Abstract

Salah satu terobosan dibidang kedokteran yang sedang marak di masyarakat adalah operasi peremajaan vagina yang biasa disebut dengan vaginoplasty. Tujuan utama dari vaginoplasty adalah untuk mempercantik tampilan vagina sekaligus mengencangkan kembali otot-ototnya yang telah longgar. Perawatan organ intim ini tidak hanya dilakukan oleh wanita dewasa yang telah berumah tangga, tetapi juga remaja atau perempuan yang belum menikah akibat pernah melakukan hubungan intim, ataupun menjadi korban perkosaan. Adanya fenomena baru ini, maka akan melahirkan suatu hukum dan aturan baru yang mengaturnya. Mengingat fenomena ini belum pernah terjadi dimasa Rosululloh, maka maka penulis tertarik untuk melakukan penelitian untuk mengetahui hukum vaginoplasty dalam presfektif hukum Islam dan undang-undang kesehatan. Metode yang dilakukan penulis adalah dengan melakukan studi kepustakaan dengan merangkum berbagai pendapat ulama dan foqoha dalam menafsirkan dalil-dalil naqli, baik qur’an atau hadits yang ada kaitannya dengan vaginoplasty. Sedangkan untuk mengetahui bagaimana perspektif undang-undang Kesehatan Republik Indonesia terhadap vaginoplasty, maka penulis pencoba mengelaborasi Undang-undang nomor 17 tahun 2023 tentang Kesehatan, khususnya berkaitan dengan masalah  kesehatan reproduksi. Kesimpulan dari penelitian ini adalah dalam perspektif hukum Islam, vaginoplasty bisa dibolehkan manakala tujuannya untuk menutup aib, atau melindungi keluarga. Serta tidak boleh dilakukan jika hanya untuk mempercantik diri, merubah ciptaan Alloh, berbuat zina dan hal jelek lainnya. Adapun vaginoplasty dalam perspektif Undang-undang Kesehatan, dapat disimpulkan bahwa vaginoplasty diperbolehkan jika dilakukan sebagai pemulihan kesehatan atas tindak pidana seksual, tidak bertentangan dengan norma agama serta peraturan pemerintah.

Abstract

The breakup of marriage is a permissible act, but Allah SWT does not like such a decision. In the implementation of the sakinah mawaddah and rahmah family, it is quite difficult to carry out but it is not impossible to do. The serious problem is how when a family can no longer be harmonized again to exercise rights and obligations proportionately, and whether it must end in a divorce that is hated by God. This research focuses on husband and wife to remain harmonious when carrying out obligations and rights that benefit from the perspective of KHI. This study uses a comprehensive literature study methodology based on normative legal research presenting data and facts from the perspective of compilation of Islamic law and socio-cultural phenomena of society. KHI has an important role in a legal decision process because KHI is sourced from 13 books that are complete and in accordance with the socio-cultural nature of the Indonesian state and then with the nature of Islamic law that is flexible so that it can adapt to the dynamic development of the times. Although there are several KHI rules that need to be updated, such as the tendency towards patriarchal culture because it has been a long time when it was formed, namely 33 years, it is used as a reference by legal subjects so that it can be more up-to-date again when used in more contemporary legal cases in the future.

Abstract

The result of the breakdown of marriage is often a dispute over joint property. Article 97 KHI regulates the division of joint property with each party half a share. However, the reality in the field is not always the case, as in Decision Number 1349/Pdt.G/2023/PA.Bm the judge decided to divide it not equally, namely 40% for the husband and 60% for the former wife. The size of the ex-wife's share is because the ex-husband does not carry out his obligations as head of the family, namely providing maintenance. The difference in the percentage of the division of joint property makes the author interested in researching the decision. This research is a type of normative research with library research. Primary data sources are obtained from decision number 1349/Pdt.G/2023/PA.Bm and secondary data comes from books, journals, and so on. Data collection techniques using literature study with descriptive data analysis. The results of the study state that Decision Number 1349/Pdt.G/2023/PA.Bm according to the author is not in accordance with the theory of distributive justice initiated by Aristotle because the Defendant (ex-wife) who has a double burden as a housewife and works to earn a living does not get her rights as she should.Keywords :  joint property, family maintenance, distributive justice

Abstract

This research aims to analyze the law on the elimination of domestic violence (PKDRT) in Tahir Mahmood's contemporary family law relations. Related to the methodology used in this research is normative juridical using qualitative data types of library research and content analysis using a descriptive analysis approach method. The results of the study show that victims of criminal acts of domestic violence are not unwilling to report the crimes of the perpetrators, but there are external forces that prevent them from reporting, one of which is the moral burden on the family and the patriarchal culture is still quite thick. Then law enforcement officials need to provide penalties that provide a deterrent effect to perpetrators of domestic violence in the process of implementing regulations so that the same mistakes are not repeated because if it ends in a peaceful way and is resolved in a family manner, there will be no significant results in providing security to victims because it is not justified regarding the implementation of Law number 23 of 2004 concerning PKDRT. Tahir Mahmood's methodology is one of the steps to reform the PKDRT law because it is in accordance with the situation of maslahat conditions and is relevant to the Indonesian state.

Abstract

Studies of ḥadīth on family law in contemporary Islamic discourse frequently become trapped in ahistorical and literalistic approaches. This tendency can be seen in the reading of ḥadīths related to polygamy, divorce, child marriage, and wifely obedience, which are often reduced to mere normative legitimization without considering historical context, maqāṣid al-sharīʿah, and the challenges of modern families. This article proposes a new framework called HERMES (Hermeneutic Resonance of Muslim Family Ethics and Sharīʿah) as an alternative paradigm. HERMES emphasizes that ḥadīth is not merely a static text, but a living resonance of prophetic values that interacts across time. This study employs a qualitative approach using library research and critical-hermeneutic analysis. The data are drawn from primary sources in the form of classical ḥadīth collections and their commentaries, as well as secondary sources consisting of contemporary studies on family law, maqāṣid al-sharīʿah, and modern hermeneutical theories. The analysis combines an ahistorical critique of literalistic interpretations with a transdisciplinary construction involving sociology, psychology, and the philosophy of law. HERMES is structured around four dimensions: (1) hermeneutic resonance, namely historical–contextual reading; (2) ethical resonance, which involves extracting the values of justice, compassion, and public benefit (maṣlaḥah); (3) social resonance, which connects ḥadīth with contemporary issues such as digital divorce, child marriage, and domestic violence; and (4) sharīʿah resonance, which reaffirms maqāṣid as the primary objective of family law. Through this approach, the article demonstrates that HERMES can serve as an epistemological foundation for reformulating Islamic family law to be more adaptive, just, and relevant.
