orientation and the government’s political interest and policy in utilizing the coffee GI rights. Data were collected to analyze and address the problem from legal, social, and political perspectives. Our findings emphasize the government’s role as the grantor of rights to manage GI rights in a holistic context beyond legal positivism in order to enhance the benefits of coffee farmers in Indonesia

Abstract

Jambi Malay customary law in the traditional community unit of the Rumah Tuo, Rantau Panjang village, Kec. Tabir Kab. Merangin and solving problems in the distribution of inheritance according to Jambi Malay customary law in the Unity of Indigenous Peoples of Rumah Tuo, Rantau Panjang Village, Kec. Tabir Kab. Merangin. The research method used is empirical juridical. The research specification is descriptive analytical, which provides an overview of the object under study. The results showed that the distribution of inheritance according to Jambi Malay customary law in the Tuo community unit, Rantau Panjang village was carried out on the principle of primacy, meaning that in receiving inheritance or accepting roles to manage inheritance, the levels of rights that caused one party to be more entitled than the other. another and the survivors who have the right are still there, the others have not received them. In the case of the problem of dividing the traditional inheritance of the Rumah tuo in Rantau Panjang Village, Tabir District, Merangin Regency, it is resolved by duduk basamo by means of (sitting together) with the principle of deliberation for the distribution of inheritance.

Abstract

Geographical indication is part of the Intellectual Property regulated in the Law Number 20 of 2016 on Trademarks and Geographic Indications, Tangkit pineapple is a typical Pineapples Village of New Tangit district of Muaro Jambi which must be protected in order to obtain legal protection of Geographic Indication. The aim of this research is to identify and analyze the economic benefits for communal communities that are integrated into the MPIG Nanas New Infection Group. To identify the role of the government in optimizing the utilization of Geographical Indications for the new Infection Society. The basic problems in this research are: 1) How the economic benefit for the communal community that is integrated in the new infection MPIG Group is formed. 2) How the government's role in optimising the use of geographical indications for new infected communities. This research uses empirical methods of jurisprudence with data collection techniques using observations, interviews and documentation. The conclusion of the results of the discussion in the research showed that: 1) The form of economic benefits made by the people of the village of Tangkit New to increase the revenue of the region is to manage UMKM or home industry by processing pineapple fruit into various kinds of processed products. 2) The role of the Muaro Jambi Government in optimizing the use of Geographical Indications is to provide support in the provision of guidance and training as well as facility assistance.

Abstract

Kegiatan Pengabdian kepada masyarakat bertujuan untuk memberikan pemahaman hukum tentang pentingnya HaKI terhadap karya yang ada pada guru dan siswa di SMK Muhamadiyah Singkut. Adapun capaian yang ingin peroleh dalam kegiatan ini adalah: 1) meningkatan pemahaman mitra tentang hukum; 2) meningkatnya pemahaman mitra tentang HaKI atas hasil karya guru dan siswa 3) meningkatnya kemampuan mitra dalam memilih produk karya yang akan di daftarkan. Pengabdian dilakukan dengan kegiatan sosialisasi dan pendampingan pada karya guru dan siswa, baik pada konsep karya, evaluasi kekaryaan dan pemberkasan permohonan HKI. Tahapan yang dilakukan: 1) Persiapan; 2) Pelaksanaan Program atau Kegiatan; 3) Evaluasi. Hasil Pengabdian ini meliputi: 1) kesadaran pentingnya perlindungan Hak Cipta pada karya yang dihasilkan, 2) teridentifikasi karya yang dimiliki 3) kemauan untuk pengajuan perlindungan hukum pada karya-karya yang dihasilkan dan sertifikat Hak Cipta dari Dirjen Kekayaan Intelektual Kementrian Hukum dan Hak Asasi Manusia.

Abstract

The rise of the Roblox gaming platform within the Metaverse presents new challenges for trademark protection in Indonesia. Users frequently create, trade, and sell virtual goods incorporating well-known marks without authorization, raising concerns about the adequacy of Trademark Act No. 20 of 2016 in addressing digital trademark violations. This study aims to evaluate Indonesia’s legal framework for protecting well-known marks in virtual spaces and assess its effectiveness in preventing unauthorized use on platforms like Roblox. Using a normative juridical approach, the research analyzes the current legal provisions, particularly the scope and interpretation of Articles 1, 21, and 83 of Law No. 20 of 2016, and also identifies normative gaps in addressing violations involving virtual goods and digital environments. The findings reveal that while the Trademark Act provides a foundation for brand protection, it lacks explicit regulations for virtual goods and digital environments, leaving well-known marks vulnerable to misuse. To address these challenges, the study recommends broadening key legal definitions within the Trademark Act and enhancing preventive measures on Roblox, such as stricter verification and enforcement systems. Strengthening Indonesia’s trademark regulations in response to technological advancements is essential to ensure comprehensive intellectual property protection. Theoretically, the study contributes to the discourse on adapting IP law to digital realities. Practically, it offers policy insights for legislators and platforms to prevent misuse of well-known marks in virtual spaces.

Abstract

This study aims to analyze judicial authority in cases of child adoption for Muslims, particularly the conflict between the jurisdiction of the District Court and the Religious Court. Child adoption plays an important role in ensuring the protection and welfare of children, yet in practice it often creates dualism of authority that leads to legal uncertainty. This research applies a normative juridical method with statutory, conceptual, and case study approaches. The findings reveal that District Courts continue to accept and adjudicate adoption cases involving Muslim children based on the Child Protection Law and Supreme Court Circular Letters. However, this practice contradicts Law Number 3 of 2006 on Religious Courts, which explicitly grants absolute authority over adoption cases for Muslims to the Religious Court. This situation results in a normative conflict between general civil law and Islamic family law jurisdiction. Therefore, harmonization of regulations, clearer delineation of judicial authority, and increased judicial awareness are needed to avoid overlapping decisions. The study concludes that legal certainty and optimal child protection can only be achieved if the absolute jurisdiction of the Religious Court is upheld, in line with the principle of lex specialis derogat legi generali.
