Abstract

This research aims to reveal the Moluccas local wisdom through the existence of marriage arbitrators among Muslim community in Salahutu, Leihitu, and West Leihitu, Central Maluku. The data were collected through observation and interviews with community leaders, marriage arbitrators and their married sisters and then analyzed descriptively and qualitatively. The research results showed that the marriage arbitrators come from a male distant relative who was appointed by custom as a part of the marriage custom. The appointment aims to strengthen the family relationship between the bride (married sister) and the arbitrator in which they can help each other. Traditionally, an arbitrator serves to help the bride in both material and non-material aspects, particularly in preventing domestic violence. He can become a mediator, peacemaker, and helper of the economic hardship as well as preventing the married sister from psychological domestic violence. Furthermore, he can also provide protection for his married sister from the threat of her husband’s physical violence. This research found that the role of marriage arbitrators as peacemakers in preventing husband’s violence against their married sisters is relevant to hakamain concept in Islamic law as well as the provisions of "safe houses by the community," in Law No. 23/2004.(Tulisan ini bertujuan untuk mengungkapkan peran kearifan lokal saudara kawin  pada masyarakat Muslim di Kecamatan Salahutu, Leihitu dan Leihitu Barat Kabupaten Maluku Tengah. Data dikumpulkan melalui observasi dan wawancara kepada tokoh masyarakat, saudara kawin dan saudari kawin kemudian dianalisis secara deskriptif kualitatif. Hasil penelitian menunjukkan bahwa saudara kawin adalah laki-laki dari kerabat jauh yang diangkat secara adat sebagai bagian dari adat perkawinan. Hal itu bertujuan untuk mempererat hubungan kekeluargaan antara saudara kawin dengan saudari kawinnya di mana keduanya bias saling membantu. Secara adat, saudara kawin bertugas membantu mempelai perempuan (istri) dalam hal material maupun non-material, utamanya untuk mencegah tindak kekerasan dalam rumah tangga si saudari kawin. Saudara kawin bisa berperan sebagai penengah, juru damai, sekaligus membantu kesulitan ekonomi keluarga saudari kawinnya, termasuk mencegah terjadinya kekerasan psikis saudari kawinnya. Lebih jauh, saudara kawin juga bisa berperan melindungi saudari kawinnya dari ancaman kekerasan fisik suaminya. Temuan penelitian ini menunjukkan bahwa peran saudara kawin sebagai juru damai yang mencegah kekerasan suami kepada istri relevan dengan konsep hakamain dalam hukum Islam serta ketentuan ”rumah aman oleh masyarakat,” dalam Undang-undang RI Nomor 23 Tahun 2004)

Abstract

This study examines the role of multicultural education in creating legal awareness of plural societies. Data was collected through library research using a statutory approach (statue approach), a conceptual approach and a comparative approach. The results show that there is a strong relationship between education and legal awareness, where education is the basis for human development with legal awareness, because legal awareness itself is not a scientifically formed condition in humans, however humans have reason as their natural potential to form legal awareness. with the form of knowledge, understanding, attitudes and behavior. The attainment of the system of thinking or reasoning goes through an educational process. Multicultural education itself aims to create legal awareness of plural society as an effort to strengthen the legal system in Indonesia, so that it can create tolerance, understanding and knowledge that takes into account cultural differences, as well as differences and similarities between cultures and their relation to world views, concepts, values, beliefs, and attitudes. Abstract

Tulisan ini berkenan dengan studi Hukum Administrasi mengenai kelayakan operasional Pelabuhan Laskar di negeri batu merah Ambon sebagai Pelabuhan rakyat yang dapat ditetapkan dalam suatu peraturan daerah, asumsi penelitian ini dilatarbelakangi oleh fakta sosial yang menggambarkan keberadaan masa konflik sosial sekitar tahun 2000 hingga sekarang karena dan telah menjadi tumpuan harapan ekonomi kehidupan masyarakat yang memanfaatkan jalur transportasi laut di pelabuhan tersebut, sementara fakta hukum menganggap bahwa aktivitas kepelabuhanan dan pelayaran tersebut dipandang ilegal dan tidak sesuai dengan ketentuan perundang-undangan yang berlaku, Hal ini dimaklumi bahwa areal Pelabuhan, dimensi kapal, dan rute pelayaran telah digolongkan sebagai aktivitas yang harus mendapat perizinan dan pengawasan pemerintah, sementara kapal-kapal tersebut dan aktivitas penemuannya tidak memiliki izin operasional. Untuk dapat menentukan kelayakan operasional Pelabuhan Laskar sebagai pedoman rakyat maka pengumpulan data ini didasarkan atas penelitian lapangan dengan menggunakan pendekatan sosial, atau penemuan hukum berdasarkan fakta sosial. Selanjutnya data dianalisis berdasarkan teori hukum progresif yang mengadopsi pemikiran Roscoe Pound tentang sociological jurisprudence terhadap eksistensi pelabuhan di negeri batu merah Ambon. Dari sudut pandang normatif, sistem operasional atau dan pelayaran tidak memiliki legalitas formal secara administratif, menurut Undang-Undang Nomor 17 Tahun 2008 tentang Pelayaran, Peraturan Pemerintah Nomor 61 tahun 2009 tentang Kepelabuhanan, Peraturan Pemerintah Nomor 20 Tahun 2010 tentang Angkutan di Perairan, Peraturan Menteri Nomor 9 Tahun 2005 tentang Izin Berlayar sedangkan Analisis Sosiologi Hukum, terhadap keberadaan Pelabuhan Laskar dapat dilihat dari dua sisi yakni, sisi kemaslahatan jika keberadaan Pelabuhan Laskar dijadikan sarana perhubungan antar pesisir, sarana rentang kendali dan sarana perekonomian serta pembangunan Desa, dan dari sisi kemudharatan jika Pelabuhan Laskar tidak diakui dan tidak akomodir sebagai sarana terminal laut, dan berpeluang memberikan peluang musibah terhadap putusnya rentang kendali antara masyarakat pesisir dan masyarakat di Kota Ambon, terputusnya ekonomi masyarakat yang hidup di sekitar Pelabuhan Laskar serta menimbulkan bahaya akan adanya kapal-kapal niaga yang tidak memiliki kelaiklautan Pelayaran niaga. Abstract

Settlement of crimes committed by children at the Huamual Police Sector were resolved through a restorative justice approach, in which the legal settlement process took place by bringing the victim and perpetrator (suspect) together to sit in a meeting to talk together, mediator, facilitator, or supervisor. Especially for children who commit criminal acts, restorative justice is important to apply because the child's psychological factors must be considered. In implementing the principle of restorative justice, the victims and their families, the perpetrators and their families, and the parties jointly conduct election deliberations with decisions that are as non-punitive as possible and prioritize solutions by taking into account the best interests of the child, victim and community.Keywords: restorative justice, child crime

Abstract

An innovation in Islamic teaching and preaching, the "Bincang Syariah" Program in Cafes aims to increase Islamic literacy in the community throughout the month of Ramadan. With a focus on young adults and professionals, this program aims to establish a casual and welcoming environment for discussing Islamic law, social concerns, and economics. The implementation strategy involves engaging conversations, brief lectures, and Q&A sessions with academic and Islamic practitioners in cafés. Surveys of participant satisfaction and an examination of the program's influence on their comprehension are used to gauge its efficacy.The program effectively raised participant interest in Islamic studies and broadened access to Islamic literacy in informal public settings, according to the evaluation's findings. This initiative shows that creative delivery techniques may be a successful substitute for community service projects by using a flexible, community-based approach to preaching.

Abstract

This study aims to analyze the implementation of restitution rights for child victims of sexual violence and to identify obstacles and solutions from a victimological perspective. Although Law Number 12 of 2022 concerning Sexual Violence Crimes (UU TPKS) has provided normative reinforcement, the fulfillment of restitution rights in practice still faces significant obstacles. The research method used is normative legal research with a statutory and conceptual approach. The results indicate that the implementation of restitution is still far from ideal due to three main obstacles: normative obstacles related to the complexity of administrative procedures, structural obstacles in the form of law enforcement officials' lack of sensitivity in calculating losses, and substantial obstacles triggered by the perpetrator's financial inability. From a victimological perspective, the failure to execute restitution is a form of secondary victimization by the state. As a solution, this study recommends optimizing the role of the LPSK, activating the Victim Trust Fund mechanism as state compensation for indigent perpetrators, and implementing the seizure of the perpetrator's assets starting from the investigation stage to ensure the certainty of restoring the victim's rights Keywords: restitution, child sexual violence, victimology, victim recovery, UU TPKS

Abstract

Collective violence remains a significant social issue in Ambon City, particularly over the past two years. The increasing intensity and spread of group violence incidents underscore the importance of spatial, temporal, and social analysis in understanding the emerging patterns. This study aims to identify the distribution patterns of locus delicti, temporal trends, and the underlying social motives behind collective violence in Ambon during 2023–2024. This research employed a descriptive qualitative method with data collected through field observations, informal interviews with community members and security personnel, as well as documentation from police reports and local media. The results indicate that collective violence incidents were concentrated in densely populated urban areas, public facilities, and nightlife zones. By 2024, the locus of violence began shifting to suburban and symbolic locations such as Merdeka Square. Temporally, most incidents occurred at night until early morning, coinciding with weakened social control. Contributing criminogenic factors include weak community social control, subcultural violence within village-based youth groups, neglected environments, and the contagion effect of crowds in public spaces. This study concludes that collective violence in Ambon City is driven not only by situational and individual factors but also by environmental conditions, crime opportunities, and collective norms that legitimize violent behavior. This study recommends intensifying nighttime patrols, initiating inter-community youth dialogues, and fostering community-based early warning systems to prevent the escalation of group violence in the future.
