Abstract

This study aims to understand the essence of community participation in various stages of a sand mining business permit in Sidenreng Rappang Regency. This research was conducted using an empirical legal research method with data collection techniques through interviews, documentation studies, and data recording directly related to the research problem. The results of this study indicate that community participation in various stages of sand mining business licensing in Sidenreng Rappang Regency consists of determining the Mining Area as a requirement for preparing the Mining Business Permit Area, Regional Spatial Planning, and submitting and issuing environmental permits. The community participation related to their involvement in the issuance of mining business permits is considered not to have been effective as based on Law No. 3 of 2020, Law No. 32 of 2009, Government Regulations No. 8 of 2018, Government Regulations No. 22 of 2021, Regulation of the Minister of State Environment No. 17 of 2012, as well as related laws and regulations. Therefore, the Regional Government of Sidenreng Rappang Regency must be proactive in involving the local community, especially environmental impact analysis or environmental management efforts and environmental monitoring efforts. In addition, it is hoped that the Regional Government of Sidenreng Rappang Regency will re-identify the completeness of the mining business license requirements for mining business actors when they want to extend the mining business permits of the related companies.

Abstract

In Indonesia, the fundamental right to health is enshrined in the 1945 Constitution, affirming every person's entitlement to live a safe and prosperous life with access to health services. The 2023 Health Law focuses on six pillars, including health security, funding, human resources, technology, primary care, and referral services, aiming to alleviate financial burdens through progressive financing. Particularly significant is the procedural change in protecting health workers, notably medical personnel, through the implementation of restorative justice methods. This article critically examines the implications of the 2023 Health Law on victim redress, particularly concerning medical personnel protection and the application of restorative justice in life-threatening medical error cases. However, the provision regarding the handling of medical personnel facing criminal allegations and disciplinary sanctions raises concerns regarding clarity and implementation. Ambiguities surrounding key terms and the prioritization of restorative justice mechanisms without clear guidelines may result in delays and inconsistencies in the legal process. This study sheds light on the need for clarity and refinement in legal frameworks to ensure the protection of both medical personnel and patients while promoting accountability and justice within the healthcare system.

Abstract

Prior to the implementation of the Job Creation Law, wastewater management in Indonesia was governed by the granting of liquid waste management permits. Nevertheless, the implementation of the new law has supplanted these licenses with a technical approval system that mandates adherence to wastewater quality requirements. This study aims to examine the current legal framework governing wastewater management in Indonesia and assess its execution under the Job Creation Law, with a focus on environmental sustainability. The employed methodology is a normative and empirical legal research strategy, utilizing qualitative analysis via document examination and field observation in Kendari City. The findings suggest that the new legislation encounters implementation difficulties, particularly in overseeing wastewater from home and small-scale enterprises, such as laundry services, which are predominantly unregulated. The conclusion is that the existing legal framework has not adequately integrated principles of environmental ethics, including anthropocentrism and ecocentrism. Consequently, legal reform and the establishment of ethical principles are essential to guarantee environmental preservation and foster the sustainability of ecological functions.

Abstract

Indonesia’s criminal justice system confronts a fundamental paradox. Constitutional guarantees of citizen protection clash with the architecture of Law Number 8 of 1981, which is inherently offender-oriented and retributive in its paradigm. Ironically, the reform effort through the Criminal Procedure Code Bill, projected as a solution, risks creating a new “illusion of protection.” The draft Bill presents a seemingly progressive showcase of witness and victim rights. However, it simultaneously fails to provide an integrated enforcement mechanism and even introduces norms that could create systemic disharmony. This research aims to analyze the urgency of the problem and to formulate a holistic integration model for LPSK as a response to this systemic malady. Employing a hybrid legal research method that combines a juridical-normative analysis of the regulatory framework with a qualitative approach through an in-depth interview with an LPSK senior expert, this study finds that the LPSK’s structurally isolated position has led to serious institutional friction and ambiguous authority, despite its proven crucial role in strategic cases. Therefore, it is concluded that the required solution is a structural transformation. This study recommends a systemic integration model via two pathways: an imperative revision of the Criminal Procedure Code Bill, or the strengthening of the LPSK through an amendment to Law Number 13 of 2006 as a synchronized lex specialis, to ensure the realization of a criminal justice system that is substantively centered on witnesses and victims.

Abstract

Penguatan Kinerja Komisi Pemberantasan memang sangat diperlukan mengingat korupsi adalah tindak pidana yang mengancam kemajuan Negara,Penelitian ini bertujuan untuk mengetahui kinerja Komisi Pemberantasan Korupsi setelah adanya Dewan Pengawas dalam tubuh Komisi Pemberantasan Korupsi. Penelitian ini menggunakan metode pendekatan Kualitatif dengan menggunakan pendekatan Perundang-undangan dengan konsep dan ruang lingkup dari permasalahan yang berkaitan dengan isu-isu, data/ informasi fakta dan peristiwa-peristiwa. Hasil penelitianini menunjukkan bahwa kesimpulan awal, Keberadaan dewan pengawas sebagai sesuatu yang baru dalam tubuh KPK terlalu superbody yang diantaranya dimuat dalam Pasal 37 dan Pasal 47 Kewenangansehingga menyentuh Pro justicia sehingga mengganggu sifat pelaksanaan tugas KPK yang bersifat independent apalagi Dewan Pengawas yang memiliki kewenangan yang lebih besar dari pimpinan KPK serta Dewan Pengawas tidak takluk kode etik,bebas bertemu dengan seseorang dan tidak taklut kepada peraturan KPK di sinilah terjadi potensi penyalahgunaan jabatan sehingga keseimbangan atau Check and balance tidak tercapai sehingga muncul dalam tubuh KPK yang ujungnya tidak menciptakan Penguatan Kinerja dalam tubuh KPK

Abstract

This study aims to optimize the implementation of the legislative function in the village consultative organization. This study using sociolegal law research methods, data collection techniques used are interviews, direct observation, literature study. All data obtained from this study, both primary data, secondary data, and tertiary data, are then processed and analyzed qualitatively for further description in order to provide understanding by explaining the results of this study, ideally, it discusses and agrees on a village regulation draft from the right of initiative. The proposal purpose is to gather the aspirations from the village community and stipulated in a village regulation product. However, the implementation of proposals and designs proposed by the Village Deliberative Council was low, resulting in the lack of village regulations being produced. There are 179 villages in Merauke district, none of it has village regulation product initiatively.. The decline performance of the Village Deliberative Council will result in ineffective legislative functions. Appropriate regulations, namely renewal and improvement in terms of Quality, Quantity, Timeliness, Effectiveness, Independence, Environment, become benchmarks in optimizing the legislative function of Village Deliberative Council. Something questionable here is whether the village community can follow the changes or reject the changes.

Abstract

The principle of ex aequo et bono occupies a unique position within Indonesia’s legal landscape: although not expressly codified, it is increasingly invoked by judges to pursue substantive justice in employment termination disputes. This judicial practice, however, raises concerns regarding legal certainty and the boundaries of judicial authority, especially when decisions extend beyond the parties’ claims and risk violating the ultra petita doctrine. This article examines the application of ex aequo et bono in Indonesian labor courts through a normative legal analysis, using both comparative and conceptual approaches. A focal point of the study is Supreme Court Decision No. 223 K/Pdt.Sus-PHI/2017, in which the court terminated an employment relationship despite neither party explicitly requesting such relief. By comparing Indonesia’s judicial approach with the Netherlands, where ex aequo et bono is permitted exclusively within arbitration and only with explicit party consent. This article highlights the structural safeguards embedded in Dutch law that preserve both fairness and legal certainty. The results show that Indonesia’s unregulated use of ex aequo et bono creates inconsistencies and risks judicial overreach, underscoring the urgent need for statutory guidance. This study argues that incorporating explicit party consent and clearer procedural boundaries into Indonesia’s labor dispute resolution framework would better harmonize equity-based reasoning with the principles of legal certainty and judicial accountability.
