Abstract

This study aims to understand the essence of community participation in various stages of a sand mining business permit in Sidenreng Rappang Regency. This research was conducted using an empirical legal research method with data collection techniques through interviews, documentation studies, and data recording directly related to the research problem. The results of this study indicate that community participation in various stages of sand mining business licensing in Sidenreng Rappang Regency consists of determining the Mining Area as a requirement for preparing the Mining Business Permit Area, Regional Spatial Planning, and submitting and issuing environmental permits. The community participation related to their involvement in the issuance of mining business permits is considered not to have been effective as based on Law No. 3 of 2020, Law No. 32 of 2009, Government Regulations No. 8 of 2018, Government Regulations No. 22 of 2021, Regulation of the Minister of State Environment No. 17 of 2012, as well as related laws and regulations. Therefore, the Regional Government of Sidenreng Rappang Regency must be proactive in involving the local community, especially environmental impact analysis or environmental management efforts and environmental monitoring efforts. In addition, it is hoped that the Regional Government of Sidenreng Rappang Regency will re-identify the completeness of the mining business license requirements for mining business actors when they want to extend the mining business permits of the related companies.

Abstract

International treaty law confronts a fundamental dialectic between the stability guaranteed by the principle of pacta sunt servanda and the demand for flexibility driven by disruptive global dynamics. The principle of rebus sic stantibus serves as a theoretical safety valve to ensure justice. In practice, however, it has become a paradox: a doctrine that is formally recognized yet rendered virtually inaccessible by highly restrictive interpretations. Through normative legal research employing statute, conceptual, and jurisprudential analysis approaches, this study examines the legal architecture and judicial practice that shape this doctrine. The analysis reveals that its codification in Article 62 of the 1969 Vienna Convention deliberately established onerous cumulative conditions. This policy is reinforced by the judicial practice of the International Court of Justice, which has consistently rejected claims of a fundamental change of circumstances in key cases. It creates a significant chasm between the doctrine’s theoretical existence as an instrument of justice and the reality of its severely limited application, establishing it as a ‘sleeping giant’ within the international legal order. This study concludes that this rigidity threatens the relevance of treaty law in responding to contemporary crises, such as systemic climate change and technological disruption. Therefore, this study recommends a renewed discourse on a more dynamic interpretation to rebalance stability with justice.

Abstract

Ancaman cyber bullying merupakan risiko yang bisa dialami baik oleh anak-anak maupun orang dewasa. Namun, anak-anak yang menggunakan media sosial tanpa pemahaman yang cukup mengenai cyber bullying cenderung lebih rentan, terutama dalam hal kesehatan mental mereka. Dalam penulisan ini digunakan metode penelitian hukum normatif. Penelitian hukum normatif adalah jenis penelitian yang berfokus pada penggunaan sumber hukum utama, yaitu peraturan perundang-undangan yang berlaku. Adapun rumusan masalah dalam penelitian ini yakni Pertama, Bagaimana Pertanggungjawaban Pidana anak terhadap Cyber Bullying; Kedua, Bagaimana Penanggulangan terhadap Cyber Bullying di Kalimantan Utara. Hasil penelitian ini yaitu Penanggulangan cyberbullying di Kalimantan Utara dilakukan melalui tiga pendekatan utama, yaitu metode Komunikasi dan Informatika (KOMINFO), pemahaman dan kepatuhan terhadap etika berinternet, serta pendekatan dari perspektif korban. Metode KOMINFO berperan dalam sosialisasi etika digital dan penyediaan platform pelaporan. Etika berinternet ditanamkan melalui pendidikan formal maupun komunitas agar masyarakat terbiasa berperilaku positif di ruang digital. Sementara itu, pendekatan dari sisi korban menekankan pentingnya dukungan psikologis dan perlindungan hukum. Sinergi antarinstansi seperti pemerintah daerah, kepolisian, lembaga pendidikan, dan KOMINFO menjadi kunci dalam menciptakan ruang digital yang aman, sehat, dan beretika di Kalimantan Utara

Abstract

Although the codification of corporate criminal liability in Law Number 1 of 2023 marks a paradigmatic advancement in Indonesian criminal law, its implementation is overshadowed by normative vulnerabilities that could undermine legal certainty. This research aims to critically analyze the architecture of corporate criminal liability, as regulated in Articles 45 through 50 of Law Number 1 of 2023, to identify its inherent conceptual and structural problems. Using a normative legal research method supported by statutory and conceptual approaches, as well as systematic interpretation techniques, this study dissects each layer of the norms that construct this liability mechanism. The findings indicate that Law Number 1 of 2023 has progressively expanded the definition of criminal law subjects and the scope of perpetrators to include beneficial owners, while also formulating pragmatic criteria for corporate fault. However, behind this progress, two fundamental problems were identified. First is the normative ambiguity arising from open-ended phrases such as “or that which is equated to it,” which risks creating disparities in judicial decisions. Second is a structural disharmony reflected in the functional redundancy between Articles 47 and 49 of Law Number 1 of 2023. It is concluded that the effectiveness of this entire corporate criminal liability framework will heavily depend on the active role of the judiciary as a law-finder (rechtsvinder) to clarify normative obscurities. Therefore, the issuance of technical guidelines by the Supreme Court is an urgent necessity to ensure consistent and just implementation.
