Abstract

Hukum secara filosofis adalah elemen penting yang mengatur kehidupan bermasyarakat, oleh karenanya terdapat di dalamnya nilai-nilai keadilan, perlindungan terhadap HAM, persamaan, kemandirian, kebenaran, kejujuran, kepercayaan dan cinta kasih antar sesama, yang semuanya itu hanya dapat diwujudkan oleh mereka yang mempunyai kesadaran hukum, memiliki kualitas moral yang tinggi, serta berintegritas. Oleh karena itu mewujudkan manusia-manusia yang mampu menghayati dan mengamalkan nilai-nilai hukum tersebut perlu dibangun sejak dini melalui pendidikan. Sebagai sistem sosial, lembaga pendidikan tinggi harus berfungsi dan melakukan perannya dalam mewujudkan perubahan masyarakat menuju ke arah yang lebih baik dalam segala lini, terutama untuk mewujudkan cita-cita hukum. Pendidikan disadari secara alamiah menjadi elemen penting dalam kehidupan manusia. Melalui pendidikan, manusia bisa mengetahui segala hal, di dalamnya terdapat usaha untuk menumbuhkan dan mengembangkan potensi-potensi bawaan, baik jasmani maupun rohani, sesuai dengan nilai-nilai hukum yang ada dan hidup ddalam masyarakat dan kebudayaannya. Tulisan ini mencoba mengkaji dan menemukan konsep hubungan antara Pendidikan dan Kesadaran Hukum serta Urgensinya dalam penguatan suatu sistem hukum dengan menggunakan pendekatan perundang-undangan (statue approach), pendekatan konsep (conceptual approach) dan pendekatan komparatif (comparative approach) Terdapat relasi yang kuat antara, Pendidikan dan Kesadaran Hukum, dimana pendidikan menjadi dasar pembangunan manusia dengan kesadaran hukumnya, karena kesadaran hukum sendiri bukanlah keadaan yang terbentuk secara alamiah pada manusia, namun demikian manusia memiliki nalar sebagai potensi alamiahnya untuk membentuk kesadaran hukum dengan wujud pengetahuan, pemahaman, sikap dan perilaku. Pencapaian sistem berpikir atau daya nalar tersebut melewati sebuah proses pendidikan. Pendidikan dan instrument hukumnya adalah elemen penting seluruh aspek kehidupan bernegara tidak terkecuali untuk mewujudkan sistem hukum yang kuat, baik substansi, struktur, maupun kesadarn hukum masyarakat.

Abstract

Improving legal literacy in society has become an urgent need to prevent the increasing number of investment fraud cases. The lack of public understanding regarding the typology of investment crimes and effective investment management is often exploited by criminals to carry out fraudulent practices. This community service activity aims to provide education on legal literacy, particularly concerning the typology of investment crimes and safe investment management strategies. The methods used include legal socialization, case studies, and investment management training. The results of the activity showed active community participation in understanding the characteristics of illegal investments, such as Ponzi schemes and fraudulent investments, as well as grasping the principles of effective investment. Previously vulnerable to investment scams, the community is now more critical and aligned in selecting investment instruments. This activity is expected to contribute to building a legally aware society, capable of managing finances wisely and protected from the risks of investment crimes.

Abstract

This community service activity aims to increase the awareness of the community around the IAIN Ambon campus regarding the importance of plastic waste management and maintaining environmental cleanliness. Through the Participatory Action Research (PAR) method, students of the Islamic Criminal Law Study Program at the Faculty of Sharia IAIN Ambon acted as facilitators in the socialization and implementation of plastic waste recycling activities. This activity included education on the negative impacts of plastic waste, waste sorting practices, recycled product creation, and waste cleanup actions. The results showed positive changes in community behavior towards the environment and improved students' skills in applying the amar ma'ruf nahi munkar principle. This activity not only had a tangible social impact but also strengthened the application of Islamic values in the context of environmental preservation.

Abstract

This study aims to explore the concept of Restorative Justice and its implementation in laws and regulations in Indonesia. Restorative justice is an approach to resolving criminal cases that prioritizes the restoration of relationships and social harmony rather than punishment. The research method used is a normative legal approach with analysis of primary and secondary legal materials. The results of the study show that the concept of restorative justice has been accommodated in various laws and regulations in Indonesia, such as the 1945 Constitution, Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, Regulation of the Indonesian Prosecutor's Office Number 15 of 2020, and Regulation of the Indonesian Police Number 8 of 2021. The implementation of restorative justice in Indonesia is manifested in the form of diversion, mediation, and termination of prosecution based on restorative justice. This study concludes that the implementation of restorative justice in Indonesia is an effort to create a more humane, inclusive, and sustainable criminal justice system.

Abstract

This paper examines the considerations of Supreme Court (MA) judges in reducing sentences for defendants of corruption crimes in Indonesia. The problem in this paper is what are the considerations of Supreme Court judges in reducing sentences for defendants of corruption crimes juridically. This research uses a juridical method by analyzing relevant theories, concepts, and laws and regulations. The results show that the judge's consideration is based on the good character of the defendant, the social impact, and the facts of the trial, referring to Law Number 48 of 2009 and Law Number 8 of 1981. Edhy Prabowo's case shows that the sentence reduction does not reflect public justice, on the contrary, Idrus Marham's case shows weakness due to the sentence reduction received.

Abstract

Unclear criminal liability regulations for limited liability companies are the main obstacle in eradicating criminal acts committed by limited liability companies. This study focuses on the study of the urgency of regulating criminal liability for limited liability companies in their business activities through a criminology approach. The criminology study in this study uses several theories such as Strain Theory, Social Control Theory, Opportunity Theory, and Work Ethic Theory to analyze the factors that encourage limited liability companies to commit crimes. This study uses a normative legal research method that is descriptive analytical with a statutory approach, case approach, and conceptual approach. The results of the study conclude that the regulation of criminal liability and the imposition of criminal penalties on limited liability companies is urgent because the current regulation of criminal liability has not been able to fulfill the objectives of the law, namely certainty, justice, and benefit, and is a legacy of the colonial era that does not recognize limited liability companies as subjects of criminal law. As an update, Law Number 1 of 2023 seems to be able to answer the challenge of the urgency of criminal liability for limited liability companies as subjects of criminal law, which is stated in Articles 45 to 50 which regulate corporate criminal liability.

Abstract

  One of the indigenous communities in Maluku that faces a number of legal issues in their daily lives is the Huaulu community. This study employs a socio-legal method to identify important legal concerns and advocacy tactics that can assist the Huaulu people in more fairly and equally obtaining their rights. According to the mapping results, the Huaulu community still faces social stigma, restricted educational opportunities, civil administration obstacles, and inequalities in legal protection, all of which have a substantial influence on their rights as citizens. A community service program was put in place as a remedy to deal with these problems. The purpose of this article is to identify the legal issues that the Huaulu community faces and provide community-based remedies through activism, legal education, and administrative support. The report aims to support Indonesia's acknowledgment and defense of indigenous rights by combining policy recommendations with legal empowerment.

Abstract

An innovation in Islamic teaching and preaching, the "Bincang Syariah" Program in Cafes aims to increase Islamic literacy in the community throughout the month of Ramadan. With a focus on young adults and professionals, this program aims to establish a casual and welcoming environment for discussing Islamic law, social concerns, and economics. The implementation strategy involves engaging conversations, brief lectures, and Q&A sessions with academic and Islamic practitioners in cafés. Surveys of participant satisfaction and an examination of the program's influence on their comprehension are used to gauge its efficacy.The program effectively raised participant interest in Islamic studies and broadened access to Islamic literacy in informal public settings, according to the evaluation's findings. This initiative shows that creative delivery techniques may be a successful substitute for community service projects by using a flexible, community-based approach to preaching.

Abstract

The rapid growth of online marketplaces in Indonesia has brought significant economic opportunities but also posed new challenges in the realms of criminal law and criminology. This study aims to analyze online marketplace crimes from a criminological perspective and examine the development of Indonesia's criminal law to address these challenges. Utilizing a qualitative approach with a literature review method, this research explores various types of online marketplace crimes, including fraud, identity theft, intellectual property violations, and tax evasion. The study applies criminological theories such as Strain Theory, Rational Choice Theory, Routine Activity Theory, Social Control Theory, and Social Learning Theory to understand the motivations and behaviors of offenders in digital transactions. The findings indicate that the legal framework in Indonesia, including the Electronic Information and Transactions Law (UU ITE) and Consumer Protection Regulations, still contains gaps that allow cybercriminals to exploit marketplace platforms. Therefore, this study suggests strengthening legal harmonization, enhancing consumer protection, improving tax regulations, and implementing effective law enforcement strategies. By integrating criminological insights into legal reforms, Indonesia can create a safer and more just online marketplace environment, contributing to sustainable digital economic development.

Abstract

Modern legal thought is often dominated by the positivism school, which emphasizes legal certainty through written rules and formal procedures. However, this approach often overlooks the substantial aspect of justice, namely the sense of justice that lives within society. Fransiscus Budi Hardiman, in his work Melampaui Positivisme dan Modernitas (Beyond Positivism and Modernity), offers sharp criticism of formal justice that focuses solely on legality without considering morality and human values. This study aims to analyze Hardiman’s thoughts in the context of criticism against positivism and its impact on legal life in Indonesia. Using a philosophical approach and a qualitative-descriptive method, this study finds that Hardiman encourages a reinterpretation of law that is not only legal-formal but also humanistic and contextual. This perspective is relevant in addressing various legal cases in Indonesia, which often reveal a gap between legal decisions and the public's sense of justice. This study is expected to contribute to the development of a legal theory that is more responsive and adaptive to social dynamics.
