Abstract

Peradilan agama di Indonesia telah mengalami perkembangan signifikan sejak era reformasi dengan pendirian Mahkamah Agung Republik Indonesia (MA) bidang Peradilan Agama pada tahun 2003. Meski demikian, konsistensi putusan perkara syariah masih menjadi isu yang perlu diperhatikan, dipengaruhi oleh perbedaan interpretasi hukum Islam, keberagaman budaya, kualitas hakim, dan keterbatasan sumber daya. Penelitian ini menggunakan metode hukum normatif dengan pendekatan yuridis-normatif untuk mengidentifikasi faktor-faktor yang menyebabkan inkonsistensi putusan, menganalisis peran MA dalam menjaga konsistensi putusan, serta merumuskan rekomendasi untuk meningkatkan konsistensi putusan. Hasil penelitian menunjukkan bahwa inkonsistensi putusan perkara syariah di Indonesia disebabkan oleh faktor hukum seperti perbedaan interpretasi hukum Islam antar mazhab, keberagaman budaya, kualitas hakim yang bervariasi, dan keterbatasan sumber daya, serta faktor non-hukum seperti tekanan sosial dan politik, ketidakjelasan aturan dan prosedur, serta kurangnya koordinasi dan kerjasama antar lembaga peradilan agama. Untuk mengatasi masalah ini, diusulkan solusi berupa peningkatan kualitas hakim melalui pendidikan dan pelatihan, pengembangan pedoman teknis dan petunjuk pelaksanaan yang lebih komprehensif, penguatan koordinasi dan kerjasama antar lembaga peradilan agama, serta peningkatan sosialisasi dan edukasi kepada masyarakat tentang hukum Islam. Mahkamah Agung memiliki peran penting dalam menjaga konsistensi putusan perkara syariah melalui mekanisme seperti pembinaan dan pengawasan hakim, memutus perkara kasasi, menetapkan pedoman teknis dan petunjuk pelaksanaan, serta koordinasi dan kerjasama dengan lembaga terkait, yang didasarkan pada dasar hukum yang tercantum dalam Undang-Undang Nomor 5 Tahun 2004 tentang Mahkamah Agung dan Undang-Undang Nomor 3 Tahun 2006 tentang Peradilan Agama, serta Kompilasi Hukum Islam (KHI). Oleh karena itu, penelitian ini diharapkan dapat memberikan kontribusi bagi upaya peningkatan kualitas peradilan agama di Indonesia melalui peran MA dalam menjaga konsistensi putusan perkara syariah.

Abstract

Religious justice in Indonesia has developed since the reform era with the establishment of the Supreme Court (MA) of the Republic of Indonesia in the field of Religious Justice in 2003. However, the consistency of sharia rulings is still a concern due to differences in the interpretation of Islamic law, cultural diversity, the quality of judges, and limited resources. This study uses normative legal methods to identify factors that cause inconsistencies in decisions, analyze the role of the Supreme Court, and formulate recommendations. The results show that the inconsistency of the decision is influenced by legal and non-legal factors. To overcome this, it is necessary to improve the quality of judges, develop technical guidelines, and improve coordination between religious judicial institutions. The Supreme Court plays an important role in maintaining the consistency of sharia case decisions with judge guidance, technical guidelines, coordination, and cooperation with related institutions. Hopefully this research can help improve the quality of religious justice in Indonesia through the Supreme Court.

Abstract

The growth of the sharia capital market in Indonesia reflects increasing investment interest based on sharia principles that emphasize justice, transparency, and ethical investment. The sharia capital market presents a unique appeal amid global economic uncertainty, offering greater stability compared to conventional markets. This study aims to analyze the role of sharia as a catalyst for the growth of market capitalization in sharia indices on the Indonesia Stock Exchange (IDX). The research methodology uses a literature review method by analyzing secondary data and relevant theories from publications by the Financial Services Authority (OJK) and previous research. The findings show that Indonesia’s sharia capital market has experienced significant capitalization growth despite challenges such as economic crises and the pandemic. Several sharia indices, such as the Jakarta Islamic Index (JII) and the Indonesia Sharia Stocks Index (ISSI), have recorded long-term upward trends, supported by restrictions on speculation and the prohibition of riba practices. Regulatory support from OJK, particularly through policies that expand the scope of the Sharia Securities List (DES), further strengthens this growth. The year-to-year increase in the number of sharia stocks indicates market resilience and growing public awareness of sharia-based investments. With promising prospects, the sharia capital market in Indonesia is expected to continue to develop as a catalyst in market capitalization, positively contributing to the national economy through productive capital flows aligned with sharia values.

Abstract

This study examines the perspectives of the Indonesian Ulema Council (MUI) and Nahdlatul Ulama (NU) regarding Multi-Level Marketing (MLM) practices, focusing on the alignment with Islamic principles. MLM has gained popularity as a business model, but its compatibility with Islamic law has been debated, particularly concerning practices such as recruitment-based commissions and the potential for exploitation. This research uses a qualitative approach, analyzing fatwas and official statements from MUI and NU, as well as examining Islamic legal frameworks to assess the permissibility of MLM. The study finds that while MUI permits MLM under certain conditions, NU takes a stricter stance, condemning MLM that resembles pyramid schemes. The research highlights key elements that must be observed for MLM to comply with syariah, including transparency, fairness, and product legitimacy. The findings suggest that both organizations stress the importance of ethical practices in MLM, with the need for better regulation and public education to avoid exploitative systems.

Abstract

Sharia-based Multi-Level Marketing (MLM) is increasingly developing as a business alternative that aligns with Islamic economic principles. However, challenges remain in ensuring compliance with these principles and their impact on distributor performance. This study aims to analyze the influence of compliance with Islamic economic principles on the performance of distributors at HNI Bekasi Timur Branch. The Islamic economic principles examined include interest-free transactions, honesty in promotion, price transparency, contract compliance, and fairness in profit distribution. This research employs a quantitative method with a simple linear regression approach. Data were collected through questionnaires distributed to HNI Bekasi Timur Branch distributors, and their validity and reliability were tested. The results indicate that compliance with Islamic economic principles significantly affects distributor performance, with an R Square value of 0.587, meaning that 58.7% of the variation in distributor performance can be explained by the variable of compliance with Islamic economic principles. The positive regression coefficient (B = 0.745, p = 0.000) shows that the higher the compliance with Islamic economic principles, the better the distributor performance. A significant F-test (p = 0.000) also indicates that the model used is valid in explaining the relationship between the two variables. Thus, the application of Islamic economic values in business strategies has been proven to enhance the performance and competitiveness of sharia-based MLM distributors.
