Abstract

The designation of armed criminal groups (KKB) in Papua as a terrorist group/organization raises pros and cons because the KKB has so far been identified with the West Papua National Liberation Army (TPNPB-OPM), which is one of the armed separatist movements in Papua. The determination is motivated by violence and or armed violence carried out by the KKB which has political, ideological, and security motives, where these three motives are elements in criminal acts of terrorism. Meanwhile, according to the author, the policy carried out by the Government of Indonesia is a re-criminalization. By using the normative juridical method, the authors conclude that the determination of the KKB as a terrorist group/organization is the right policy of the Indonesian government. Based on the three motives above, the KKB can be categorized as an ethno/nationalist separatist terrorism.

Abstract

Indonesia selama ini menanggulangi kejahatan terorisme bertumpu pada model pendekatan bersifat lunak dan keras. Pendekatan lunak dilaksanakan oleh BNPT RI bersama kementerian/lembaga terkait serta melibatkan unsur masyarakat. Pendekatan keras dilakukan oleh Polri dalam rangka penegakan hukum, bersama TNI. Perkembangan modus operandi kejahatan terorisme menuntut Indonesia dimasa depan untuk merumuskan model pendekatan baru yang didasarkan atas skala ancaman kejahatan terorisme terhadap keamanan nasional. Model “pendekatan cerdas” berupa soft-medium-hard dapat menjadi rujukan untuk batasan skala ancaman serta bentuk penanggulangan seperti apa dan bagaimana untuk menanggulangi kejahatan terorisme. Tulisan ini bertujuan mengetahui apa kebijakan kriminal Indonesia selama ini dalam penanggulangan terorisme dan menganalisis bagaimana kebijakan kriminal Indonesia menanggulangi terorisme di masa depan. Artikel ini berkesimpulan bahwa, pertama, selama ini Indonesia menggunakan kebijakan kriminal untuk menanggulangi kejahatan terorisme dengan dua model pendekatan, yaitu: bersifat lunak dan keras. Kedua, untuk masa depan, penanggulangan kejahatan terorisme dengan kebijakan pidana idealnya menggunakan pendekatan cerdas yang terdiri dari tiga model yaitu soft-medium-hard. Pendekatan soft dilakukan oleh BNPT RI, pendekatan medium oleh Polri-TNI, dan pendekatan hard oleh TNI-Polri. Kata kunci: Kebijakan Kriminal, Penanggulangan Terorisme, Pendekatan Cerdas

Abstract

Densus 88 AT is a special police unit that has the duty and authority to enforce the law on criminal acts of terrorism. As law enforcers, Densus 88 AT has the authority to carry out the arrest of suspected terrorists based on Law No. 5/2018. Based on the theory of law enforcement by Joseph Goldstein, law enforcement is divided into three areas, namely: total enforcement, full enforcement, and actual enforcement. This paper is a law-normative research which aims to identify and understand the arrest of suspected terrorists by Densus 88 AT from the perspective of law enforcement by Joseph Goldstein. The conclusions are as follows: the status of a suspect is unknown in the Indonesian Criminal Code; Densus 88 AT has the authority to arrest suspected terrorists based on RI Law Number 5 of 2018; and in the three areas of law enforcement, Densus 88 AT has discretionary power in three areas of discretion, namely: choosing objectives, intervention methods, and field procedures.

Abstract

Youth is an important figure of the national movement because youth are the pillars of national development and the future State of Indonesia. However, one of the problems facing Indonesia today is the involvement of youth in radicalism and terrorism. Answering this problem, this research uses normative juridical research methods with a statutory and conceptual approach. This research shows the need for the role and responsibility of youth in tackling radicalism and terrorism. The active role of youth is a reflection of moral strength, social control and agents of change in the development of the nation and the State of Indonesia, while the responsibility of youth can be carried out with masohi militancy efforts. Masohi militancy is a youth attitude that reflects resilience, enthusiasm and passion to cooperate with each other in tackling radicalism and terrorism in Indonesia which is realized through “Panca-P” namely Pembangunan kepemudaan, Pelayanan kepemudaan, Penyadaran pemuda, Pemberdayaan pemuda and Pengembangan pemuda (Youth Development, Youth Services, Youth Awareness, Youth Empowerment, and Youth Development).

Abstract

Masih adanya anak yang menjadi korban kekerasan seksual menunjukkan bahwa penerapan sanksi pidana pada pelaku kekerasan seksual seperti yang diatur dalam KUHPidana belum berjalan efektif. Pada tahun 2022 Pemerintah sudah mengesahkan Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual yang pengaturannya lebih jelas dan rinci. Sebagai bagian peningkatan pemahaman Siswa-Siswi SMA Santa Maria Cirebon tentang keberlakukan Undang-Undang Tersebut maka perlu dilakukan sosialisasi dalam bentuk penyuluhan hukum secara daring dan hal ini juga dikaitkan dengan  proyek penguatan profil pelajar Pancasila SMA Santa Maria Cirebon. Tahapan yang dilakukan adalah dengan tahapan pemaparan dari narasumber, tanya jawab, dan pemaparan resume dari siswa-siswi SMA Santa Maria Cirebon sebagai bagian untuk melihat tingkat pemahaman terhadap materi yang sudah disampaikan oleh narasumber. Setelah dilakukan pemaparan tentang definisi, jenis, dan sanksi kekerasan seksual, berdasarkan hasil pemaparan resume siswa-siswi SMA Santa Maria Cirebon ternyata mereka memahami bahwa kekerasan seksual merupakan tindak pidana, sehingga harus diwaspadai terjadinya dan jika menjadi korban atau melihat orang lain menjadi korban kekerasan seksual harus berani untuk melaporkan ke pihak kepolisian dengan bukti-bukti yang kuat untuk menindak tegas pelaku

Abstract

The purpose of the text is to examine the issue of homosexual act committed by by TNI member from a human rights perspective. The research used is doctrinal legal research. The results of this study can be concluded that homosexsual act commited by TNI member is contrary to article 281 paragraph (1) of the KUHP. In additiaon especially in TNI internal regulations include the telegram of the TNI commander number ST/398/2009 Jo. ST/1648/2019 as emphasized in the supreme court circular letter number 10 of 2020. Homosexsual act also contarty with the human rights in Indonesian as stated in article 28 J paragraph (2) of the UUD 1945 Jo. Article 70 UU HAM. The limitations on the application of human rights that apply in Indonesia are based on considerations of moralitry, security and public policy in a democratic society, so that homosexsual act coomited by TNI members is a contrary toi the provisions of the law that are upheld so that actions coomited by TNI member must be dealt with firmly.
