Abstract

The purpose of this study was to determine and analyze the factors that encourage people to have underage marriages in Bukit Kerman District, Kerinci Regency. The formulation of the research problem is what factors encourage the community to engage in underage marriages, then the legal consequences arising from underage marriages. To answer these problems, the authors use empirical juridical research methods, namely the type of research used to solve research problems by examining secondary data, namely legislation in this study, which is a regulation on marriage and is supplemented with primary data in the field, which aims to see synchronization between das sollen and das sein. As for the results obtained from this study that what factors encourage the community to engage in underage marriages in Bukit Kerman District Kerinci Regency is the low level of community education, the factor of local community habits that marry off their children at a relatively young age, promiscuity also be the cause of early marriages, and easy to get dispensation from local officials for both parties who have not reached the age set by the Marriage Law. Then the consequences arising from underage marriages are in terms of rights and obligations as husband and wife that cannot be implemented properly, and not achieving the expected marriage goals. Keywors: Underage marriage Abstrak Tujuan penelitian ini adalah untuk mengetahui dan menganilisis faktor-faktor yang mendorong masyarakat melakukan perkawinan di bawah umur di Kecamatan Bukit Kerman Kabupaten Kerinci. Rumusan masalah penelitian adalah faktor apakah yang mendorong masayarakat melakukan perkawinan di bawah umur, kemudian akibat hukum yang di timbulkan dari adanya perkawinan di bawah umur. Untuk menjawab permasalahan tersebut maka penulis menggunakan metode penelitian yuridis empiris yaitu tipe penelitian yang digunakan untuk memecahkan masalah penelitian dengan meneliti data sekunder yaitu Perundang-Undangan yang dalam penelitian ini adalah peraturan tentang perkawinan dan di lengkapi dengan data primer di lapangan, yang bertujuan ingin melihat sinkronisasi antara das sollen dan das sein. Adapun hasil yang di peroleh dari penelitian ini bahwa faktor apakah yang mendorong masayarakat melakukan perkawinan di bawah umur di Kecamatan Bukit Kerman Kabupaten Kerinci adalah rendahnya tingkat pendidikan masyarakat, faktor kebiasaan masyarakat setempat yang menikahkan anak-anak nya di usia yang relatif muda, pergaulan linkugan bebas juga menjadi penyebab dari terjadinya pernikahan dini, serta mudah nya memperoleh dispensasi dari pejabat setempat bagi kedua pihak yang belum mencapai usia yang ditetapkan oleh Undang-Undang Perkawinan. Kemudian akibat yang di timbulkan dari adanya perkawinan di bawah umur adalah dari segi hak dan kewajiban-kewajiban sebagai suami isteri yang tidak dapat terlaksana dengan baik, dan tidak tercapainya tujuan perkawinan yang di harapakan. Abstract

The purpose of this research is to 1. To find out and analyze the distribution system of 3 kg LPG gas to the hands of consumers in Paal Merah District, Jambi City. 2. To understand and analyze legal protection for consumers in obtaining 3 Kg of LPG gas in Paal Merah District, Jambi City. To reveal this problem, the writer uses juridical-empirical research, namely field research with interviews and documentation. The results of this study show that: 1. The distribution system of 3 Kg LPG gas to the hands of consumers in Paal Merah District, Jambi City is not implemented with the distribution channel which should be due to the existence of retailers in the 3 kg LPG gas distribution chain in Paal Merah District, Jambi City. 2. Legal protection for consumers in obtaining 3 Kg of LPG gas in Paal Merah Sub-district, Jambi City is not protected by consumer rights, due to very weak appeals and supervision of the distribution chain. Keywords: Consumer; Protection.   Abstrak Tujuan penelitian ini untuk 1. Untuk mengetahui dan menganalisis sistem pendistribusian gas LPG 3 kg sampai ketangan konsumen di Kecamatan Paal Merah Kota Jambi. 2. Untuk memahami dan menganalisis perlindungan hukum bagi konsumen dalam mendapatkan gas LPG 3 Kg di Kecamatan Paal Merah Kota Jambi. Untuk mengungkapkan persoalan tersebut penulis menggunakan jenis penelitian yuridis-empiris yaitu penelitian lapangan dengan wawancara, dan dokumentasi. Hasil penelitian ini memperlihatkan bahwa : 1. Sistem pendistribusian gas LPG 3 Kg sampai ketangan konsumen di Kecamatan Paal Merah Kota Jambi tidak terlaksana dengan alur jalur pendistribusian yang seharusnya dikarenakan adanya Pengecer dalam rantai pendistribusian gas LPG 3 kg di Kecamatan Paal Merah Kota Jambi. 2. Perlindungan hukum bagi konsumen dalam mendapatkan gas LPG 3 Kg di Kecamatan Paal Merah Kota Jambi tidak terlindunginya hak-hak konsumen, dikarenakan sangat lemahnya imbauan serta pengawasan pada rantai pendistribusian. Abstract

Penelitian ini bertujuan  untuk mengetahui dan menganalisis pengaturan pengalihan objek jaminan fidusia di PT. Astra Credit Companies Kota Jambi, selanjutnya untuk memahami dan menganalisis perlindungan hukum terhadap para pihak apabila terjadi pengalihan utang objek jaminan fidusia di PT. Astra Credit Companies Kota Jambi. Metode yang digunakan adalah yuridis empiris. Hasil penelitian menunjukkan bahwa pengaturan pengalihan objek jaminan fidusia di PT. Astra Credit Companies Kota Jambi bahwa barang yang merupakan jaminan fidusia dialihkan kepada pihak ketiga tanpa melalui sistem resmi dan mendapat persetujuan tertulis terlebih dahulu dari kreditur (pengalihan utang di bawah tangan) dipandang sebagai bentuk cidera janji debitur dalam melaksanakan perjanjian pembiayaan konsumen PT. Astra Credit Companies Kota Jambi, kemudian perlindungan hukum terhadap para pihak apabila terjadi pengalihan utang objek jaminan fidusia di PT. Astra Credit Companies Kota Jambi tidak berjalan sebagaimana mestinya. Karena pengalihan utang objek jaminan fidusia oleh debitur dilakukan secara di bawah tangan. Dari hasil penelitian ini diharapkan Perusahaan Pembiayaan PT. Astra Credit Companies Kota Jambi melakukan sosialisasi atas peraturan pembiayaan kredit dengan jaminan fidusia, sehingga dapat meningkatkan kesadaran konsumen untuk mematuhi Undang-Undang Nomor 42 Tahun 1999 dan Peraturan Pemerintah Nomor 21 Tahun 2015 tentang tata cara pendaftaran jaminan Fidusia. Kata Kunci: Jaminan Fidusia; Pembiayaan Konsumen. This study aims to determine and analyze the transfer of fiduciary security object arrangements at PT. Astra Credit Companies Jambi City, then to understand and analyze the legal protection of the parties in the event of a transfer of debt fiduciary collateral objects at PT. Astra Credit Companies Jambi City. The method used is empirical juridical. The results showed that the arrangement of the transfer of fiduciary collateral objects in PT. Astra Credit Companies of the City of Jambi that goods which are fiduciary guarantees are transferred to third parties without going through an official system and obtaining prior written approval from creditors (transfer of debt under the hand) is seen as a form of default on debtors' promises in carrying out PT. Astra Credit Companies Jambi City, then legal protection against the parties in the event of a debt transfer object fiduciary guarantee at PT. Astra Credit Companies Jambi City is not running as it should. Because the transfer of fiduciary collateral debt objects by the debtor is done underhanded. From the results of this study it is expected that the Financing Company of PT. Astra Credit Companies Jambi City socializes the credit financing regulations with fiduciary guarantees, so as to increase consumer awareness to comply with Law Number 42 of 1999 and Government Regulation Number 21 of 2015 concerning the procedures for registering Fiduciary guarantees. Abstract

This study aims to determine the implementation of the fulfillment and legal protection measures provided by the wood factory company PT. Duren Mandiri Fortuna Jambi to all its workers who have experienced work accidents. The formulation of the research problem is how to fulfill the rights of workers who have experienced work accidents and how the efforts made by PT. Duren Mandri Fortuna in ensuring the safety of workers who are not registered with the Labor Social Security. This study uses an empirical juridical research method by combining direct data from informants through field research to determine the problems that arise in the implementation of legal protection for the employees of PT. Duren Madiri Fortuna Jambi. The things faced by PT. Duren Mandiri Fortuna Jambi in the implementation of legal protection for workers is that there are contract workers, and casual daily workers who are not registered in the Employment Guarantee by PT. Duren Mandiri Fortuna Jambi which causes the workers' rights to be not fulfilled and the company is negligent in carrying out its obligation to register all workers in the work accident insurance. The non-fulfillment factor is waiting for the contract worker for more than 6 (six) months to 1 (one) year of work contract. Abstrak Penelitian ini bertujuan untuk mengetahui pelaksanaan pemenuhan dan upaya perlindungan hukum yang diberikan oleh perusahaan pabrik kayu PT. Duren Mandiri Fortuna Jambi kepada seluruh para pekerjanya yang mengalami kecelakaan kerja. Rumusan masalah penelitian adalah bagaimana pelaksanaan pemenuhan hak para pekerja yang mengalami kecelakaan kerja dan bagaimana upaya yang dilakukan PT. Duren Mandri Fortuna dalam menjamin keselamatan pekerja yang tidak didaftarkan Jaminan Sosial Tenaga Kerja. penelitian ini menggunakan Metode penelitian yuridis empiris dengan menggabungkan data langsung dari informan melalui penelitian lapangan untuk mengetahui masalah-masalah yang timbul dalam pelaksanaan perlindungan hukum terhadap para pekerja PT. Duren Madiri Fortuna Jambi. Hal yang dihadapi pada PT. Duren Mandiri Fortuna Jambi pada pelaksanaan Perlindungan hukum terhadap pekerjanya adalah ada pekerja kontrak, dan tenaga kerja harian lepas yang tidak didaftarkan dalam Jaminan ketenagakerjaan oleh PT. Duren Mandiri Fortuna Jambi yang menyebabkan tidak terpenuhinya hak para pekerja tersebut dan lalainya perusahaan dalam melaksanakan kewajibannya untuk mendaftarkan seluruh pekerja pada Jaminan Kecelakaan kerja. faktor tidak terpenuhinya pemenuhan tersebut adalah dengan menunggu masa kontrak kerja pekerja kontrak lebih dari 6 (enam) bulan sampai 1(satu) tahun kerja.

Abstract

Menjaga kekayaan alam di wilayah kedaulatan dalam laut teritrorial dan hak berdaulat merupakan kewenangan suatu negara terhadap wilayahnya. Kemajuan teknologi dewasa ini telah berkembang jenis-jenis alat penangkapan ikan yang dimaksud untuk mempermudah cara penangkapan dan menghasilkan yang semaksimalkan mungkin, kondisi yang demikian itu apabila tanpa memperhatikan ekologi.   Pemikiran   yang   mengarah   pada   pencegahan   kepunahan   maupun kerusakan lingkungan laut sangat diperlukan disisi lain diperlukan kontrol dalam bentuk pengawasan baik secara sektoral maupun regional. Keadaan geografis Indonesia ditambah potensi perikanan besar telah menumbuhkan gagasan tentang strategi pemberdayaan yang  dikembangkan diantaranya  adalah  meningkatkan posisi tawar nelayan melalui penataan kelompok nelayan, kelembagaan pasar, kelembagaan pelayanan. Strategi tersebut dikembangkan dikembangkan karena berorientasi pada peningkatan kesejahteraan nelayan. Adapun yang menjadi permasalahan dalam penelelitian ini adalah sebagai berikut: Bagaimana implementasi pemberantasan penangkanapan ikan ilegal setelah meratifikasi Agreement On Port StateMeasures To Prevent, Deter, And Eliminate Illegal, Unreported, And Unregulated Fishing. Penelitian ini merupakan penelitian normatif dengan pendekatan penelitian  konseptual dan pendekatan perundang-undangan.

Abstract

The purpose of this article is to study the state’s efforts to guarantee the principle of transparency and implement it into land acquisition process for the sake of public interest. With normative method, this article found that the land, despite of being an object of private ownership, has a social function. Therefore, the state has an authority to regulate the utilisation and use of land for the sake of public interests through a land acquisition. In recent years, disputes due to land acquisition between the government and the land owners has always increased, resulting in the use of violence and public distrust against the government. It is believed that such the condition was triggered by the lack of transparency as long as the land acquisitions are concerned. In order to realize agrarian justice, which is the state’s obligation, it is necessary to guarantee the principle of transparency in the land acquisition process which are the basic rights of land owners / holders and the general public. Because the principles of openness and transparency in the Land Acquisition Law are obscure in norms, it is necessary to interpret the law. The principles of openness and transparency are carried out from the planning, preparation, implementation stages to the stage of submitting the results of land acquisition. At the empirical level, it must be implemented without causing various encapsulation resulting in land acquisition disputes. Abstract

The research aims to explore and analyze legal protection for parties in online loan transaction disputes and alternative dispute resolution through online loan application service networks. The type of research is normative legal research (normative research) using a statutory approach, a conceptual approach, analysis of legal materials is carried out by interpreting and assessing related laws and regulations and selecting relevant legal materials. The research results show that legal protection for parties in transaction disputes through the online loan application service network must be based on an agreement based on mutual agreement with the legal online loan provider and a dispute resolution institution must be determined in the initial agreement, carrying out legal enforcement for unlawful acts committed by the provider. and provide, in principle, this protection to protect the rights of debtors as consumers, resolving disputes in online loan transactions for technology-based loan actors because borrowers still do not know in detail the dispute resolution mechanism, Financial Services Authority Regulation Number 77/POJK. 01/2016 Article 29 letter e only regulates the principle of dispute resolution which is carried out simply, quickly and at low cost, the parties can freely choose a dispute resolution institution that has been recommended by the Financial Services Authority.

Abstract

This article aims at discussing remission granted upon terrorsime convicts. It has been debated among academics as to whether giving remision or reduction of sentence upon the pepertrator of an extra ordinary crime is a wise policy or not. Some of them argue that Indoensia is a country based on law. Any policy, therefore, shall refer to laws which allow remision for any prisoners who have met certain conditions including terrorism convicts. Other academics, however, insist on argument that providing remission to terrorism conficts is nothing but to let to destroy the country for they (the terrorists) might hold radical views which are not recovered with imprisonment. In this article, the authors argue that the laws are still the main reference as long as the legal perspective is concerned. However, as the laws have not provided special regulation for granting remission upon terrrorism convicts, this article proposed to ammend or revisit the laws related to such issue. The revision or ammendmet is urgent in order to provide wiser regulation as long remission upon terrorism convicts is concerned

Abstract

This study was made to criticize the legal force of the Sale and Purchase Binding Agreement (PPJB) of land rights for containing an absolute power clause, which is legal smuggling and is null and void, so that actions due to the Notary's partiality have bad faith in the land sale and purchase agreement violating the Book of Laws. Article 1320 of the 4th Civil Code is a condition for the validity of an agreement, namely a lawful cause. The Sale and Purchase Binding Agreement (PPJB) becomes a prohibited substance of the agreement, causing the authentic deed made by the Notary to become a legally flawed deed. Legal protection for the owner of land rights in which the Sale and Purchase Binding Agreement (PPJB) uses an absolute power clause that is caused as a result of the Notary's partiality to one of the parties, namely the buyer causing a violation committed by the Notary based on Law Number 02 of 2014 concerning amendments to the Law Number 30 of 2014 concerning the position of a Notary in accordance with Article 16 paragraph (1) as well as the responsibilities of a Notary in making a Sale and Purchase Binding Agreement (PPJB) which contains an absolute power of attorney clause, with losses suffered by the owner of land rights or who is known as the seller then the seller can file a civil lawsuit against the Notary who made the authentic deed. Penelitian ini dibuat untuk mengkritisi kekuatan hukum Perjanjian Pengikatan Jual Beli (PPJB) hak atas tanah yang mengandung klausula kuasa mutlak merupakan penyeludupan hukum dan batal demi hukum sehingga perbuatan dikarenakan adanya keberpihakan Notaris memiliki itikad tidak baik dalam kesepakatan jual beli tanah melanggar Kitab Undang-Undang Hukum Perdata Pasal 1320 ke 4 sebagai syarat sahnya suatu perjanjian yaitu sebab yang halal. Perjanjian Pengikatan Jual Beli (PPJB) tersebut menjadi suatu substansi perjanjian yang terlarang sehingga menyebabkan akta otentik yang dibuat oleh Notaris tersebut menjadi akta yang cacat hukum. Perlindungan hukum terhadap Pemilik Hak atas tanah yang Perjanjian Pengikatan Jual Beli (PPJB) menggunakan klausula kuasa mutlak yang disebabkan akibat dari keberpihakan Notaris kepada salah satu pihak yaitu pembeli menyebabkan pelanggaran yang dilakukan Notaris berdasarkan Undang-Undang Nomor 02 Tahun 2014 tentang perubahan atas Undang-Undang Nomor 30 Tahun 2014 tentang Jabatan Notaris sesuai dengan Pasal 16 ayat (1) serta tanggung jawab Notaris dalam pembuatan Perjanjian Pengikatan Jual Beli (PPJB) yang mengandung klausula kuasa mutlak , dengan adanya kerugian yang diderita oleh pemilik hak atas tanah atau yang diketahui sebagai pihak penjual maka pihak penjual dapat mengajukan gugatan perdata terhadap Notaris yang membuat akta otentik tersebut.

Abstract

The purpose of this study was to identify and analyze why there are still many people do not registered their land and the factors that are obstacles in the implementation of land registration in Jambi City. The formulation of the problem is: 1) Why are there still many Jambi City people who have not registered their land rights? 2) What factors are the obstacles in registering land rights in Jambi City? The research method is Empirical Law research, is sourced from primary and secondary data. The results can be concluded: 1) The large number of residents causes the opening of new land due to community needs. The majority of the unregistered land is freehold land obtained through inheritance, grants, tstamentary grants, and buying and selling. 2) Obstacles in registering land rights in Jambi City are: a) Lack of public awareness of law, b) The notion that the land registration process is complicated, c) The assumption that costs are high, d) Lack of public interest in registering their land, e) Lack of socialization from the Jambi City Land Agency Office. To realize the registration of land rights, public awareness is needed. The role of the Jambi City Land Office is to carry out socialization in order to increase legal awareness and eliminate negative stigma. Abtstrak Tujuan penelitian untuk mengetahui dan menganalisis mengapa masih banyak masyarakat yang belum mendaftarkan tanahnya serta faktor yang menjadi kendala dalam pelaksanaan pendaftaran tanah di Kota Jambi. Rumusan masalah adalah : 1) Mengapa masih banyak masyarakat Kota Jambi yang belum mendaftarkan hak atas tanah miliknya?, 2) Faktor apa saja yang menjadi kendala dalam pendaftaran hak atas tanah di Kota Jambi?. Metode penelitian yakni penelitian Hukum Empiris bersumber dari data primer dan sekunder. Hasil penelitian ini dapat disimpulkan : 1) Banyaknya jumlah penduduk menyebabkan terbukanya lahan baru akibat kebutuhan masyarakat. Mayoritas tanah yang belum terdaftarkan tersebut merupakan tanah hak milik yang diperoleh melalui warisan, hibah, hibah wasiat, dan jual beli. 2) Faktor-faktor kendala dalam pendaftaran hak atas tanah di Kota Jambi ialah: a) Kurangnya kesadaran hukum masyarakat, b) Anggapan bahwa proses pendaftaran tanah yang berbelit-belit, c) Anggapan biaya yang mahal, d) Kurangnya minat masyarakat untuk mendaftarkan tanahnya, e) Kurangnya sosialisasi dari Kantor Badan Pertanahan Kota Jambi. Untuk mewujudkan pendaftaran hak atas tanah, maka diperlukan kesadaran masyarakat.
