Abstract

It becomes clear from the examination of consumer protection offenses connected to fiduciary assurance agreements that an agreement, though a civil law document, might have a criminal component. Article 62 of Law Number 8 of 1999 concerning Consumer Protection, notably Article 18, about the provisions of standard clauses, contains information on the criminal implications of fiduciary guarantee agreements. Articles 35 and 36 of Law Number 42 of 1999 concerning Fiduciary Guarantees detail additional criminal issues. In light of this criminal component, the Consumer Dispute Settlement Agency (BPSK), an organization established under the Consumer Protection Law, is tasked with monitoring the incorporation of standard clauses and notifying the public prosecutor of any infractions of the law's provisions. Investigators typically connect it to the crimes of embezzlement and document forgery. The problem statement, "What is the Relationship between the Fiduciary Guarantee Law and the Consumer Protection Law?" is based on this background information. "How do the criminal provisions of articles 263 and 372 of the Criminal Code in fiduciary agreements from the perspective of the Consumer Protection Law?" is, of course, related to this relationship. Normative research methodology combined with a survey of the literature. An summary of the connections between consumer law, criminal law, and fiduciary guarantee agreements is presented in this journal's conclusion

Abstract

Air transportation has now developed rapidly so that many new airline companies are providing air transportation services and more and more people are using airplane services. In this case, there is still a lot of attention needed from the airline related to passenger rights which until now are still not considered in the schedule which results in flight delays for passengers. In this study, the researcher uses a normative juridical method by examining Law Number 1 of 2009, Regulation of the Minister of Transportation Number 89 of 2015 and Law Number 8 of 1999 and other legal journals. The researcher in this case carried out a descriptive analysis approach that aimed to examine related to legal protection for aviation consumers who experienced flight delays. The form of legal remedies taken in this dispute can be carried out inside or outside the court so that the liability of the airline can apply to the maximum. Responsibility in this case adopts the principle of presumption of liability.

Abstract

Transaksi jual beli E-Commerce adalah suatu proses meliputi produksi, ditribusi, pemasaran, penjualan dan pengiriman barang serta jasa melalui Elektronis. Artinya adanya pihak antara penjual dan pembeli atau pihak-pihak lainnya dalam hubungan kontrak yang menggunakan media elektronik atau digital yang dalam prosesnya tidak diperlukan temu muka dan transaksi dilakukan secara lintas batas. Terkait dengan perlindungan hukum yaitu sebagai suatu upaya untuk melindungi kepentingan individu atas kedudukannya sebagai manusia yang mempunyai hak untuk menikmati martabatnya, dengan memberikan kewenangan padanya untuk bertindak dalam rangka kepentingannya tersebut. Oleh karena itu dalam perlindungan hukum bagi konsumen dalam transaksi jual beli online dapat dilakukan melalui sarana preventif dan represif.
