Abstract

The mining business is a business that has the most layers of regulations. This is because in addition to the various types of mining, it is also because the mining processing process is so complex. Judging from the legal review, the mining regime has experienced very significant changes. At that time, the mining regime used a contract of work model between mining companies and the government, both local and central government. In practice, contracts of work provide opportunities for mining companies to control mining areas for a certain period of time. At this time the mining regime is the licensing regime. This was marked by the issuance of Law No. 4 of 2009 concerning Minerba. Based on the law, the relationship between mining companies and the government is no longer a partner relationship, but rather a government administration relationship. In the process of perfecting the legal system, in 2022, the government will again issue a regulation regarding the delegation of authority from the central government to regional governments with regard to the management of mineral and coal mining. This Government Regulation is considered very appropriate and effective. Mining of non-metallic minerals and coal involves many small-scale mining companies or small-scale mining companies. So it is hoped that permit arrangements will be adjusted to the needs of small-scale mining

Abstract

Indonesia's potential membership to BRICS, a coalition of prominent rising economies, presents substantial ramifications for international trade legislation and domestic regulatory structures. The research adopts a normative legal approach, employing statutory, conceptual, and comparative methodologies to examine primary legal sources, including international trade agreements, Indonesian trade regulations, and BRICS policies, alongside secondary sources such as academic articles and case studies. The principal findings indicate that Indonesia's participation in BRICS may augment its trade prospects by providing access to expansive markets and cooperative economic endeavours. Nonetheless, it presents obstacles, especially in harmonizing domestic trade regulations with BRICS' unified objectives and guaranteeing sufficient legal safeguards for local enterprises against heightened competition. The study concludes that Indonesia must strategically amend its trade legislation to reconcile international obligations with national interests, advocating for the creation of strong legal protections, enhancement of domestic enterprise capabilities, and proactive involvement in formulating BRICS trade policies to optimize advantages while minimizing risks. This paper enhances the discussion on the convergence of international trade law and domestic legal systems within the framework of growing economic alliances.

Abstract

Penelitian ini membahas kewarganegaraan ganda seumur hidup, relevansinya di Indonesia, dan masalah perlindungan hukum pada anak hasil perkawinan campuran. Berdasarkan Pasal 6 UU No. 12 Tahun 2006 tentang Kewarganegaraan, Indonesia menganut prinsip kewarganegaraan tunggal, sehingga kewarganegaraan ganda seumur hidup sulit diterapkan di Indonesia. Namun, kewarganegaraan ganda terbatas dapat diberlakukan pada anak hasil perkawinan campuran sampai usia 18 tahun yang kemudian dapat diperpanjang selama 3 tahun untuk menghindari terjadinya status tanpa kewarganegaraan. Masalahnya adalah Undang-Undang Kewarganegaraan tidak dapat melindungi hak asasi anak yang lahir dari suatu perkawinan campuran seperti status kewarganegaraan. Penelitian ini menggunakan metode penelitian yuridis normatif dengan pendekatan penelitian berupa pendekatan normatif dan spesifikasi penelitian deskriptif analitis. Hasil penelitian menunjukkan bahwa negara wajib memenuhi serta melindungi hak warga negaranya, termasuk hak atas status kewarganegaraan anak hasil perkawinan campuran yang merupakan bagian yang tidak dapat terpisahkan dari konsepsi hak asasi manusia yang tertuang dalam konstitusi UUD NRI 1945. Oleh karena itu, diperlukan revisi Pasal 6 ayat (1) Undang-Undang No. 12 Tahun 2006 tentang Kewarganegaraan agar hak sebagai warga negara Indonesianya bisa dilindungi seumur hidup. Diharapkan Lembaga Pemerintah seperti KBRI, Kemendagri, Dinas Kependudukan Pencatatan Sipil dan Kementerian Hukum dan HAM berintegrasi untuk saling mengkaji data antar instansi ketersediaan data dan dokumen, serta verifikasi status kewarganegaraan terkait perkawinan campuran untuk mempermudah proses pendaftaran serta pemberian fasilitas keimigrasian terhadap anak-anak perkawinan campuran yang ada di dalam dan di luar negeri. Penelitian ini memberikan kontribusi pada pemahaman konsep perlindungan hukum pada anak hasil perkawinan campuran dalam menjamin hak asasi manusia dimasa yang akan datang.

Abstract

Desentralisasi merupakan salah satu mekanisme utama dalam pengelolaan negara kesatuan untuk menjaga keseimbangan antara stabilitas nasional dan kebutuhan otonomi lokal. Indonesia dan Jepang, meskipun sama-sama negara kesatuan, menerapkan model desentralisasi yang berbeda dengan latar belakang historis, politik, dan budaya yang khas. Artikel ini bertujuan membandingkan pola hubungan pusat–daerah di Indonesia dan Jepang dengan menekankan aspek regulasi, struktur pemerintahan, dan mekanisme fiskal. Metode penelitian yang digunakan adalah studi literatur dengan pendekatan komparatif. Hasil pembahasan menunjukkan bahwa Indonesia menekankan desentralisasi politik dan administratif melalui pemberian kewenangan luas kepada daerah, sementara Jepang lebih menekankan efisiensi dan stabilitas fiskal dalam kerangka local autonomy law. Studi ini menegaskan bahwa keberhasilan desentralisasi tidak hanya ditentukan oleh peraturan hukum, tetapi juga kapasitas birokrasi, budaya politik, dan konsistensi pengawasan pusat.

Abstract

Cooperatives in the Indonesian economic system function as one of the efforts to achieve national development goals, namely creating a just and prosperous society in accordance with the principles of Pancasila and the 1945 Constitution. The legal basis of cooperatives in Indonesia is regulated by Law Number 25 of 1992 concerning Cooperatives. The purpose of this research is to study the development of cooperative law in Indonesia as an alternative to economic empowerment of rural communities, and analyse the legal construction of cooperatives as an alternative to economic empowerment of rural communities in Indonesia. This research is a normative legal research with a legislative approach and conceptual approach. The results show that the weaknesses in Law No. 25/1992 on Cooperatives, such as the unclear definition of cooperatives, unfulfilled principles, and lack of strict sanctions, indicate that the regulation needs to be reconstructed to address the existing problems and increase public trust in cooperatives. Thus, the reconstruction of Law Number 25 of 1992 on Cooperatives will not only improve cooperative governance, but also make a significant contribution to the economic empowerment of communities in Indonesia, especially in rural areas.
